Main discussions and approvals: • 06 April 2010: o No discussion4 • 12 April 2010: o Discussion and voting in generality of the PPL 32/II on Precedence in State Protocol Result: Approved in generality with 37 votes in favour, 0 against and 4 abstentions • 13 April 2010: 1. Discussion and voting of “Voto de Pesar” 5 honoring the President of Poland H. E. Mr. Lech Kaczynski and expressing condolences on behalf of people of Timor-Leste. Result: Final approval with 33 votes in favour, 0 against and 0 abstentions 2. Discussion and internal voting6 authorizing the MP Paulo de Fatima Martins (CNRT) to provide a witness declaration7 to the Dili District Court. Result: Final approval with 33 votes in favour, 0 against and 0 abstentions o Discussion and voting in speciality of the PPL 32/II on Precedence in State Protocol Result: no final voting • 14 April 2010 (extraordinary session): o Swearing-in Ceremony of the Provedor for Human Rights and Justice, Mr. Sebastião Dias Ximenes and its deputies for Human Rights, Mr. Silverio Pinto Baptista and for Good Governance, Mr. Rui Pereira dos Santos8 3 There was no Plenary session on 05 April 2010 as it was a public holiday The plenary agenda 291/II included discussion in generality of the PPL 32/II on “Precedence of State Protocol”. However the discussion was postponed as the Minister of Foreign Affairs was on official travel overseas. 5 “Condolences Vote” or “Grieve Vote”: This document expresses condolences of the National Parliament. Based on previous cases, those voting are published as “Voto de Pesar” on the Jornal da República Série I. For the statistic methodology used in this report, it has been considered as “other approvals”, as it is neither a law nor a resolution, but it is officially approved in Plenary sessions. 6 As it is regarding an internal voting, for statistical procedures, it is considered as “other approvals” as voted in Plenary session. Result: Final approval with 40 votes in favour, 0 against and 0 abstentions 4. Discussion and voting of the Project Resolution 41/11 on the official travel of the President of the Republic to the Kingdom of Cambodia and Socialist Republic of Vietnam. Result: Final Approval with 33 votes in favour, 0 against and 4 abstentions 5. Discussion in speciality and final voting of the PPL 32/II on Precedence in State Protocol Result: Final Approval with 29 votes in favour, 1 against and 5 abstentions • 20 April 2010: o Presentation and discussion on the report of the visit of the Commission G to the Districts of Baucau, Lautem, Ainaro, Aileu, Ermera and Liquica. Result: Discussion with no voting necessity • 26 April 2010: o Discussion in speciality of the PPL 31/II on Domestic Violence Law10 Result: no final voting • 27 April 2010: o Presentation and discussion Report of Committee F (Health, Education and Culture) on their comparative and monitoring visit to Philippines, Malaysia, Thailand, Singapore and Indonesia (Yogyakarta-Surabaya) from 18 July 2009 to 09 August 200911. Result: Discussion with no voting necessity o Discussion in speciality of the PPL 31/II on Domestic Violence Law Result: no final voting 9 “Condolences Vote” or “Grieve Vote”: Idem of Footnote nº 5 . PPL 31/II on Domestic Violence Law was approved in generality on 22 March 2010, with 40 votes in favour, 0 against and 2 abstentions 11 Monitoring observation: The report was presented and discussed almost 8 months after the conclusion of the official travel. 10 7 Monthly Governance Report – April 2010 Extraordinary Activities of the Parliament • • On 07 April 2010: the chief of Parliamentarian benches attended Donors Meeting From 21 to 22 April 2010: International Conference on Anti-Corruption organized by Committee C in the premises of the Ministry of Foreign Affairs. Main issues raised in the Plenary sections: 1. Misuse and lack of transparency of the funds of the Referendum Package and quality of the projects executed 2. Fretilin request for a Commission of Inquiry (COI) on the construction of the BeBui Irrigation project in Viqueque District 1. Road Traffic Code and the illiteracy of a high number of drivers 2. Expression of preoccupation regarding the increase of alcohol consumption by youth population in Timor-Leste 3. Security in Suco and the Martial Arts Groups activities 4. Questions regarding the rectification of the State Budget after the implementation of the Referendum Package 5. Comments about the PNTL Ninja operation in Bobonaro and Covalima 6. Discussion on the hierarchical level between FFDTL and PNTL for protocol issues and need for conflict prevention. 7. Expression of successful election on 17 April 2010 of the President of the Chamber of Commerce, Mr. Julio Alvaro. 8. Urgency to establish a “pardon law” with clear criteria for President’s indults 9. Appraisal to the UN Democratic Governance Forum for the promotion of dialogue and a culture of democratic governance. 10. Lack of availability of clean water in most part of Dili. 11. Food shortage in Lautem District 12. Accusation from the opposition that the Prime-Minister is on political campaign instead of Popular Consultation.Complaint regarding the visits of the Prime-Minister without previous discussion with the National Paliament on the Government’s Strategic Plan. 13. For transparency and accountability, MPs should declare their assets 14. Report of Commission G visit to the Districts of Baucau, Lautem, Ainaro, Aileu, Ermera and Liquica, mainly regarding road construction, water irrigation, rehabilitation of hospitals and buildings of schools. 15. According to the article 11 of the Rules of Procedure of the National Parliament: “The duties of a Member of Parliament shall be as follows: a) To report punctually to and attend sessions of the Plenary and meetings of the committees he or she serves on”. In addition, article 5 of the National Parliament Rules of Procedure states that. “A Member of Parliament who is to absent himself or herself for more than three consecutive days on substantiated grounds may, through his or her political party, submit a request for an early justification of absence and temporary replacement of office”. 13 All information regarding official attendance in this section is based on the “Lista de Presença dos Deputados” prepared by the Secretariat of the National Parliament. The attendance data is based on the signature of the Member of the Parliament (MP) who signs the attendance sheet during a plenary session. Therefore, this does not mean that the MP attended the entire session. In addition, this official visit also allowed strengthening the bilateral cooperation for capacity building of the Timorese civil servants thought the program of Intensive Internship in Civil Service established by the Government of Timor-Leste and Northern Territory of Australia. • On 20 April 2010: 10th Extraordinary Meeting The commissioners discussed the establishment of a policy of conversion of temporary employees to permanent employment status. CSC will present recommendations to the Government and will provide assistance to the Ministries for its implementation. • On 22 April 2010: Directors and Chiefs of Department attended an internal meeting to explained CSC Strategic Plan 2009-2014 and to prepare the workshop for the Annual Activities Plan. • On 23 April 2010: Workshop attended by directors and department chiefs with the objective to discuss the Annual Activities Plan. • On 26 April 2010: A media release on the CSC leadership for the transparency of the recruitment of temporary Census employees was released. • On 29 April 2010: The first Inter-Agency Training and Development Consultative Committee has held with the presence of representatives of 11 ministries and INAP with the purpose of develop a comprehensive and systematic training and development framework for all civil servants. • Recruitment Process: In order to ensure a transparent process, CSC supervised the recruitment process of temporary 3.990 staffs for the different projects for the Census 2010. These employers will have short term contracts between one and four months and thus, are not considered public servants. In parallel, CSC also supervised the recruitment of the first phase of the recruitment of 1.200 civil servants for every degree in all ministries. The first phase started in April for A and B degrees39. The rank shows how one country compares to others included in the index. The CPI score indicates the perceived level of public-sector corruption in a country/territory. Agreement resulting from the convergence of wills of two or more international law subjects, formalized in a written text, with the purpose of producing legal effects in the international plan. In other words, the treaty is a means through which international law subjects – mainly national States and international organizations – determine rights and obligations between themselves. The States and international organizations (and other international law subjects) that celebrate a certain treaty are called “Contracting Parties” (or simply “Parties”) of this treaty. As in many other countries, legislative texts enter into force only after being published. L LAW The word law can be used with three different meanings, according to the intended scope. In the broadest sense, law is every legal rule, written or not, and covers the habits and all rules formally produced by the State. In a broad sense, law is the written legal rule, excluding legal habit. In a strict sense, it means the normative act by excellence, issued from the National Parliament. LAW-MAKING Science that studies the ways of designing and writing normative acts. In colloquial terms, law-making is the art of drafting laws well, in the sense that it consubstantiates a set of rules – law-making rules – the purpose of which is to contribute to a good drafting of laws. Set of legal requirements for starting a process. Set of legal precepts regulating a certain matter. LEGAL PROCEDURES LEGISLATION LEGISLATIVE ACT LEGISLATIVE COMPETENCE LEGISLATIVE POWER M N Manifestation of the will with strength of law and meant to produce law effects. It is one of the three sovereign powers of the State, responsible for the drafting of laws. Legal capacity for drafting laws, decree-laws, regulations and decrees. Power to legislate, create and sanction laws. The goal is to draft law rules with general or individual scope that are applied to all society, in view of satisfying the needs of the pressure groups; public administration; society. The legislative power elementary functions include that of overseeing the executive power and voting on budget laws. - NATIONAL PARLIAMENT Assembly of representatives elected by the citizens in democratic regimes, normally holding legislative power. ORGANIC LAW Law on the organization and operation of the Government and respective Ministries. It covers the general dispositions and sets up the main functions and actuation instruments. O P PUBLIC ADMINISTRATION In organic or subjective sense, Public Administration is the set of State bodies, services and agents, as well as the further public legal persons, which ensures the satisfying of various collective needs, such as security, culture, health and the wellbeing of the populations. A person employed by Public Administration is called a civil servant. It can also be defined objectively as the concrete and immediate activity that States develop for ensuring collective interests, and subjectively as the set of legal bodies and persons to which the Law attributes the exercise of the administrative function of the State. Under the operational aspect, Public Administration is the perennial and systematic, legal and 82 Monthly Governance Report – April 2010 PROMULGATION PROJECT OF LAW PROPOSAL OF LAW technical development of the services belonging to the State, benefiting the whole. Internal legal act by which the President of the Republic attests the existence of a duly ratified law, Decree-Law, treaty, etc., and order its execution within the territory. It is important to highlight the difference, in practical terms, between the effects of ratification and those of promulgation. If a State ratifies a treaty but does not promulgate it (and if its constitutional law requires promulgation), the conventional text is mandatory in the international sphere but not in the internal one. In this case, the State in question may be asked by other Contracting Parts to fulfill some of its conventional obligations, but one of its internal bodies may refuse to do so because of lack of promulgation. The faulty State then incurs in a situation of international accountability. Text presented by the Deputies or Parliamentary Group to the Parliament, so that the latter can pronounce on it.
