Introduction
O UBImedical constitui um espaço
de excelência para articular a ligação
entre a Universidade e o mundo
empresarial. Criado para agilizar a
transferência de conhecimento na
busca de novas tecnologias, permite às
empresas desenvolver a investigação
e os testes laboratoriais necessários
à efectiva comercialização de novos
produtos, gerando valor acrescentado
para a economia.
Esta estrutura veio enriquecer o cluster
da saúde em Portugal, atuando como
spill-over na ligação da Universidade
ao mercado.
A UBI tem um gabinete para a
Propriedade Industrial na Divisão de
Inovação e Desenvolvimento que:
• apoia académicos e empreendedores na
UBI em relação a assuntos de propriedade
industrial e transferência de tecnologia;
• ajuda no pedido de patentes, marcas,

Transferência de Tecnologia
O UBIMEDICAL dirige-se a pessoas com
perfil empreendedor que estejam interessadas
em desenvolver projetos de transferência
de tecnologia ou projetos empresariais. As
start-ups, os alunos e investigadores da UBI,
as entidades de Ensino Avançado e de I&D,
encontram o ambiente propício para a partilha
de conhecimento, nas áreas dos cuidados de
saúde e ciências da vida, e a sua valorização
económica.
Para as melhores ideias, o UBIMEDICAL
oferece serviços de pré-incubação para garantir
que os projetos que entram para o processo
de incubação física têm o seu produto/serviço
suficientemente desenvolvido para ser lançado
no mercado.
Durante o período de pré-incubação os
promotores poderão utilizar as instalações na
vertente de coworker, aceder a serviços de
consultoria especializados que irão permitir
o desenvolvimento do produto/serviço, o
acompanhamento no desenvolvimento do plano
de negócios, e outros serviços especializados
com vista à criação da empresa (apoio jurídico,
apoio fiscal, formação, entre outros).
O foco da incubadora do UBIMEDICAL é

UBIMEDICAL is directed to people with an
entrepreneurial profile that are interested in
developing technology transfer projects or
business projects. Start-ups, UBI students
and researchers, advanced studies and R&D
entities find here the environment for sharing
knowledge in the areas of health care and life
sciences, and its economic value.
To the best ideas UBIMEDICAL offers preincubation services to ensure that the projects
entering the physical incubation process have
their products/services sufficiently developed to
be launched on to the market .
During the pre-incubation period, promoters may
use the facilities as a coworker shed, access
specialized consulting services that will allow
the development of the product/service, monitor
the development of the business plan, and other
specialized services for the establishment of the
company (legal, fiscal support, training, etc.) .
The focus of UBIMEDICAL incubator is
to provide the best conditions to develop
projects, offering “premium” physical spaces at
competitive prices, favorable terms of access
to specialized entities (consultancy in the fields
of science, technology and management), and
easier access to public authorities, investors
and lenders that can support business growth.
Coaching and mentoring are tools available to
entrepreneurs to mitigate risks and support the
acceleration of the business project and their

UBIMEDICAL promotes technology transfer
between the scientific/academic world and
the business community, applying the concept
of translational research in response to the
challenge that involves passing the basic
knowledge to their clinical applications and to

The translational research aims to get the
results of R&D as soon as possible to the stage
where they can become attractive to industries
such as pharmaceutical, biotechnology or
other. As a result, scientific research will be
valued because it relies on a consistent policy
of patents and licensing.
The researchers, laboratories and projects are
directed towards promoting technology transfer,
a driven ecosystem for the promotion of science

entrepreneurship,
launching R&D spin-offs as new companies

Esta Unidade laboratorial desenvolve e
implementa a avaliação qualitativa e quantitativa
dos problemas de visão, a fim de estudar seu
impacto no envelhecimento e qualidade de vida
da população que vive na região da Cova da
Beira.
Investigação
A principal tarefa do grupo de investigação em
Ciências da Visão é focar a investigação para
desenvolver e implementar os procedimentos
adequados para avaliar problemas de visão
decorrentes de determinadas doenças, como
a degeneração macular (DMRI), diabetes,
hipertensão, glaucoma, catarata e doenças
neuro degenerativas.

Deteção e monitorização dos problemas de
visão, em tempo útil, usando medidas de
acuidade visual (ETDRS e estenopéico),
medidas de sensibilidade ao contraste, pressão
intraocular, campos visuais, imagiologia do
fundo de olho, aberrometria, topografia corneal,
análise da câmara anterior (lâmpada de fenda)
e densidade ótica.

This laboratory develops and implements the
qualitative and quantitative evaluation of vision
problems in order to study their impact in ageing
and quality of life that lives in the Cova da Beira
region.
Research
The main task of the Vision Sciences research
group is to focus the research to develop and
implement the adequate screening procedures
to qualitative and quantitatively evaluate
vision problems such as age related macular
degeneration (ARMD), diabetes, hypertension,
glaucoma, cataracts, and neurodegenerative
diseases.

Detection and monitoring of the vision problems
in good time using visual acuity measurements
(ETDRS and stenopeic), contrast sensitivity
measurements, intraocular pressure, visual
fields, fundoscopy, aberrometry, corneal
topography, anterior chamber analysis (slit
lamp), and lens densitometry.

O UBI@MotionLab é um Laboratório de
Biomecânica do Movimento Humano desenhado
para a realização de análises ao sistema
locomotor humano e para a compreensão de
fatores biomecânicos que afetam o movimento
na sua generalidade e no âmbito desportivo.
Investigação
Investigação aplicada em Biomecânica do
Movimento Humano, em especial: (1) Análise
da estabilidade articular e rigidez músculoesquelética; (2) Avaliação e identificação
biomecânica de fatores de risco em populações
especiais; (3) Desenvolvimento de protocolos
para caracterização e avaliação biomecânica
de populações especiais; (4) Avaliação e
desenvolvimento de programas de exercícios
de apoio a populações especiais; (5) Avaliação
e identificação biomecânica de fatores
chave para o desempenho motor no âmbito
desportivo.

The UBI@MotionLab is a Laboratory of
Biomechanics of Human Movement designed
to perform analyzes to the human locomotor
system and understand biomechanical factors
that affect human movement performed during
daily and sport activities.
Research
Applied Biomechanics of Human Movement,
more specifically: (1) Analysis of joint stability
and musculoskeletal stiffness; (2) Evaluation
and identification of biomechanical risk factors
in special populations; (3) Development of
protocols for biomechanical characterization and
evaluation of special populations; (4) Evaluation
and development of exercise programs to
support special populations; (5) Biomechanical
evaluation and identification of key factors for
human performance in sports.

O Laboratório de Fisiopatologia Geral do
UBIMEDICAL é uma unidade de avaliação
epidemiológica, prestação de serviços e de
investigação vocacionada para a avaliação
de parâmetros relativos à função respiratória
humana e à elasticidade dos órgãos por métodos
não invasivos. Está capacitado para fazer a
avaliação da ventilação em situações normais
e patológicas em repouso e em exercício, a
análise Ecográfica de estruturas torácicas e
abdominais, a elasticidade não invasiva de
órgãos como o fígado, sendo possível esta
avaliação desde a idade pediátrica até ao adulto
e a avaliação da infiltração adiposa de órgãos
como o fígado, permitindo a caracterização
de fenômenos patológicos que lhe aumenta a
rigidez, como a fibrose.

respiratória da população e análise da sua
evolução designadamente em situações de
doença como da Doença Pulmonar Obstrutiva
Crônica e caracterização epidemiológica da
asma em pacientes idosos.

General Pathophysiology Laboratory

The UBIMEDICAL’s general pathophysiology
laboratory is an epidemiological and clinical
research unit that also delivers diagnostic
services. Their main objectives are the study of
human respiratory function and the evaluation
of organ elasticity through noninvasive
methods. It enables assessing ventilation in
normal and pathological situations in resting
and in exercise, ultrasound analysis of thoracic
and abdominal structures and the evaluation of
non-invasive elasticity of organs like the liver,
allowing assessment of fat infiltration, and
characterization of pathological phenomena
that increases the rigidity, such as fibrosis.

INTELLECTUAL PROPERTY | the basics
Intellectual assets are recognized as the most
important assets of many of the world’s largest
and most powerful companies, since they
support a great deal of the competitive factors
associated with the business competences of
an enterprise, being represented and protected
under the form of Industrial Property Rights.
Understanding the value of industrial property
rights in an organisation is a very important
part of successfully managing its resources in
an effective way. Industrial Property valuation,
that is to say the determination of the monetary
value of a patent or a trademark, provides key
information for different stages of the decision
making process. It can be used for taking
decisions on investment in R&D, for the internal
management of IP assets, for raising capital,
when doing transactions, such as licensing,
sale or purchase of IP assets, spin-offs, and
strategic alliances and also in the enforcement
of IP rights that is in the calculation of damages
when an IP right is infringed. Decision making
supported by IP valuation contributes to the
maximization of an organization income.
Therefore, IP is of particular importance
to companies, because it strengthens the
ownership over a product/service and it limits
the scope for copying and/or imitation.
IPRs (trademarks, industrial designs, patents,
utility models) ensure the ownership over the
new inventions, brands, designs, and other IP
works by providing exclusive rights to control
production, importation and sale. However, the
legal system of IPRs limits what can be protected
and for how long. Companies should dominate
and understand IP to effectively integrate it into
their business, market and, more importantly,
export strategies.
IP legislation includes many exclusive rights
that result from the human mind creation, such
as marks, patents, industrial designs, trade
secrets, utility models, copyrights, geographical
indications. This wide concept is divided into
two branches: Copyright and Industrial
Property. The former is mostly related to the
artistic and literary creations, computer software
and compilation of data. Oppositely, Industrial
Property covers the remaining IPRs which
are related to all manufactured and natural
products, such as: patents and utility models
to protect inventions; industrial designs to
protect products appearance; layout-designs of
integrated circuits; trademarks and geographical
indications.
The management of IPRs can be not only a
complex task, but also a huge investment. For
example, a single product can be protected
by different IPRs: its model is protected by a
mark; its appearance is protected by industrial
designs; its application and the production
method is protected by patents or utility models.
Companies should study what is remarkable
about their products and/or services and the
reason(s) for its success in the marketplace
should be protected appropriately.
If companies want to go internationally, IP
becomes even more important for them. The
export product prices are influenced by the brand
recognition and potential competition in the
export market; the commercial opportunities are
guaranteed by holding IPRs on the company’s
products and agreements negotiations with
new partners will take them into account.
However, the IP influence can also put an end
to the exportation process if the products and/or
services to be exported infringe on the IPRs in
the export country.
a) Patents
In order to be awarded a patent for an invention
it must:
- be new;
- have inventive step;
- have industrial applicability.
The right conferred by the patent is valid for 20
years since companies pay the annual fees.
A patent confers the holder:
- the right of exclusive use;
- the right to prevent third parties to use without
his consent;
- the right to take all kinds of administrative and
judicial action to defend their right;

- the right to sell or transmit the patent to
interested parties through exploration license
agreements or assignment agreements.
Patentability criteria - what is not patent?
•
discoveries,
scientific
theories
and
mathematical methods;
• materials / substances existing in nature and
nuclear materials;
• aesthetic creations;
• projects , principles and methods for performing
mental acts, for playing games or in the field
of economic activities, as well as computer
programs, as such, without any contribution;
• presentations of information;
• methods for surgical treatment / therapy of the
human or animal body and diagnostic methods
practiced on the human or animal body, can be
protected product/composition employed;
• processes for cloning human beings;
• processes for modifying the genetic identity of
human beings;
• uses of human embryos for industrial/
commercial purposes;
• modification processes of genetic identity
of animals which may cause them suffering
without any substantial medical benefit to man
or animal, and also animals resulting from such
processes;
• human body, and the simple discovery of one
of its elements, including the sequence or partial
sequence of a gene;
• plant varieties and animal breeds, and
essentially biological processes for the
production of plants or animals.
b) Utility model
The utility model aims to protect new inventions,
for a more simplified administrative procedure
and faster than the patent. Utility models
are more simple inventions. However not all
countries recognize the utility model. The right
conferred by the patent is valid for 10 years
since the company pays the annual fees.
c) Marks
A mark is a distinctive sign which distinguishes
goods or services provided by one company
from those provided by others. As long as the
chosen sign is distinctive, any of the following
types can be used as well as combinations:
words, characters, numbers, drawings, colors,
pictures, shapes, logotypes, labels, smells,
sounds, three-dimensional objects.
Even if the trademark is registered by use in
the countries where its protection is sought, its
registration is important to make it even stronger.
Registering a mark provides an exclusive right
of its use, which prevents others from marketing
similar or identical products and/or services
under a similar (or even confusingly similar) one.
It fosters branding and marketing strategies and
subsequently a loyal clientele which recognizes
the company’s image and reputation.
After registration, a trademark typically lasts
for 10 years (depending on the country and/or
trademark office where it was registered). Then,
it can be renewed after this period and there is
no time limit for the renewal payments (unlike
most PI rights). However, trademarks can be lost
if not used for a certain period of time (between
3 and 5 years, according to the trademark office
where the registration was provided).
The registration process starts with filing a
trademark application form, which usually
requires the contact details of the company,
graphic illustration of the trademark, description
of goods and services and their business
corresponding
classes.
The
trademark
classification systems facilitate the identification
of goods and/or services related to the
trademark. The Nice Classification (NCL) is the
most used in the world.
The three main options to register a trademark
are: the national route, the regional route and
the international route. The national route
requires a registration at the trademark office
of each country where the protection is sought.
The regional route is supported by regional
trademark systems (composed by the countries
members) and, if your country is a party to
those systems or if all countries where you seek
protection are parties to them, it is certainly an
easier option to obtain protection abroad than
IP and commercialization
the national route. Finally, another choice is
the international route which requires only a
single application with a single language to
deal with during the registration procedure to
obtain protection among 70 countries covered
by the Madrid System, which is administered
by the World Intellectual Property Organization
(WIPO).
d) Industrial Designs
An industrial design protects only the aesthetic
aspect or outward appearance of the whole or
parts of a product resulting from its features.
It consists of three-dimensional features, such
as the shape of a product, the two-dimensional
features such as ornamentation, patterns and
lines or color, or a combination of two or more of
these. It must be new and original (independently
created by the designer). Another requirement
is that it must have individual character, which
is met if the overall impression that a design
makes on an informed user differs from the
overall impression made on such a user by any
earlier design (available to the public). Industrial
designs can protect the appearance of chairs,
bottles, carpets, jewelries, among any industrial
or handicraft item.
The registering process of an industrial design
starts with fulfilling a design application form,
which usually requires the contact details of
the company, as well as drawings, photographs
and a brief description of it. The three main
options to register an industrial design are:
the national route, the regional route and the
international route. The national route requires
a registration at the industrial property office of
each country where the protection is sought.
The regional route is supported by regional
industrial property systems (composed by the
countries members) and, if your country is a
party to those systems or if all countries where
you seek protection are parties to them, it is
certainly an easier option to obtain protection
abroad than the national route. Finally, another
choice is the international route which requires
only a single application with a single language
to deal with during the registration procedure
to obtain protection among the countries of 62
parties covered by the Hague Agreement.
Commercialization channels
The importance of commercializing public
research results can be justified by several
reasons:
1. generate economic and social value
and improve the competiveness of national
industry;
2. since the increasing costs of scientific
research and national budgetary restrictions
have significantly hit Public Research
Organization (PROs), results commercialization
could constitute an alternative income source to
fund their R&D activity;
3. it would allow rooting an entrepreneurial
culture within PROs. This is of particular
importance for a successful exploitation of
publicly funded knowledge.
1. Assignment
The ownership of IP is permanently transferred
from one party (the assignor) to another party
(the assignee). Consequently, the assignee
becomes the new owner of the IPR.
Advantages: availability of immediate cash flow
return to be invested in further R&D activity,
as payments usually take the form of a lump
sum payment; the PROs would have no further
responsibility for the management of the IP title,
including the payment of fees or the monitoring
of infringements.
IP and commercialization
Disadvantages: the loss of control over the
IPR.
2. License
A license agreement is a contract under which
the holder of IP (licensor) grants permission for
the use of the intangible asset concerned to
another person (licensee), within the limits set
by the provisions of the contract. When it comes
to negotiate license agreements, it is important
to understand why PROs wish to license their
IP, and which license is more suitable to the
specific case, as well as the potential risks of
entering in such deal.
In particular, transfers of ownership of IP owned
by the PRO and the granting of exclusive
licenses should be carefully assessed, since
this can diminish or eliminate altogether
the control over the IP asset. Licenses for
exploitation purposes should involve adequate
financial compensation, as well as other types
of benefits.
3. Joint venture
It is a type of collaborative commercialization.
It is a situation where scientists and private
companies jointly commit resources and
research efforts to projects; research activities
are carried out jointly and may be co-funded.
Joint venture may range from short-term
projects (non-incorporated joint venture),
normally narrow in scope, to long-lasting
strategic partnerships with multiple members
and stakeholders (joint venture company).
The parties to the joint venture share risks
and contribute with their intellectual capital
to technology research and development,
production,
marketing
and
further
commercialization.
4. Spin-off
A spin-off refers to a separate company usually
established to bring IP, in this case resulting
from public funding, onto the market. It is
deemed to be a valuable channel to transform
the PROs’ technology into product and service,
as well as to license out technology. Creating
spin-off companies would allow PROs to:
• Outsource the development process that might
not fit with the PRO’s scientific objectives;
• Obtain funding not available for purely research
institutions to partially cover development
costs;
• Participate in a European-funded research
programme as an industrial partner;
• Endow research staff with entrepreneurial
skills.
Plus, in the early stages when a spin-off is
founded, a strategic decision should be taken
on how the new company will acquire the IP
belonging to the PRO (the contribution in kind
from the PRO or the licensing of its intangible
assets).
5. Consultancy
This type of commercialization comprises
contract research and/or faculty consulting.
The 1st consists of a research commissioned
by a private company to pursue a solution to
a problem of interest, involving the creation of
new knowledge according to the specifications
or goals of the client. The 2nd has to do with the
results generated by the PRO should be owned
by the private-sector party. The ownership
of background should not be affected by the
project.
