European Market Infrastructure Regulation] über OTC (over the counter)-Derivate, zentrale Gegenparteien und Transaktionsregister ___________________________________________________________ • Proposal for a Regulation of the European Parliament and the Council on Markets in financial instruments (MiFID) • Amending the Regulation on EMIR (European Market Infrastructure Regulation) concerning OTC-derivates, central counterparties and trade repositories 28/06/2012 Dr. Paul Rübig 9 Leerverkäufe und Kreditausfallversicherungen/ Short Selling and Credit Default Swaps • Vorschlag für eine Verordnung des Europäischen Parlaments und des Rates über Leerverkäufe und bestimmte Aspekte von Credit Default Swaps – – alle Leerverkäufe in Aktien müssen als solche gekennzeichnet werden („Flagging“) Leerverkäufe sollen nur gestattet sein, wenn der Investor sich die betreffenden Instrumente geliehen, eine Leihvereinbarung getroffen oder von einem Dritten die Zusage erhalten hat, die Instrumente zu lokalisieren und zu reservieren um die Geschäftsabwicklung bis zum Fälligkeitsdatum sicherzustellen. Aufsichtsbehörden sollen mit der Befugnis ausgestattet werden, Leerverkäufe zu verbieten oder einzuschränken. ___________________________________________________________ • Proposal for a Regulation of the Parliament and the Council on Short Selling and certain aspects of Credit Default Swaps – – all share orders on trading venues be marked as 'short' if they involve a short sale (“flagging”) For entering a short sale, an investor should have borrowed the instruments concerned, entered into an agreement to borrow them, or have an arrangement with a third party to locate and reserve them for lending so that they are delivered by the settlement date.
