The applicant is requesting a Special Use Permit to construct a Land Clearing and Inert Debris
Landfill (LCID)

ANALYSIS:
The Unified Development Ordinances (UDO) requires Planning Board Review and a Special Use
Permit be issued for Land Clearing and Inert Debris Landfill in residential zoning districts The
Board of Adjustment may issue the Special Use Permit if it believes that the request satisfies the
necessary findings of fact.
The site consist of 6.85 acres at the end of a private road. The LCID must meet the following
conditions:
2-5.41 - LANDFILL, LAND CLEARING AND INERT DEBRIS (LCID)
(A) State Law .....Land clearing and inert debris landfills (LCID) shall comply with State law.
with
(B Access .....Access to the land clearing and inert debris landfill area shall be controlled
security fencing or other barrier to vehicular access.
(C) Setbacks .....All land clearing and inert debris landfills shall be setback at least one
hundred (100) feet from any interior property line or from any adjoining public or private
street right-of-way. If located between one hundred (100) feet to two hundred (200) feet from
any interior property line or from any adjoining public or private street right-of-way, the
intervening area shall be left undisturbed except for access or erosion control devices for the
LCID. If the LCID is located at least two hundred (200) feet of the property line or from any
adjoining public street or private right-of-way, the intervening land may be disturbed.
(D) Permit Duration and Renewals .....Any land clearing and inert debris landfills which
received approval from the State of North Carolina Department of Environment and Natural
Resources (DENR) and were established prior to December 31, 1994, and for which a valid
State permit has been continuously maintained shall not be required to obtain a Special Use
Permit from the Board of Adjustment. All other land clearing and inert debris landfills must
obtain either a Special Use Permit from the Zoning Board of Adjustment or a Planning Board
Review whichever is required in the zoning district in which the LCID is located. Said permit
shall be valid for a maximum of three (3) years, after which time renewals may be granted for
up to three (3) years at a time.

(E) State Permit Approval .....No permits for land clearing and inert debris landfills shall be
approved until all plans, including plans for rehabilitation of sites, have been reviewed and
approved by the North Carolina Department of Environment and Natural Resources (DENR).
(F) Landfill Recording and Rehabilitation/Reuse Plan .....The area(s) of the site used for fill
material shall be recorded by instrument with an attached survey map in the Office of the
Register of Deeds. Developer shall also file in the office of the Register of Deeds a
rehabilitation/reuse plan for the site. Both of these requirements shall be completed prior to
the issuance of a zoning or grading permit. Said plan shall be implemented by the owner of
the site within six (6) months of discontinuance of the land clearing and inert debris landfill
operation or expiration of the permit.
(G) Temporary Discontinuance .....Notice of intent to discontinue temporarily a land clearing
and inert debris landfill shall be filed with the Director of Inspections in advance of such
temporary discontinuance. Notice of intent to discontinue permanently a land clearing and
inert debris landfill operation shall be filed with the Director of Inspections not less than three
(3) months in advance.
(H) Maintenance .....During any period that a land clearing and inert debris landfill operation
is temporarily discontinued, the site, along with all structures, machinery, and fencing shall
be properly maintained in a safe and orderly condition.
(I) Siting Criteria .....The siting criteria for land clearing and inert debris landfills, found in
Solid Waste Management Rules, 15 A NCAC 13B, Section .0564, shall be followed.
(J) Burial of Organic Material (W) .....The burial of trees, brush, stumps, limbs, or other
organic material must comply with Chapter 10 of the Code of the City of Winston-Salem.
(I) Accessory Uses (W) .....The Zoning Board of Adjustment may issue a permit for the
separation, processing, storage, or wholesale sale of materials received through lawful
operation of the land clearing and inert debris (LCID) landfill on the site as an accessory use
on the site of an LCID, provided such activities occur within the original boundaries of the
State-approved LCID landfill and are conducted at least one hundred (100) feet from any
adjacent zoning lot zoned RS or RM.
(O) Hours of Operation .....In RS and RM Districts, the hours of operation shall be limited to
between the hours of 7:00 a.m. and 7:00 p.m.
It is the position of staff that the Special Use Permit request satisfies the required findings of fact
necessary to issue a Special Use Permit and thus the permit should be issued for Case # 2972.;

The above owner or applicant is requesting that this application be presented to, and heard by the Winston-Salem Zoning Board of Adjustment
at a meeting to be held on 2/6/2014, at 2:00 P.M., in the Bryce A. Stuart Municipal Building Public Meeting Room, Suite 530, Fifth Floor of
City Hall South, 100 E. First Street , Winston-Salem, NC.
As part of your application, and included in your filing fee of $200.00, a legal notice is published in the Winston-Salem Journal and the
Inspections division furnishes you with a sign(s) which must be posted in a conspicuous place on the premises prior to the date of the hearing.
The sign(s) must be attached to sufficient support and be clearly visible from a public street. If the property is located on the corner of two
public streets or has frontage on more than one public street, a sign needs to be placed on each public street. If the property is on a private
street or access easement, a second sign or lead in sign will need to be placed at the public street.
SIGN POSTING DATE IS 1/26/2014 BY 9:00 A.M. THE SIGN MUST BE LEFT UP UNTIL AFTER THE PUBLIC HEARING. Failure to
comply with these posting instructions will result in delay of the application and postponement of the hearing and decision to a later scheduled

VARIANCE REQUEST:
Request permission for a variance of rear yard requirements as per plot plan on file.
Acreage: 0.35 acre(s)
LOCATION:
Property is located at 1606 Salem Lake Road approximately 300’ north of Waughtown Street.
ANALYSIS:
The applicant purchased a permit to construct a 24’X30’X15’9” tall accessory building on his
property. As submitted the structure met all accessory structure requirements for setback
reductions. A framing inspection on October 9 2013 found the structure be over 17’ tall violating
accessory structure requirements to be less than 17’ tall for the structure location. The owner was
notified and a zoning case file was started on October 14, 2013. A violation letter has not been
issued due to negotiations with the owner and city staff. The owner has continued construction
without taking corrective measures. In this case, the proposed structure is 20’ 4” tall; thus, per
UDO requirements, the proposed structure must meet the principle setbacks of seven feet on one
side, with both sides equaling 20’, and the rear setback of 25’ from the property line. The
applicant is requesting a rear yard variance of 15.2’. The structure meets all other requirements
for accessory structures including the allowed size restriction, use, side yard and front yard
setbacks.
Staff visited the site to see if there were any grounds for a hardship to grant this variance.
The staff could not find a hardship to recommend approval of the variance as proposed.
