Hinweise zum Export von Wibu-Systems-Produkten
Die folgenden Informationen geben Hinweise für den Export unserer Produkte. Die Hinweise wurden nach bestem Wissen und Gewissen zusammengestellt, dennoch können wir deren Richtigkeit nicht zusichern. Ferner
ändern sich gesetzliche Vorgaben ständig.
Werden Wibu-Systems-Produkte integriert in Kunden-Software oder Komplettsysteme, greift in den meisten
Fällen die „de minimis“-Regelung. Der Wert der Wibu-Systems-Komponente am Endprodukt ist so gering, dass
dies nicht separat deklariert werden muss. In diesem Fall können die untenstehenden Angaben und Prüfungen
entfallen.
Statistische Warennummer (HS Code):
Folgende statistische Warennummern können für WibuKey- und CodeMeter-Hardware angegeben werden:
84733020: Zusammengesetzte Elektronische Schaltungen (offizielle verbindliche Auskunft des deutschen
Zolls) oder
85235110: Nichtflüchtiger Halbleiterspeicher, ohne aufgezeichnetet Daten (Solid state nonvolatile memory, unrecorded), gilt auch für WibuBoxen oder CmSticks ohne Flash-Disk, da sie jeweils mindestens 16kByte nichtflüchtigen Speicher haben.

Ursprungsland/Präferenznachweise:
1. Wettbewerbsrechtlicher Ursprung: „Made in Germany“.
2. Allgemeiner Ursprung: Die IHK kann ein sog. „Ursprungszeugnis“ ausstellen, da die Produkte bei der WIBUSYSTEMS AG in Deutschland entwickelt und hergestellt sind.
3. Präferenzursprungseigenschaft: Es muss nach Regeln entsprechend internationaler Abkommen geprüft werden, um dann eine Langzeit-Lieferantenerklärung ausstellen zu können.
Für Wibu-Systems Produkte kann dies erfolgen, mit Ausnahme von CodeMeter Produkten mit einem großen
Flash-Speicher, da die Flash-Speicherchips aus Korea oder Japan stammen und nicht 40% des Gesamtwerts
des Produkts überschreiten dürfen.
Eine Langzeitlieferantenerklärung und/oder EUR-1 Bescheinigung (entweder Formular ab 6000 EUR oder Text
auf Rechnung) ist eigentlich überflüssig, wenn unsere Produkte im Zielland zollfrei eingeführt werden können.
Dies gilt bei unseren Produkten mit HS 84733020 in den meisten Ländern. Die EUR-1 kann daher entfallen.

Auskunft zur Güterliste – Dual Use Verordnung EG VO 1334/2000:
Wibu-Systems kann eine BAFA-Auskunft zur Güterliste für alle Produkte zur Verfügung stellen. Diese AzG bestätigt gleichzeitig, dass die Produkte nicht als „Dual-Use“ gemäß Verordnung EG VO 1334/2000 einzustufen
sind. Es darf in alle Länder exportiert werden.
Sobald ein Embargo in Kraft tritt, ist der Export dorthin verboten. Besonderes Vorgehen ist derzeit bei Ländern
wie Iran, Kuba, Nordkorea, Sudan und Syrien notwendig (Übersicht Embargos: http://www.ausfuhrkontrolle.info).

Produkte unterliegen nicht der Ausfuhrliste AL:
AL heißt Ausfuhrliste. Die AzG des Bundesausfuhramts bescheinigt, dass die Wibu-Systems-Produkte nicht als
„Dual-Use“ einzustufen sind und der AL nicht unterliegen.

Anmerkung 3: Kryptotechnik-Anmerkung: Die Nummern 5A002 und 5D002 erfassen keine Güter, die alle folgenden Voraussetzungen erfüllen:
a) Die Güter sind frei erhältlich und werden im Einzelhandel ohne Einschränkungen mittels einer der folgenden
Geschäftspraktiken verkauft:
1. Barverkauf, 2. Versandverkauf, 3. Verkauf über elektronische Medien oder 4. Telefonverkauf;
b) die kryptografische Funktionalität der Güter kann nicht mit einfachen Mitteln durch den Benutzer geändert
werden;
c) die Güter sind entwickelt, um vom Benutzer ohne umfangreiche Unterstützung durch den Anbieter installiert
zu werden, und
d) um die Übereinstimmung mit den unter a bis c beschriebenen Voraussetzungen feststellen zu können, sind
detaillierte technische Beschreibungen der Güter vorzuhalten und auf Verlangen der zuständigen Behörde des
Mitgliedstaates, in dem der Ausführer niedergelassen ist, vorzulegen.
Anmerkung 4: Kategorie 5 Teil 2 erfasst keine Guter, die „Kryptotechnik“ verwenden oder beinhalten und alle
folgenden Voraussetzungen erfüllen:
a) Die Hauptfunktion oder die Menge der Hauptfunktionen ist keine der folgenden:
1. „Informationssicherheit“, 2. ein Computer, einschließlich Betriebssystem, Teile und Bestandteile hierfür, 3.
Senden, Empfangen oder Speichern von Informationen (außer wenn sie dem Entertain-ment, kommerziellen
Massenübertragungen, dem digitalen Rechtemanagement (DRM) oder dem Management von medizinischen
Datensätzen dient) oder 4. Netzwerkfunktionalitat (Networking) (einschließlich Betrieb, Verwaltung, Management und Bereitstellung);
b) die kryptografische Funktionalität beschränkt sich darauf, die Hauptfunktion oder der Menge der Hauptfunktionen der Güter zu unterstützen, und
c) um die Übereinstimmung mit den unter den Buchstaben a und b beschriebenen Voraussetzungen feststellen
zu können, sind detaillierte technische Beschreibungen der Güter vorzuhalten und auf Verlangen der zuständigen Behörde des Mitgliedstaats, in dem der Ausführer niedergelassen ist, vorzulegen.
Schlüssellängen
Die Algorithmen sind im Handbuch und den technischen Datenblättern aufgeführt. Es wird FEAL32 64 Bit, AES
128 Bit, ECC 224 Bit, RSA 1024 Bit, TDES und SHA-256 verwendet.
US Export Control Classification Number ECCN:
Die Wibu-Systems Produkte sind deutschen Ursprungs und in Deutschland hergestellt. Sie enthalten keine als
sensibel gekennzeichneten genehmigungspflichtigen Produkte, Software oder Technologien mit US-Amerikanischem Ursprung und unterliegen damit nicht der Export Administration Regulation, EAR, der USA. Wibu-Systems Produkte haben daher keine ECCN Nummer.

Information about export of Wibu-Systems Products
The following information provides instructions for the export of Wibu-Systems products. The notes have been
compiled to the best knowledge and belief, but we cannot guarantee its accuracy. Furthermore, legal requirements are constantly changing.
Wibu-Systems products are integrated into client software and complete systems, takes in most cases, the „de
minimis“ rule. The value of the Wibu-Systems component of the clients product is so low that it need not to be
declared separately. In this case, the information below, and tests may be omitted.
Commodity Code (HS Code):
The statistical goods numbers, HS codes, for WibuKey and CodeMeter hardware is as following:
84733020: Composite Circuits (officicial HS code selection from German customs) or
85235110: Solid-state nonvolatile memory, unrecorded, also applies to WibuBoxes or CmDongles without flash
disk, since they each have at least 16kB non-volatile memory.

Country of Origin / Preference Documents:
1. Origin regarding law of competition: „Made in Germany“.
2. General origin: The Chamber of Commerce can issue a so-called „Certificate of Origin“ because the products
are in the WIBU-SYSTEMS AG developed and manufactured in Germany.
3. Preference Origin: this must be tested according to rules of international agreements in order to be able to
issue long-term supplier‘s declaration. For all Wibu-Systems products it can be provided with the exception of
CodeMeter products with a large flash memory. The flash memory chips are from Korea or Japan origin. It’s value must not exceed 40% of the total value of the product to be able to issue a long-ter, supplier’s declaration.
A long-term supplier‘s declaration and / or EUR-1 certificate (either form from 6000 EUR or text on invoice) is
not necessary if our products in the target country can be imported duty free. This applies to our products with
HS 84733020 in most countries. The EUR-1 can be omitted.

Commerce Control List – Dual Use Rule EG VO 1334/2000:
Wibu-Systems can provide a so called „Auskunft zur Güterliste“ for all products from german authority BAFA,
Bundesausfuhramt. This AzG confirms that our products are not classified as „Dual-Use Items“ in accordance
with Regulation EC REG 1334/2000. It may be exported to all countries.
Once an embargo comes into force, the export is banned there. Special proce
dure is currently in countries such as Iran, Cuba, North Korea, Sudan and Syria required (Embargoes overview:
http://www.ausfuhrkontrolle.info).
Testing for terrorist threat:
For all deliveries outside the European Community and also in case of doubt, the buyer should be verified that

Note 4: Category 5, Part 2 does not apply to items incorporating or using “cryptography” and meeting all of the

1. “Information security”; 2. A computer, including operating systems, parts and components therefor; 3. Sending, receiving or storing information (except in support of entertainment, mass commercial broadcasts, digital rights management or medical records management);or 4. Networking (includes operation, administration,
management and provisioning);
b. The cryptographic functionality is limited to supporting their primary function or set of functions

authority in the exporter‘s country in order to ascertain compliance with conditions described in paragraphs a.
and b. above.
Key Lengths
The algorithms are listed in the manual and the technical data sheets. It is used 64-bit FEAL, 128-bit AES, 224bit ECC, 1024-bit RSA, TDES and SHA-256.
US Export Control Classification Number ECCN:
The WIBU-Systems products are of German origin, and manufactured in Germany. They do not contain sensitive products subject to authorization, software or technology of U.S. American origin, and thus not subject to
the Export Administration Regulation, EAR, the United States.
WIBU-Systems products have therefore no ECCN number.
