A necessidade urgente de proteger e promover o direito humano à

Re: A necessidade urgente de proteger e promover o direito humano à água nas Metas do
Desenvolvimento Sustentável da ONU
Prezado Senhor Embaixador
Nós, organizações abaixo assinadas, instamos o Grupo Aberto de Trabalho sobre as Metas do
Desenvolvimento Sustentável, para que, explicitamente, afirme seu compromisso em proteger e promover o
direito humano à água e saneamento, na programação e implementação das Metas do Desenvolvimento
Sustentável. Unimo-nos ao insistente apelo da sociedade civil, no mundo todo, para assegurar que os
objetivos do Desenvolvimento Sustentável estejam explicitamente alinhados ao contexto dos direitos
humanos.
Muitos de nós estivemos ativamente engajados no processo da Conferência das Nações Unidas sobre
Desenvolvimento Sustentável (Rio+20) e temos seguido e defendido, cuidadosamente, no Grupo Aberto da
Assembleia Geral, as Metas do Desenvolvimento Sustentável desde março de 2013.
Estamos
profundamente preocupados, pois, apesar de nosso apelo claro e urgente em maio de 2014, o Anteprojeto
Zero (2 junho,2014) não incluiu uma referência explicita aos direitos humanos e à água e saneamento.
Para a agenda pós-2015 atingir seus objetivos de ser justa, centrada nas pessoas e sustentável, suas
metas devem priorizar - para as gerações presentes e futuras – o direito humano à água para saúde,
vida, alimento e cultura acima de outras demandas sobre os recursos hídricos.
Isso é ainda mais crítico devido ao papel chave da água para alcançar outros objetivos do desenvolvimento
sustentável, como energia e produção de alimentos, questões de gênero e atenuação das mudanças
climáticas.
As Metas para o Desenvolvimento do Milênio devem ser planejadas para catalisarem a capacidade crescente
e a vontade política dos Estados para cumprirem suas obrigações legalmente estabelecidas de respeitar,
proteger e promover o direito humano à água e ao saneamento. Em 2010, a Assembleia Geral da ONU
reconheceu "o direito à água limpa e potável e o saneamento como direito humano essencial para o gozo
pleno da vida e de todos os direitos humanos" (resolução 64/191, par. 1). Os Órgãos do Tratado da ONU
reconheceram que, com isso, a lei internacional já existente havia sido ratificada.
A Convenção sobre a Eliminação de Todas as Formas de Discriminação Contra as Mulheres estabelece que
os estados devem assegurar às mulheres o direito a "ter condições adequadas de vida, particularmente em
relação à (...) provisão de água, (Artigo 14 (2)). A convenção sobre o Direito das Crianças requer dos
responsáveis o combate a doenças e desnutrição "através de provisões de alimentos adequados à nutrição e
água potável" (Art.24 (2)). De maneira persuasiva, o Comitê Dos Direitos Econômicos, Sociais e Culturais
conclue que o direito à água é essencial para assegurar um padrão de vida adequado e "inextrincavelmente
relacionado ao direito do mais elevado padrão possível de saúde" (Comentário Geral N. 15, par. 3).
Entretanto, nossas organizações temem que o direito humano à água e ao saneamento continue a ser
contestado no contexto da competição global por escassos recursos de água. Estamos preocupados com que
a agenda do desenvolvimento, se não estiver comprometida, explicitamente, na sustentação desse direito
humano vital, acabe minando-o.
O fato de não explicitar esse direito na Agenda das Metas do Milênio seria uma regressão do progresso que
os Estados Membros da ONU haviam feito quando destacaram o reconhecimento e a proteção a esse direito
humano fundamental.
Nós, portanto, respeitosamente os conclamamos a assumir liderança e comprometimento com o direito
humano à água durante a próxima sessão dos Grupo Aberto de Trabalho nos GDS.
Exortamo-los a insistir com foco nos direitos humanos assim que a próxima sessão do Grupo Aberto de
Trabalho:
a) inclua explicitamente o direito à água e ao saneamento na Agenda das Metas do Milênio;
b)alinhe os objetivos ao contexto dos direitos humanos e garanta a não discriminação, a transparência e a
participação pública nos processo de tomada de decisões.

importante diálogo na 12ª sessão do Grupo de Trabalho Aberto.
