Airports
Since 2011, Brazil’s civil aviation regulatory authority, ANAC, has privatized a number of airports in order to improve
the quality of airport services and infrastructure, as well as to expand the number of flights offered.
Four airports have already been privatized, three of which are very important to the national economy: São Paulo’s
“Guarulhos” international airport, the “Viracopos” cargo airport in Campinas, and the international airport in Brazil’s
capital, Brasília.
Two additional important airports are expected to be put to bid for purposes of maintenance and expansion of
passenger and cargo capacity: Rio de Janeiro’s “Galeão” international airport and Belo Horizonte’s “Confins”
international airport. The criterion for bids for airport concessions is the highest fee offered to be paid for the right to

The Brazilian port sector has been subject to a number of changes since 2012, including significant reforms brought
about by Federal Law No. 12,815/2013 (“Port Law”), in order to modernize Brazil’s ports, as well to promote more
competition.
With the Port Law, the Government has undertaken studies of public bids for more than 150 public ports in Brazil,
which will be conducted by the Special Secretariat of Ports (“SEP”) in conjunction with Brazil’s development bank,
BNDES.
Recently, Brazil’s waterway transportation regulator, ANTAQ, announced that terminals in the Port of Santos, State of
São Paulo, and ports in the State of Pará will be the first block of terminals to be put to bid in 2013 under the Port
Law. The bid documents are expected to be issued by October, and bids may occur before the end of the year. The
second block includes ports in Paranaguá, in the State of Paraná, and Salvador and Aratu, in the State of Bahia. The
third block includes ports in Suape, in the State of Pernambuco, Itaqui, in the State of Maranhão, and other ports in
the north and northeast of Brazil. The fourth block consists of port terminals in Vitória, in the State of Espírito Santo,
Rio de Janeiro and Itaguaí, in the State of Rio de Janeiro, Itajaí and São Francisco do Sul, in the State of Santa
Catarina, and Rio Grande, in the State of Rio Grande do Sul)
For new bids under the Port Law, “highest cargo traffic” and “lowest tariff” have been adopted as the bid criteria for
the granting of new concessions and leases, instead of the “value of the award” criterion.
Notwithstanding the foregoing, investors are not limited to investing in ports via public bids: if an area is outside a
public port area, it is now possible to develop and operate private use terminals (“TUPs”), which may henceforth be
developed and operated pursuant to authorizations preceded by public calls (chamadas públicas).

Railways
Railway concessions in Brazil started in the mid-1990's in a context of the absence of investments by the public
sector. Now, Brazil faces an important change compared to past rail concessions, when both infrastructure and
services were provided together. Coming concessions are based upon a distinction between infrastructure and
services.
Brazil’s land transportation regulatory authority, ANTT, is currently overseeing railway concessions throughout the
country in order to improve and expand Brazil’s rail system, as well as to alleviate congestion in Brazilian ports.

Highways
Brazil’s highway regulatory body, ANTT, has a master plan for highway infrastructure in the coming years. The plan,
denominated “Step 3/Phase III for Federal Highway Concessions”, includes concessions throughout the country and
represents a change to the extent that previous concessions were concentrated in the coastal states.
These concessions will strategically link railways and ports, delivering more efficiently soy, iron, and sugar to trading
partners. As in the railway sector, the criterion for the selection will be the lowest toll fee charged to users.

5. Urban Transportation
The Federal Government has implemented “Urban Mobility Programs” (as part of the Growth Acceleration Programs
“PAC’s”) to improve access and expand infrastructure for urban transportation.
Currently, many PAC’s are underway in Brazilian cities, including headquarter cities for the World Cup in 2014.
Resources are being invested in subways systems, bus rapid transit (BRT), bus lanes, and high speed trains, among
others.

The concession of public services by the government to private partners exceeds the possibilities mentioned above.
The use of common concessions and public-private partnerships is increasing in Brazil, such mechanisms now being
