ince the inception of
this official newsletter, Kaugmaran(KK)Kanunay, we have
been updating the people of
Tubigon our accomplishments
as the lawmaking body of the
municipality. Our records are
open and “you” as our masters, are all free to scrutinize
it, whether we meet with your
expectations.
We are again happy to
report that we have achieved a
100% quorum requirements in
all regular and special sessions, as well as, committee
meetings in order to resolve
some issues and concerns related to local governance.
The SB, as a collegial

government. Yes, it could
not be denied that we could
not satisfy everybody. But
we are always guided by
this very simple principle,
―that the interest of the majority is always over and

We have been cooperating with the executive department for the implementation of the following major

“2012 . . .The Year of the Dragon”
Its
New Year again and we
would want to start fresh with the so
many development initiatives in the
pipeline. The national government,
after being criticized for not spending
enough to pump prime the economy, is
poised to get the ball rolling in 2012.
The 2012 Local Government Unit
budget despite the 4.8% reduction in
Internal Revenue Allotment (IRA) is
still heavily laden with initiatives to
spur growth and development that we
think would redound to better socioeconomic opportunities for our people.
So, we are ready to march forward with
the New Year.
The long cherished dream of the
residents of the coastal areas of Tinangnan and Cabulijan that is the rehabilitation of the Tinangnan Bridge
which is currently in a near collapsed
state will soon be realized. The LGU
has received a 15 Million pesos special
grant for the rehabilitation of the said
infrastructure into a concrete two lane
bridge. The grant from the special LGU
subsidy fund of the Department of
Budget and Management was released
through the joint effort of the LGU,
Congressman Relampagos and Sec.

which stands for power, good luck,
success, and happiness.
The Year of the Dragon following
its symbolism offer brighter days
ahead, however, these are all based
on mythology. What is crystal clear
is we need to work hard and work
together to achieve our goals. We
need to take advantage of every opportunity that comes our way for it
may never come again. There will
always be challenges ahead but may
the New Year offer better beginnings and good tidings for everyone.

AN ORDINANCE AMENDING SECTION 5G.03 OF ARTICLE G, CHARGES OF PARKING FEES,
OF MUNICIPAL ORDINANCE No. 2002-11-212, OTHERWISE KNOWN AS ‘THE NEW REVENUE
CODE OF 2004 OF THE MUNICIPALITY OF TUBIGON AND FOR OTHER PURPOSES.

WHEREAS, the number of passenger buses, v-hires, and other public and private transportation already
adding bulk in the designated parking area of the municipality wherein a need for regulation must be implemented;
WHEREAS, the present parking fees implemented by the municipality was ordained during the fiscal
year 2004
WHEREAS, pursuant to Section 191 of Republic Act No. 7160, otherwise known as the Local Government Code of 1991, i.e., „Local government units shall have the authority to adjust the tax rates as prescribed
herein not oftener than once every five (5) years, but in no case shall such adjustment exceed ten percent (10%) of
the rates fixed under this Code‟;
WHEREFORE:
BE IT ORDAINED by the Sangguniang Bayan of the Municipality of Tubigon, Bohol in session duly
assembled, that:
SECTION 1. Amendatory Clause. – Section 5G.03 of Article G. – Imposition of fees - shall be amended
as
follows:
a.) Heavy duty trucks (ten-wheelers and above)
- PhP 50.00 per 3 hours; excess after 3 hours
PhP 10.00/hour
b.) 6-wheeler (cargoes, buses, wing vans, forwarders) - PhP 40.00 per 3 hours; excess after 3 hours

AN ORDINANCE ESTABLISHING A PASSENGER SERVICE STATION LOCATED IN THE
AN ORDINANCE AMENDING SECTION 3 AND SECTION 6 OF MUNICIPAL ORDINANCE No. 2007-08-265, OTHERWISE KNOWN AS AN ORDINANCE REGULATING THE OPERATION OF INTERNET CAFES/SHOPS
IN THE MUNICIPALITY OF TUBIGON, AND FOR OTHER PURPOSES.

WHEREAS, the present situation in the regulation of the operation of internet cafes/shops need to
be updated since the circumstances varies from the
time the Municipal Ordinance was enacted;
2. Minors below 18 years old are
NOT ALLOWED:
a. To play computer games on
school days
from
7:00
AM – 5:00 PM
WHEREAS, these amendments were products of the ongoing discussions to all internet cafes/
shops operators along with the Executive Department
and the concerned Local Government Unit agencies
implementing the Municipal Ordinance 2007-08-265;
SECTION 2. Repealing Clause. – All
ordinances inconsistent or in conflict herewith
are hereby repealed, modified and amended
accordingly.
WHEREFORE:
SECTION 1. Amendatory Clause. –
SECTION 3.Effectivity. – This
ordinance shall take effect upon approval subject
to the compliance of all requirements provided
for by law, like publication and posting.‟
ENACTED AND APPROVED: April 8,
2011, Tubigon Bohol.
Section 3 – Computer games prohibited
to minors at a certain time of day. –
It shall be prohibited for minors below
eighteen (18) years old to play computer games
inside cafes/shops during school days from 7:00 in
the morning until 5:00 in the afternoon.
Section 6 – Posting of Notices – It shall
be mandatory for all owners/operators of cafes to post
conspicuously inside their establishments a public
notice worded thus:

AN ORDINANCE PRESCRIBING RATES OF THE ACTUAL RECOVERY OF COST IN THE
QUARRYING AND DELIVERING ANAPOG MATERIAL TO BARANGAY WITHIN THE
JURISDICTION OF THE MUNICIPALITY OF TUBIGON.

WHEREAS, the Municipality of Tubigon already complied from the different governmental agencies in the
establishment and the possession of the anapog deposit, to be used as
filling materials for LGU projects ONLY, specifically located in
Barangay Pinayagan Norte, of the same Municipality;
WHEREAS, the said anapog deposit was estimated to be
in great mass/volumes, in addition that it is too abundant for the
sole purpose of LGU usage, thereby the LGU officials announce
that it shall be practical that the LGU will subject the said anapog
deposit for delivery purposes exclusively to the barangays for improvement of Farm-to-Market Road under the territorial
jurisdiction of the Municipality of Tubigon and prescribing the rates
per cubic meter and the service thereof
There shall be an additional Five Pesos (PhP 5.00) per cubic meter for every kilometer beyond the 3 kilometer distance
SECTION 2. Manner of Procurement - a.) The barangay concerned shall coordinate with the Office of the Municipal Treasury for the payment and shall be given an official receipt of the said payment from the said
Office;
b.) The official receipt shall be presented to the Office of the Municipal Engineering as proof of payment and thereupon
sign the appropriate application form for the
detailed volume of anapog and as to the specific location of delivery.
WHEREFORE:
BE IT ORDAINED, by the Sangguniang Bayan of the
Municipality of Tubigon, Bohol in session duly assembled, that:
SECTION 1. Rates - The prescribe rates of the actual
recovery of cost of the anapog shall be as follows:

c.) After the complete signing of the
appropriate application form, the Office of the
Municipal Engineer shall start the hauling,
loading and delivery of the filling materials to
the exact location as describe in the application form.
SECTION 3. Penal Provisions –
Any person found, such as but not limited to,
hauling, loading, extracting and other manner
procuring the filling materials, without proper
presentation of the proof of payment duly
signed by the
Municipal Treasury Officer,
shall be punished with a fine not less than
Five Hundred Pesos (PhP 500.00), but not
more than Two Thousand Five Hundred Pesos
(PhP 2,500.00), or imprisonment of not less
than three (3) months but not more than six
(6) months, or both, at the discretion of the
court;
SECTION 5. Effectivity – This ordinance shall take effect upon approval subject
to the compliance of all requirements provided for by law, like publication and posting.

BE IT ORDAINED by the Sangguniang Bayan of the Municipality of Tubigon, Bohol, that:
SECTION 1. The Amount of ONE HUNDRED
EIGHTEEN MILLION FIVE HUNDRED SIXTY EIGHT
THOUSAND PESOS (118,568,000.00) WHEREBY
EIGHTY MILLION
THREE HUNDRED TWENTY
THOUSAND PESOS (P80,320,000.00) FROM GENERAL FUND PROPER AND FROM

SECTION 2. No payment of any kind shall
be allowed to be charged against any item in
this ordinance without the claim or voucher or
payroll first authenticated by the municipal
mayor, or by the municipal vice mayor, as the
case may be, or by their duly authorized representatives,
respectively, in accordance with
the provision of
R. A. No. 7160, for the proper charging of
such payment within the appropriation.
SECTION 3. All payments charged
against any of the items in this budget shall
be in accordance with the rules and regulations of the Commission on Audit.
SECTION 4. There shall be no adjustment
of items within the appropriation for offices
as provided in this ordinance, or changes of
titles or designation, nor shall changes of supervision of expenditures or elimination of
any items be allowed except in cases
where public interests so demands, and
such may be authorized through a resolution of the Sangguniang Bayan, duly approved by the Mayor.
SECTION 5. Any violation of any part of
this ordinance shall be sufficient ground for
the filing of an administrative case against
any public officials, or employee who perpetuated the act, or if proven guilty of the
charge in a proper administrative proceedings, the offender shall suffer the penalty of
suspension of not less than sixty (60) days, or
removal from the service, without prejudice
to the filing of a criminal case against the
same.
SECTION 6. Effectivity. – This Ordinance
shall take effect immediately upon approval.

AN ORDINANCE PRESCRIBING THE RATES OF CHARGES IN THE RENTAL OF
THE LOCAL GOVERNMENT UNIT-OWNED DETACHABLE TENTS
AND FOR OTHER PURPOSES.

WHEREAS, the Local Government Unit of
the Municipality of Tubigon possessed and owned 5
detachable tents (4.5 x 6 meters) to be used for public
purposes and other LGU functions;
(c) Actual cost of repair shall be charged
for the damaged unit both for outside and within
the Municipality renters.
WHEREAS, comments and responses from
the public were mounting, thru the Liga ng mga
Barangay organization of this municipality, in expressing their intentions to rent the detachable tents
for specific purpose and period of time;
SECTION 2. Manner of Rental - a.)
All renters concerned shall coordinate with the
Office of the Municipal Treasury for the payment of the rental and shall be given an official
receipt of the said payment from the said Office
of the
Municipal Treasury;
WHEREFORE
BE IT ORDAINED, by the Sangguniang Bayan of the Municipality of Tubigon, Bohol in session
duly assembled, that:
SECTION 1. Rates - The prescribe rates of
charges for the rental of every unit detachable tents
owned by the Local Government Unit of the
Municipality of Tubigon shall be:
a) One Thousand Pesos (PhP 1,000.00) in a
maximum of three (3) days and excess days thereof
will be on per day basis for renters within the Municipality of Tubigon to which it includes the delivery,
installation and dismantling of the unit except for the
island and
mountainous barangay renters wherein
they shall provide their own means of transportation;
(b) One Thousand Five Hundred Pesos (PhP
1,500.00) per day for renters outside the Municipality
of Tubigon. The renters shall pick up the unit but to
be installed and dismantled by the LGU-Tubigon
personnel; and
b.) The official receipt shall be presented
to the Office of the Municipal Engineering as
proof of payment;
c.) After the presentation of the proof of
payment, the Office of the Municipal Engineer
shall install the tent in the location prescribe by
the renter.
SECTION 3. Penal Provisions – Any

Ania ang ilang mga issue ug concern:
1. Water Supply - Miingon si Kapitan
Salutan nga luoy ang ilang barangay kay
imbis sila ang tinubdan sa tubig daghan
pa gihapon kanila ang walay tubig. Unya,
ang sitio Mahayahay, Taytay ug Boundary
hangtud karon wala pay linya sa tubig kay
taas-taas ang ilang elevation. Matud pa ni
Kapitan babagan nila ang maong proyekto
kung dili matagaan og tubig ang ilang mga
tagibarangay. Laing problema mao usab
kining ilang basakan. Nabalaka ang mga
irrigators kay basin wala na unya silay
tubig inig operate na unya sa waterworks.
Miingon si Hon. Vice Mayor Fortich nga
iyang ipa survey ang maong mga sitio aron
matagaan sila og linya sa tubig. Mahitungod sa mga Irrigators, inbitaron sa SB ang

3. Electrification/Street Lighting Nagpasalamat sila ngadto ni Hon. Mayor

ORDINANCE No. 2002-11-212, OTHERWISE KNOWN AS ‘THE NEW REVENUE CODE OF
2004 OF THE MUNICIPALITY OF TUBIGON AND FOR OTHER PURPOSES

SECTION 2. Definition of Terms. – When used in this ordinance, the following words and phrases are
defined:
Heavy Duty trucks -large vehicle (10 wheeler and above) transporting goods, chattels and other merchandise by road;
6 and 8-wheeler vehicles – refers to buses, trucks, wing vans, forwarders;
4-wheeler vehicles – refers to cargo trucks, canters, elfs, vans, v-hire vans, mini-buses and jeepneys;
Turno system – interval system of PUBs and PUJs making their turns to load and unload passengers in the
parking area of the Municipality;
Cars, tricycles and motorcycles – refers to the usual definition accorded by laws;
Rickshaw (or okay-okay) – a three-wheeled vehicle operated by pedaling and having an attached seat for
one or two passengers available for public hire;
Other vehicles – refers to all vehicles not mentioned above;
Municipal Traffic Enforcers Team – refers to municipal paid employees duly authorized to implement
the rules and regulations of the Municipal Comprehensive Traffic and Transportation Ordinance of this Municipality and likewise assist in coordination with the personnel of the Philippine National Police (PNP);
SECTION 3. Administrative Provisions. – a.) The Municipal Traffic Enforcers Team shall have the full
authority to monitor and apprehend any violators of this amending ordinance subject hereof to the penal provisions of the Municipal Ordinance No. 2000-12-170, otherwise known as the Comprehensive Traffic and Transportation Ordinance of the Municipality of Tubigon.
b.) The designated parking area shall be determined by the Municipal Traffic Enforcers Team in various
parking area in the Municipality of Tubigon. The determination of the designated parking area shall also include
the putting up of traffic signs and other traffic markers in a conspicuous portion of the designated parking areas.
SECTION 4. Repealing Clause. – All ordinances inconsistent or in conflict herewith are hereby
pealed, modified and amended accordingly.‟
