BITTE UNBEDINGT BEACHTEN: DIES IST EIN LIZENZVERTRAG, KEIN KAUFVERTRAG. FALLS SIE KEINEN
ANDEREN VERTRAG DIREKT MIT COREL ODER EINER SEINER TOCHTERGESELLSCHAFTEN
ABGESCHLOSSEN HABEN, DURCH DEN DIESER VERTRAG AUSDRÜCKLICH ERSETZT SOWIE IHRE
VERWENDUNG ODER VERTEILUNG DES PRODUKTES GEREGELT UND GEÄNDERT WERDEN, WIRD DAS
PRODUKT IHNEN AUF DER GRUNDLAGE DER BESTIMMUNGEN DES NACHSTEHENDEN LIZENZVERTRAGES
EINSCHLIESSLICH SEINER ANLAGEN, SOFERN DIESE VON RELEVANZ SIND, ZUR VERFÜGUNG GESTELLT
(DIE "LIZENZ" BZW. DER "LIZENZVERTRAG"); IN DEM LIZENZVERTRAG IST BESTIMMT, WELCHE RECHTE
IHNEN IM HINBLICK AUF DAS PRODUKT ZUSTEHEN UND WELCHE BESCHRÄNKUNGEN IN BEZUG AUF
MÖGLICHE GEWÄHRLEISTUNGSANSPRÜCHE UND RECHTSBEHELFE BESTEHEN. DIESE LIZENZ WIRD VON
DER COREL CORPORATION ("COREL") GEWÄHRT UND BESTEHT AUS FOLGENDEN TEILEN:

WICHTIGER HINWEIS: WENN SIE DIESES PRODUKT HERUNTERLADEN, LESEN SIE DIE
LIZENZBEDINGUNGEN VOR DEM HERUNTERLADEN SORGFÄLTIG DURCH. INDEM SIE DIESES PRODUKT
HERUNTERLADEN:
(i) bescheinigen Sie, dass Sie nicht minderjährig sind und sich den nachstehenden Lizenzbestimmungen
verpflichten. Das Herunterladen und/oder Benutzen des Produktes gilt als unwiderrufliche Annahme der
Lizenzbestimmungen;
(ii) erkennen Sie an, dass Sie für die Zahlung sämtlicher Gebühren verantwortlich sind, die durch die Nutzung
von über das Internet angebotenen Leistungen entstehen, sowie für Telekommunikationsgebühren und
sonstige Kosten, die dadurch verursacht werden, dass Sie das Produkt herunterladen; und
(iii) sofern Sie die Annahme für eine Gesellschaft oder eine sonstige juristische Person erklären,
gewährleisten Sie gegenüber Corel, dass Sie voll berechtigt sind, die jeweilige juristische Person zu
verpflichten.
LADEN SIE DIESES PRODUKT NUR HERUNTER, WENN SIE MIT DEM VORHERSTEHENDEN EINVERSTANDEN
SIND.
1. ALLGEMEINE LIZENZVEREINBARUNG
WICHTIGER HINWEIS: LESEN SIE DIESEN LIZENZVERTRAG AUFMERKSAM DURCH, BEVOR SIE DAS
PRODUKT NUTZEN. DIE ERSTMALIGE INSTALLATION ODER JEDE FORM DES KOPIERENS ODER SONSTIGE
NUTZUNG DES PRODUKTES GILT ALS BESTÄTIGUNG, DASS SIE DIESEN LIZENZVERTRAG GELESEN HABEN
UND SICH VERPFLICHTEN, SÄMTLICHE IN IHM ENTHALTENEN BESTIMMUNGEN ALS VERBINDLICH
ANZUNEHMEN UND ZU BEACHTEN. WENN SIE DAMIT NICHT EINVERSTANDEN SIND UND ES SICH BEI
DIESEM PRODUKT UM EIN MATERIELLES SPEICHERMEDIUM (z.B. CD) HANDELT, DANN SCHICKEN SIE DAS
KOMPLETTE PRODUKT BITTE INNERHALB VON ZEHN (10)TAGEN NACH DEM ERWERB AN DEN COREL
KUNDENDIENST, 1600 CARLING AVENUE, OTTAWA, ONTARIO, KANADA, K1Z 8R7, UM EINE VOLLE
RÜCKERSTATTUNG ZU ERHALTEN. DIESER LIZENZVERTRAG IST IHR LIZENZNACHWEIS. BEWAHREN SIE
IHN DAHER SORGFÄLTIG AUF.
1.1 DEFINITIONEN:
1.1.1 "Computer" bedeutet eine (1) CPU (Central Processing Unit, zentrale Recheneinheit), von der Daten in
digitaler oder ähnlicher Form akzeptiert und auf der Grundlage einer Befehlssequenz auf ein bestimmtes
Ergebnis hin bearbeitet werden;
1.1.2 "Dokumentation" bedeutet alle begleitenden gedruckten Unterlagen, diesen Lizenzvertrag, alle
sonstigen Verträge mit Corel bezüglich dieses Produktes sowie die "Online-Dokumentation" oder
elektronische Dokumentation;
1.1.3 "Zulässige Anzahl" bedeutet eins (1), es sei denn, in einer gültigen, von Corel oder einer seiner
Tochtergesellschaften gewährten Lizenz ist eine andere Anzahl angegeben;
1.1.4 "Produkt" bedeutet ein Computerprogramm, Computersoftware, einschließlich Kennung, Objekt-Code
mit Anwenderprogramm-Schnittstelle sowie in der Software enthaltene Bilder, Fotografien, Masken,
Animationen, Video-/Audio-/Musikdaten, Texte und "Applets" sowie gegebenenfalls die Datenträger, die die
genannten Daten enthalten, einschließlich der gesamten Dokumentation; und
1.1.5 "Nutzung" bedeutet Zugriff, Installation, Herunterladen, Kopieren oder anderweitiges Ausnutzen der
Funktionen des Produktes in Übereinstimmung mit der Dokumentation.
1.2 LIZENZ:
COREL stellt Ihnen ein Produkt zur Verfügung und gewährt Ihnen eine nicht exklusive Lizenz für die Nutzung
des Produktes gemäß den Bestimmungen dieser Lizenz. Ergänzende Software und Begleitmaterial, die Ihnen
gegebenenfalls im Rahmen der Supportleistungen von COREL für das Produkt zur Verfügung gestellt werden,
gelten als Teil des Produktes und fallen dementsprechend unter die Bestimmungen dieses Lizenzvertrages.
Die Urheberrechte und alle anderen Rechte an dem Produkt verbleiben bei COREL bzw. seinen Lizenzgebern.
Auf allen von Ihnen von dem Produkt erstellten Kopien müssen die auf dem Produkt enthaltenen Hinweise
auf Urheberrechte und sonstige Angaben wiedergegeben werden. Einige Drittanbietermaterialien, die in
dem Produkt enthalten sind, unterliegen möglicherweise anderen Kauf- und Lieferbedingungen, die
normalerweise im Feld "Hilfe - Info" angezeigt werden.
1,3 WAS SIE DÜRFEN:
(i) Sie dürfen eine (1) Kopie des Produktes auf maximal der zulässigen Anzahl von Computern installieren
und benutzen. Sie dürfen außerdem eine zweite Kopie des Produktes auf einem Heim- oder tragbaren
Computer benutzen, so lange diese Kopie zu keinem Zeitpunkt gleichzeitig im Direktzugriffspeicher (RAM)
Ihres Hauptcomputers geladen ist;
(ii) Sie dürfen eine (1) Kopie des Produktes in einer geeigneten Speichervorrichtung wie z.B. einem Server
installieren, sofern diese Speichervorrichtung ausschließlich verwendet wird, um das Produkt über ein
internes Netzwerk auf Ihren anderen Computern bis zur zulässigen Anzahl zu installieren oder zu nutzen. Sie
sind verpflichtet, für jeden Computer, auf dem Sie das Produkt von dieser Speichervorrichtung aus
installieren bzw. ausführen wollen, eine entsprechende, jeweils auf einen Computer beschränkte Lizenz zu
erwerben. Eine einzelne Lizenz für das Produkt kann nicht gemeinsam oder auf verschiedenen Computern
gleichzeitig genutzt werden, es sei denn, Sie haben einen weiteren Vertrag mit COREL abgeschlossen, der
Ihnen dies erlaubt;
(iii) Sie dürfen eine Kopie des Produktes nur für Archivierungs- oder Sicherungszwecke erstellen;
(iv) Sofern das Produkt Clipart und/oder Photo Images enthält, dürfen Sie diese Clipart bzw. Photo Images
nur unter Einhaltung der nachstehenden "Bestimmungen zum Gebrauch von Clipart und Stock Photo Images"
nutzen;
(v) Mit Ausnahme der Education Edition, der OEM-Version und der Vorab-Version, die nicht übertragbar sind
(siehe die Anhänge mit den Sonderbedingungen für "Education Editions", "OEM-Versionen" bzw. "VorabVersionen" weiter unten), dürfen Sie das Produkt nur auf andere Personen übertragen, wenn Sie alle Ihre
Rechte aus dieser Lizenz übertragen, jegliche Nutzung des Produktes einstellen, sämtliche Kopien
(einschließlich der Kopie auf der Festplatte) löschen oder vernichten, die Sie zur Unterstützung Ihrer Nutzung
des Produktes erstellt haben, und sicherstellen, dass die Person, auf die Sie das Produkt übertragen
möchten, sich mit den Bestimmungen dieser Lizenz einverstanden erklärt;
(vi) Wenn Sie dieses Produkt als Upgrade eines COREL-Produktes oder eines Produktes eines anderen
Lieferanten erworben haben, können Sie das vorherige Produkt mit diesem Produkt weiter benutzen. Im
Falle einer Übertragung dieses Produktes auf einen Dritten sind Sie verpflichtet, entweder das vorherige
Produkt mit zu übertragen, oder aber dieses ursprüngliche Produkt zeitgleich mit der Übertragung des hier
lizenzierten Produktes dauerhaft unbrauchbar zu machen. Ist das von Ihnen erworbene Produkt ein Upgrade
eines COREL-Produktes, können Sie dieses vorherige Produkt nunmehr nur gemäß den Bestimmungen dieser
Lizenz benutzen;
(vii) Wenn das Produkt Ihnen mehrere Sprachversionen zur Auswahl anbietet, dürfen Sie nur eine (1) dieser
Versionen benutzen;
(viii) Sofern das Produkt NetPerfect(R) enthält, sind Sie berechtigt, NetPerfect zu nutzen, um bis zu
einhundert (100) Dokumente zu verwalten. Möchten Sie mehr als einhundert (100) Dokumente verwalten, so
müssen Sie von Corel eine zusätzliche NetPerfect-Lizenz erwerben;
(ix) Sofern das Produkt Show On the Go(TM), Corel PRESENTS Runtime Player(TM) oder eine ähnliche
Funktion beinhaltet, die eine Laufzeit-Präsentation ermöglicht, sind Sie berechtigt, die LaufzeitProgrammdateien zusammen mit den Präsentations-Grafikdateien, die unter Verwendung des Produktes
erstellt worden sind, uneingeschränkt zu vervielfältigen und Dritten zugänglich zu machen, sofern Sie dabei
(a) keinerlei Logo, Namen oder Zeichen von Corel oder deren Lizenzgebern verwenden, es sei denn, um
darauf hinzuweisen, dass die Präsentationsdatei mit Hilfe von Corel(R) Presentations(TM) oder einem
anderen Corel-Produkt erstellt wurde, (b) jegliche Datenträger mit einem geeigneten Hinweis auf bestehende
Urheberrechte versehen und/oder deutlich sichtbar auf jeder Datei, die eine Bildschirmpräsentation mit
Laufzeit-Programmdateien enthält, einen solchen Hinweis anbringen und (c) Corel sowie deren Lizenzgeber
im Zusammenhang mit sämtlichen Forderungen oder auch gerichtlich geltend gemachten Ansprüchen Dritter
schadlos halten werden, die sich gegebenenfalls aus der Verwendung oder Verbreitung der LaufzeitProgrammdateien als Teil der von Ihnen verbreiteten Bildschirm- bzw. Leinwandpräsentation ergeben
mögen. Sie sind für die Erbringung sämtlicher technischer Supportleistungen verantwortlich, die die Nutzer
der von Ihnen verbreiteten Laufzeit-Programmdatei eventuell benötigen mögen; und
(x) Sofern das Produkt Trellix Software enthält (die "Software"), sind Sie berechtigt, ein Exemplar dieser
Software auf einem einzelnen Computer zu installieren und dort zu nutzen. Der Hauptnutzer dieses
Computers ist berechtigt, diese Software für ausschließlich eigene Zwecke auf einem mobilen Computer zu
installieren. Unbeschadet des Vorstehenden sind Sie berechtigt, "Viewers Setup.exe"-Dateien zu kopieren
bzw. zu vervielfältigen und Dritten zugänglich zu machen, jedoch ausschließlich zum Zweck der
Einsichtnahme in von Ihnen erstellte Trellix-Dokumente. Die "Viewers Setup.exe"-Datei, insbesondere die
darin enthaltene EULA (Endnutzer-Lizenzvereinbarung), darf nicht verändert werden, und Hinweise auf
bestehende Schutzrechte müssen beibehalten werden. Die Trellix Corporation und Corel übernehmen im
Zusammenhang mit der Verbreitung solcher Dateien keinerlei Verantwortung oder Haftung. Sie sind auch
berechtigt, unter Einsatz des zu dieser Software gehörenden Trelligram Creator Programms erstellte Dateien
Dritten zugänglich zu machen, jedoch ausschließlich zum Zweck der Einsichtnahme in die Inhalte dieser
Dateien, wobei vorausgesetzt wird, dass Ihnen die für eine Verbreitung dieser Inhalte erforderlichen Rechte
zustehen bzw. dass ihnen eine entsprechende Erlaubnis erteilt worden ist. Die ausschließliche Verantwortung
und Haftung für die Inhalte solcher Materialien und die Geeignetheit der Software für die Zwecke der
Empfänger liegt bei Ihnen (jede Haftung oder Verantwortung von Corel oder der Trellix Corporation ist
insoweit ausgeschlossen).
1,4 WAS SIE NICHT DÜRFEN:
(i) Sie dürfen das Produkt nicht auf eine Weise benutzen, die nicht durch diese Lizenz autorisiert ist, oder
Kopien des Produktes erstellen, außer solcher, die durch diese Lizenz autorisiert sind, ausgenommen in dem
Maße, in dem die vorgehende Einschränkung nach geltendem Recht unzulässig oder unwirksam ist;
(ii) Sie dürfen das Produkt nicht übersetzen, rückentwickeln, dekompilieren oder disassemblieren,
ausgenommen in dem Maße, in dem die vorgehende Einschränkung nach geltendem Recht unzulässig oder
unwirksam ist;
(iii) Sie dürfen das Produkt nicht vermieten, im Wege des Leasings weitergeben, abtreten, verkaufen,
unterlizenzieren, verleihen oder übertragen, es sei denn, dies geschieht in Übereinstimmung mit dem obigen
Absatz 1.3;
(iv) Sie dürfen das Produkt nicht verändern oder das Produkt ganz oder teilweise mit einem anderen
Programm zusammenfügen;
(v) Sie dürfen die in dem Produkt enthaltenen Schriftzeichensätze und Klangdateien nicht weitergeben;
(vi) Sie dürfen die Einzelteile des Produktes nicht zur Nutzung auf mehr als einem (1) Computer trennen,
ausgenommen in dem Maße, in dem die vorgehende Einschränkung nach geltendem Recht unzulässig oder
unwirksam ist; und
(vii) Sofern es sich um eine OEM-Version handelt, dürfen Sie das Produkt nicht benutzen oder kopieren,
wenn Sie es als selbständiges Produkt erhalten haben. Die Benutzung der OEM-Version des Produktes
unterliegt den in Absatz 5 festgelegten Einschränkungen.
1.5 BESCHRÄNKUNG DER NUTZUNG DER UNISYS-TECHNOLOGIE:
Für Corel Produkte mit PDF- und/oder TIFF-LZW- und/oder GIF- und/oder Postscript-LZW- und/oder LZWGraphikfähigkeit wird eine Technologie verwendet, die durch das US-amerikanische Patent Nr. 4,558,302
sowie entsprechende Rechte in anderen Ländern ("Unisys Patent") geschützt ist. Die Ihnen durch diesen
Vertrag gewährte Lizenz beinhaltet das Recht, das Unisys-Patent zu nutzen, jedoch ausschließlich in
Verbindung mit dem Produkt. Für jede Nutzung eines anderen Produktes oder sonstige Anwendung mit einer
unter das Unisys-Patent fallenden Komprimierungs-/Dekomprimierungstechnologie ist eine gesonderte Lizenz
der Unisys Corporation erforderlich.
1.6 HAFTUNGSAUSSCHLUSS BEZÜGLICH DER SPRACHERKENNUNG:
Sofern das Produkt Spracherkennungssoftware enthält, wird folgender ergänzender Haftungsausschluss als
Teil dieses Lizenzvertrages vereinbart:
SIE SIND SICH DER TATSACHE BEWUSST, DASS SPRACHERKENNUNG EIN AUF STATISTISCHEN
ERKENNTNISSEN BERUHENDES VERFAHREN IST, BEI DEM ERKENNUNGSFEHLER IN KEINEM FALL GANZ
AUSGESCHLOSSEN WERDEN KÖNNEN; AUF SPRACHERKENNUNG BERUHENDE ANWENDUNGEN MÜSSEN
DAHER STETS SO AUSGELEGT SEIN, DASS DIE MÖGLICHKEIT SOLCHER FEHLER IM
ERKENNUNGSVERFAHREN VON VORNE HEREIN BERÜCKSICHTIGUNG FINDET. SIE SIND SICH BEWUSST,
DASS SOLCHE FEHLER NICHT AUSGESCHLOSSEN WERDEN KÖNNEN UND DASS SIE DAFÜR
VERANTWORTLICH SIND, ERKENNUNGSFEHLER ZU BERICHTIGEN, BEVOR SIE DIE ERGEBNISSE DER
SPRACHERKENNUNG WEITER VERWENDEN.
1.7 EINSCHRÄNKENDE BESTIMMUNGEN FÜR DRAGON SOFTWARE:
Sofern das Produkt Dragon NaturallySpeaking(TM) Software enthält, gilt für diese Software Folgendes:
Bei Erwerb des Produktes für oder durch eine Behörde oder sonstige Untergliederung der Bundesregierung
der Vereinigten Staaten von Amerika gilt das Produkt als "kommerzielle Computer-Software" (commercial
computer software), wobei, sofern keine anderslautende schriftliche Vereinbarung getroffen wurde, die
Rechte der Bundesregierung durch diese Lizenz gemäß der amerikanischen Beschaffungsverordnung Federal
Acquisition Regulation FAR 12.212(a) und/oder DFARS 227.7202-1(a) Beschränkungen unterliegen.
1.8 PRODUKT-PATCHES, -PLUGS ODER -UPDATES:
Wenn es sich hierbei um ein Patch, Plug, Update oder eine sonstige Datei handelt, die Sie herunterladen
oder die auf Speichermedien enthalten ist (zum Beispiel auf CD-ROM), dann ist das Produkt zur Nutzung
zusammen mit einem Corel Software-Anwendungsprodukt konzipiert (die "Originalanwendung") und
unterliegt ggf. den von Corel festgelegten Beschränkungen der Gewährleistung und Haftung sowie
Haftungsausschlüssen (gemäß Absatz 1.11, 1.12 und 1.13) sowie den Berechtigungsbestimmungen (gemäß
Absatz 1.16). Ihnen wird eine nicht exklusive Lizenz gewährt, nach der Sie berechtigt sind, das Produkt nur
zusammen mit den Originalanwendungen unter der Voraussetzung zu nutzen, dass Sie noch immer im Besitz
einer gültigen, von Corel gewährten Lizenz zur Nutzung der Originalanwendung sind. Sofern nicht in diesem
Absatz anderweitig bestimmt, unterliegt das Produkt den Bestimmungen der von Corel für die
Originalanwendung gewährten Lizenz. WENN SIE DIESES PRODUKT HERUNTERLADEN, TRAGEN SIE
SÄMTLICHE MIT DER ÜBERTRAGUNG UND DEM HERUNTERLADEN VERBUNDENEN RISIKEN EINER
BESCHÄDIGUNG DES PRODUKTES.
1.9 RECHTE AN GEISTIGEM EIGENTUM:
Sofern nicht in dieser Lizenz ausdrücklich anderweitig bestimmt, behält Corel alle Rechte sowie Eigentumsund Nutzungsrechte am Produkt und an sämtlichen Kopien, die Sie mit Genehmigung von Corel erstellen.
Das Produkt ist urheberrechtlich geschützt, einschließlich ohne Einschränkung durch das kanadische
Urheberrechtsgesetz sowie durch die Bestimmungen internationaler Verträge und des geltenden Rechts in
dem Land, in dem es benutzt wird. Sofern nicht in dieser Vereinbarung ausdrücklich angegeben, werden
Ihnen mit dieser Lizenz keine Rechte an geistigem Eigentum bezüglich des Produktes gewährt. Alle nicht
ausdrücklich gewährten Rechte bleiben Corel vorbehalten.
1.10 LAUFZEIT:
Diese Lizenz bleibt nur so lange wirksam, wie Sie ihre Bestimmungen einhalten. Die Lizenz verliert ihre
Gültigkeit, sofern Sie die Lizenzbestimmungen und ?bedingungen nicht einhalten. Sie verpflichten sich, bei
Beendigung des Lizenzverhältnisses sämtliche Exemplare und Kopien des Produktes zu vernichten. Die in den
Absätzen 1.9, 1.11, 1.12, 1.13, 1.17, 1.18, 3.2, 6.3 und 7.3 genannten Rechte an geistigem Eigentum,
Beschränkungen der Gewährleistung und Haftung sowie Haftungsausschlüsse bleiben auch nach einer
Beendigung in Kraft. Wenn Sie dieses Produkt als Teil des Student Campus Reward Option For Learning
(SCROL) Programms erworben haben, sind Sie den Bestimmungen von Absatz 4.2 dieser Lizenzvereinbarung
verpflichtet.
1.11 BEGRENZTE GEWÄHRLEISTUNG:
Soweit nicht in dieser Lizenzvereinbarung anderweitig bestimmt und sofern es sich bei dem Produkt nicht um
eine Probeversion gemäß Absatz 3 oder eine Vorab-Version gemäß Absatz 7 handelt, gewährleistet Corel
dem Erstkäufer einer Lizenz des Produktes für einen Zeitraum von neunzig (90) Tagen nach dem Tage des
Erwerbs, dass das Produkt frei von Material- und Verarbeitungsmängeln ist. Sollte dennoch ein solcher
Mangel vorliegen, so bitten wir um Rücksendung des Produktes an den Corel-Kundendienst unter folgender
Adresse: Corel Customer Service, 1600 Carling Avenue, Ottawa, Ontario, Kanada, K1Z 8R7. Corel wird dann
eine kostenfreie Ersatzlieferung vornehmen. WEITERE ANSPRÜCHE STEHEN IHNEN IM
GEWÄHRLEISTUNGSFALL NICHT ZU, UND COREL UND SEINE LIEFERANTEN UND HÄNDLER ÜBERNEHMEN
KEINE WEITERE HAFTUNG FÜR GEWÄHRLEISTUNGSFÄLLE ODER, SOWEIT NACH GELTENDEM RECHT
ZULÄSSIG, FÜR SONSTIGE KLAGEGRÜNDE (EINSCHLIESSLICH FAHRLÄSSIGKEIT) BEZÜGLICH EVENTUELLER
MATERIAL- ODER VERARBEITUNGSMÄNGEL AN DEM PRODUKT. MIT DIESER BEGRENZTEN

1.12 HAFTUNGSAUSSCHLUSS:

GEWÄHRLEISTUNGSRECHTEN, ZUSAGEN ODER BESTIMMUNGEN, SOFERN DIESE NICHT NACH DEM FÜR
SIE IN IHREM RECHTSSYSTEM GELTENDEN RECHT AUSGESCHLOSSEN ODER BESCHRÄNKT WERDEN
KÖNNEN ODER DÜRFEN, WIRD DAS PRODUKT IN DEM ZUSTAND ZUR VERFÜGUNG GESTELLT, IN DEM ES
SICH BEFINDET, OHNE WEITERE AUSDRÜCKLICHE ODER STILLSCHWEIGENDE GEWÄHRLEISTUNG ODER
ZUSAGE, BEDINGUNGEN ODER BESTIMMUNGEN IRGENDEINER ART, INSBESONDERE AUCH HINSICHTLICH
DER NICHTVERLETZUNG VON RECHTEN DRITTER, DER INTEGRATION UND DER HANDELSÜBLICHEN BZW.
ANGEMESSENEN QUALITÄT DES PRODUKTES ODER SEINER HANDELBARKEIT ODER EIGNUNG FÜR
BESTIMMTE ZWECKE, AUCH SOFERN EINE SOLCHE GEWÄHRLEISTUNG ODER ZUSAGE AUS GESETZLICHEN
ODER SONSTIGEN BESTIMMUNGEN, HANDELSBRÄUCHEN ODER SONSTIGEN GEPFLOGENHEITEN
ABGELEITET WERDEN KÖNNTE. COREL UND SEINE LIEFERANTEN UND HÄNDLER KÖNNEN UND WERDEN
KEINE GEWÄHRLEISTUNG FÜR DIE LEISTUNG ODER DIE ERGEBNISSE AUS DER NUTZUNG DES PRODUKTES
GEBEN. SIE TRAGEN DAS GESAMTE RISIKO EINER NICHT ERWARTUNGSGEMÄSSEN LEISTUNG ODER
NUTZBARKEIT DES PRODUKTES. SOFERN NICHT AUSSCHLIESSBARE RECHTE KRAFT GESETZES IN DIESE
LIZENZ HINEINGELEGT WERDEN, BESCHRÄNKT COREL SEINE HAFTUNG, SOWEIT GESETZLICH ZULÄSSIG,
DARAUF, NACH EIGENER WAHL DIE WAREN ZU REPARIEREN ODER ZU ERSETZEN, ÄQUIVALENTE WAREN
NEU ZU LIEFERN ODER DIE KOSTEN ZU ERSTATTEN.
1.13 BESCHRÄNKUNGEN DER HAFTUNG:
MIT AUSNAHME DER OBEN GENANNTEN AUSDRÜCKLICHEN BEGRENZTEN GEWÄHRLEISTUNG HAFTEN
WEDER COREL NOCH SEINE HÄNDLER ODER LIEFERANTEN GEGENÜBER IHNEN ODER EINER SONSTIGEN
NATÜRLICHEN ODER JURISTISCHEN PERSON FÜR SCHÄDEN, ANSPRÜCHE ODER KOSTEN JEGLICHER ART
(OHNE EINSCHRÄNKUNG AUCH FÜR SOLCHE, DIE SICH AUS VERTRAGSBRUCH, FAHRLÄSSIGKEIT ODER
EINEM ANDEREN KLAGEGRUND ERGEBEN) ODER SCHÄDEN, DIE GELEGENTLICH DES
VERTRAGSVERHÄLTNISSES, MITTELBAR ODER ALS FOLGESCHÄDEN ENTSTEHEN, EINSCHLIESSLICH
ENTGANGENER EINNAHMEN ODER ENTGANGENEN GEWINNS, VERLORENER ODER BESCHÄDIGTER DATEN
ODER SONSTIGER GESCHÄFTLICHER ODER WIRTSCHAFTLICHER SCHÄDEN, SELBST WENN EIN CORELVERTRETER ÜBER DIE MÖGLICHKEIT SOLCHER SCHÄDEN INFORMIERT WAR, UND GLEICHGÜLTIG, OB
DIESE SCHÄDEN VORHERSEHBAR WAREN ODER NICHT. EBENSO HAFTET COREL IN KEINEM FALL FÜR
ANSPRÜCHE DRITTER. FALLS DIE OBEN GENANNTEN BESCHRÄNKUNGEN DER HAFTUNG IN IHREM
RECHTSSYSTEM NICHT GÜLTIG SIND, DARF DIE MAXIMALE GESAMTHAFTUNG VON COREL UND SEINEN
HÄNDLERN UND LIEFERANTEN DEN VON IHNEN FÜR DAS PRODUKT GEZAHLTEN BETRAG NICHT
ÜBERSTEIGEN. DIE BESTIMMUNGEN DIESES ABSCHNITTS GELTEN UNABHÄNGIG DAVON, OB EINE
VERLETZUNG BZW. EIN VERZUG BEI DER ERFÜLLUNG EINER WESENTLICHEN VERTRAGSPFLICHT ODER
WESENTLICHEN VERTRAGSBEDINGUNG VORLIEGT BZW. BEHAUPTET WIRD. DIE VORSTEHENDEN
AUSSCHLÜSSE UND BESCHRÄNKUNGEN GELTEN SOWEIT SIE NACH GELTENDEM RECHT IN IHREM
RECHTSSYSTEM ZULÄSSIG SIND. COREL HANDELT BEZÜGLICH DES HAFTUNGSAUSSCHLUSSES SOWIE
DES AUSSCHLUSSES UND/ODER DER BESCHRÄNKUNG VON VERPFLICHTUNGEN,
GEWÄHRLEISTUNGSRECHTEN UND HAFTUNG GEMÄSS DIESEM LIZENZVERTRAG, JEDOCH NICHT IN
ANDEREN BEREICHEN, IM NAMEN SEINER HÄNDLER UND LIEFERANTEN.
1.14 RECHTE DER U.S.-REGIERUNG:
Das nach diesem Vertrag lizenzierte Produkt besteht aus "Commercial Computer Software" und "Commercial
Computer Software Documentation" gemäß 48 C.F.R. 252.227-7014(a)(1). Wenn diese Commercial
Computer Software und/oder Commercial Computer Software Documentation von oder im Namen einer
zivilen Stelle oder Behörde gemäß den Bestimmungen dieser Lizenz erworben wird, dann gilt das Produkt
gemäß 48 C.F.R. 12.212 (Computer Software)und 12.211 (Technical Data) der Federal Acquisition
Regulations ("FAR"), in der jeweils geltenden Fassung, als von der U.S.-Regierung erworben. Wenn dieses
Produkt von oder im Namen einer Stelle oder Behörde des Verteidigungsministeriums (Department of
Defense, "DOD") gemäß den Bestimmungen dieser Lizenz erworben wird, dann gilt diese Commercial
Computer Software und/oder Commercial Computer Software Documentation gemäß 48 C.F.R. 227.7202 der
DOD-FAR-Ergänzung ("DFAR"),in der jeweils geltenden Fassung, als von der U.S.?Regierung erworben.
1.15 EXPORTKONTROLLE:
Sofern das Produkt als "nicht für den Export bestimmt" gekennzeichnet ist (z.B. auf der Verpackung, dem
Datenträger oder durch eine bei der Installation des Produktes erscheinende Anzeige) gilt Folgendes - außer
bei Vorliegen einer durch das amerikanische Handelsministerium (United States Department of Commerce)
oder einer sonst zuständigen Verwaltungsbehörde erteilten Ausnahmegenehmigung: MIT AUSNAHME EINES
EXPORTS NACH KANADA FÜR EINE NUTZUNG IN KANADA DURCH EINE PERSON, DIE DORT EINEN
RECHTMÄSSIGEN STÄNDIGEN WOHNSITZ HAT, DARF DAS PRODUKT NICHT AUS DEN VEREINIGTEN
STAATEN VON AMERIKA EXPORTIERT WERDEN ODER AN EINE AUSLÄNDISCHE JURISTISCHE ODER
NATÜRLICHE PERSON (foreign entity or foreign person) IM SINNE DER U.S. GOVERNMENT REGULATIONS
EXPORTIERT WERDEN; DIES GILT INSBESONDERE FÜR PERSONEN, DIE NICHT STAATSBÜRGER DER
VEREINIGTEN STAATEN VON AMERIKA SIND, VON DORT STAMMEN ODER DORT EINEN RECHTMÄSSIGEN
STÄNDIGEN WOHNSITZ HABEN. DURCH IHRE ANNAHME DER BESTIMMUNGEN DIESES LIZENZVERTRAGES
ERKLÄREN SIE GEGENÜBER COREL, DASS SIE IN DIESEM SINNE KEIN AUSLÄNDER (foreign person) SIND
ODER VON EINEM SOLCHEN BEHERRSCHT WERDEN.
1.16 BERECHTIGUNG:
Zum Herunterladen oder zur Nutzung des Produktes sind Sie nur berechtigt, sofern Sie gemäß den geltenden
Exportgesetzen handeln. Sie dürfen das Produkt nur herunterladen, installieren und/oder benutzen, wenn:
(i) Sie sind weder Bürger bzw. Staatsangehöriger noch Einwohner von einem der folgenden Staaten bzw.
stehen nicht unter der Kotrolle einer dieser Staaten: Kuba, Iran, Irak, Libyen, Nordkorea, Sudan, Syrien,
Serbien, von den Taliban kontrollierte Gebiete Afghanistans oder eines anderen Staates, in den die
Vereinigten Staaten die Ausfuhr von Waren verboten haben. (ii) Sie werden das Produkt weder
herunterladen noch unmittelbar oder mittelbar in die unter (i) genannten Staaten noch an Bürger,
Staatsangehörige oder Einwohner solcher Staaten ausführen oder wiederausführen. (iii) Sie sind in den
Verzeichnissen des Finanzministeriums der Vereinigten Staaten (United States Department of Treasury)
weder als besonders bezeichnete Staatsangehörige, Terroristen oder Drogenhändler verzeichnet noch stehen
Sie auf der schwarzen Liste (Table of Denial Orders) des Handelsministeriums der Vereinigten Staaten
(United States Department of Commerce). (iv) Sie werden das Produkt weder herunterladen noch in
sonstiger Weise unmittelbar oder mittelbar an Personen ausführen oder wiederausführen, die auf den unter
(iii) genannten Listen aufgeführt sind, und (v) Sie werden das Produkt für keine durch das Recht der
Vereinigten Staaten verbotenen Zwecke benutzen und eine solche Nutzung nicht zulassen; dies gilt
insbesondere für die Entwicklung, das Design, die Herstellung oder Produktion atomarer, chemischer oder
biologischer Massenvernichtungswaffen.
Sofern die vorstehenden Angaben auf Sie nicht zutreffen, sind Sie nicht zur Nutzung oder zum Herunterladen
des Produktes berechtigt.
WENN SIE DIESES PRODUKT HERUNTERLADEN, TRAGEN SIE SÄMTLICHE MIT DER ÜBERTRAGUNG UND
DEM HERUNTERLADEN VERBUNDENEN RISIKEN EINER BESCHÄDIGUNG DES PRODUKTES.
1.17 AUSNAHMEN FÜR BENUTZER IN DEUTSCHLAND ODER ÖSTERREICH:
1.17.1 Begrenzte Gewährleistung für Benutzer in Deutschland oder Österreich.
Wenn Sie das Produkt in Deutschland oder Österreich erworben haben und eines dieser Länder Ihr
gewöhnlicher Wohnsitz ist, werden die Absätze 1.11 und 7.3 sowie sonstige Gewährleistungsbestimmungen
dieses Lizenzvertrages, soweit sie nicht mit diesem Absatz vereinbar sind, unter den folgenden
Voraussetzungen durch die gesetzlichen Bestimmungen zu Wesen von und Abhilfe bei Mängeln an Waren
ersetzt bzw. geändert: Corel darf erhebliche Mängel am Produkt nach eigenem Ermessen angemessen
beheben, indem es (i) ein Patch, Update oder Ersatzprodukt zur Verfügung stellt oder (ii) um Rücksendung
des Produktes bittet und die Lizenz aufhebt. Sie haben nur dann Anspruch auf Minderung des Kaufpreises
oder Rücktritt vom Lizenzvertrag, wenn Corel wiederholt den Mangel nicht nach einem angemessenen
Zeitraum behoben hat. Wenn Sie Endverbraucher sind, verjähren Ihre Ansprüche aus dieser Klausel nach 24
Monaten oder, wenn Sie ein Unternehmen führen, nach 12 Monaten. Sollten Sie das Produkt ohne
Genehmigung von Corel in irgendeiner Weise ändern, so behebt Corel keine Mängel, die durch diese
Änderung verursacht werden, und Sie sind für alle Schäden haftbar, die Corel aufgrund Ihrer nicht
genehmigten Änderung entstehen. VORAB-VERSIONEN DES PRODUKTES, DIE ALS SOLCHE
GEKENNZEICHNET SIND, INSTALLIEREN SIE AUF EIGENE GEFAHR; Vorab-Versionen des Produktes dürfen
nur zu Testzwecken in Testumgebungen benutzt werden und dürfen nicht zu Produktionszwecken benutzt
werden. Weitere Details finden Sie im Anhang "Sonderbedingungen für Vorab-Versionen" weiter unten. Um
einen Gewährleistungsanspruch geltend zu machen, müssen Sie eine detaillierte Fehlerbeschreibung an den
Corel-Kundendienst senden oder das Produkt nach Aufforderung durch Corel auf Kosten von Corel an die
Corel Corporation, 1600 Carling Avenue, Ottawa, Ontario, K1Z 8R7, Kanada, zurücksenden. Weitere
Gewährleistungsinformationen erhalten Sie beim Corel-Kundendienst.
1.17.2 Beschränkungen der Haftung für Benutzer in Deutschland oder Österreich.
Wenn Sie das Produkt in Deutschland oder Österreich erworben haben und eines dieser Länder Ihr
gewöhnlicher Wohnsitz ist, werden Absatz 1.13 und sonstige Haftungsbestimmungen dieses Lizenzvertrages,
soweit sie nicht mit diesem Absatz vereinbar sind, folgendermaßen ersetzt bzw. geändert: Corel haftet
möglicherweise (i) ohne Einschränkung für Schäden, die Ihnen aus oder im Zusammenhang mit diesem
Lizenzvertrag entstanden sind, nur wenn der Schaden durch eine vorsätzliche oder grob fahrlässige
Handlung von Corel oder seinen Vertretern entstanden ist; und (ii) für typische Schäden, die angemessen
vorhersehbar waren und die durch eine andere fahrlässige Verletzung einer wesentlichen vertraglichen
Pflicht durch Corel oder seine Vertreter verursacht wurden. Jede weitere Haftung von Corel oder seinen
Vertretern ist ausgeschlossen. Diese vorstehenden Beschränkungen gelten unabhängig von ihrer rechtlichen
Grundlage, besonders im Hinblick auf vorvertragliche oder nebenvertragliche Ansprüche. Diese
Beschränkungen gelten jedoch weder für die obligatorische Haftung aus dem geltenden deutschen bzw.
österreichischen Produkthaftungsgesetz noch für Schäden, die durch die Verletzung einer ausdrücklichen
Gewährleistung verursacht werden, soweit diese ausdrückliche Gewährleistung in der Absicht gegeben
wurde, den Benutzer gegen den speziellen entstandenen Schaden zu schützen, noch für Schadenersatz bei
Tod, Verletzung oder gesundheitlicher Beeinträchtigung.
1.17.3 Wenn Sie in Deutschland oder Österreich ein Unternehmen führen, unterliegen alle aus diesem
Vertrag entstehenden Verfahren der ausschließlichen Gerichtsbarkeit der Gerichte der Provinz Ontario,
Kanada.
1.18 AUSNAHMEN FÜR BENUTZER IN ENGLAND ODER WALES:
1.18.1 Begrenzte Gewährleistung.
Wenn Sie als Endverbraucher mit gewöhnlichem Wohnsitz im Vereinigten Königreich handeln und diesen
Lizenzvertrag dort abgeschlossen haben ("Endverbraucher"), dann werden die Absätze 1.11 und 7.3 sowie
sonstige Gewährleistungsbestimmungen dieses Lizenzvertrages, soweit sie nicht mit diesem Absatz vereinbar
sind, durch die Absätze 1.18.1 und 1.18.2 ersetzt bzw. geändert.
Corel gewährleistet dem Erstkäufer der Lizenz für das Produkt für einen Zeitraum von sechs (6) Monaten
nach dem Empfang bzw. Herunterladen, dass das Produkt, wenn es unter der empfohlenen HardwareKonfiguration und anderweitig in Übereinstimmung mit den Bestimmungen dieses Lizenzvertrages genutzt
wird, frei von Material- und Verarbeitungsmängeln ist, vorausgesetzt, Corel wird nicht haftbar gemacht für (i)
Beschädigung oder Verlust aufgrund von Unfall, unsachgemäßem Gebrauch, unbefugter Reparatur oder
Modifikation des Produktes oder Zweckentfremdung des Produktes durch Sie oder Dritte; (ii) Mängel am
Produkt aufgrund von normalem Verschleiß, ungewöhnlichen oder ungeeigneten Bedingungen, Lagerungen
oder Nutzungen oder einer Handlung, Fahrlässigkeit oder Vertragswidrigkeit durch Sie oder Dritte; oder (iii)
Mängel am Produkt, die Corel nach dem Lieferdatum nicht innerhalb von sechs (6) Monaten mitgeteilt
werden.
Um einen Gewährleistungsanspruch geltend zu machen, müssen Sie das Produkt innerhalb dieses Zeitraums
von sechs (6) Monaten auf Kosten von Corel an die Corel Corporation, 1600 Carling Avenue, Ottawa,
Ontario, K1Z 8R7, Kanada, zurücksenden. Corel haftet nicht für Gewährleistungsansprüche, die nach Ablauf
der Gewährleistungszeit auftreten. Wenn Corel nach dieser Gewährleistung haftbar ist, besteht die einzige
Verpflichtung von Corel darin, (i) das Produkt zu ersetzen oder zu reparieren; (ii) den Kaufpreis des
Produktes zu mindern; oder (iii) vom Lizenzvertrag zurückzutreten und Ihnen den für das Produkt gezahlten
Betrag zu erstatten.
1.18.2 Endverbraucher.
Wenn Sie als Endverbraucher Geschäfte tätigen (gemäß dem "Unfair Contract Terms Act" von 1977), gilt
Absatz 1.18.3 für Sie nicht, soweit der Ausschluss dieser Punkte nach englischem Recht verboten ist. Nur bei
Endverbrauchergeschäften (gemäß der "Consumer Transactions (Restrictions on Statements) Order" von
1976) werden Ihre gesetzlichen Rechte als Endverbraucher durch diesen Lizenzvertrag in keiner Weise
beeinträchtigt.
1.18.3 Haftungsausschluss.
Wenn Sie als Unternehmen oder Endverbraucher im Vereinigten Königreich ansässig sind, werden die
Absätze 1.12 und 7.3 sowie sonstige Haftungsausschlussbestimmungen dieses Lizenzvertrages, soweit sie
nicht mit diesem Absatz vereinbar sind, durch diesen Absatz 1.18.3 ersetzt bzw. geändert. Sofern nicht in
diesem Lizenzvertrag (einschließlich Absatz 1.18.2) ausdrücklich festgelegt, werden sämtliche Bedingungen,
Gewährleistungen und Zusagen, die sich ausdrücklich oder stillschweigend aus Gesetz, Common Law oder
sonstigen Bestimmungen ergeben, bezüglich des Produktes ausgeschlossen. Corel haftet Ihnen gegenüber
nicht (aus Billigkeit, Vertrag oder unerlaubter Handlung, gemäß dem "Misrepresentation Act" von 1967 oder
anderweitig) für Zusagen, die nicht in diesem Lizenzvertrag enthalten sind, und Sie erklären, dass Sie beim
Abschluss dieses Lizenzvertrages nicht auf eine Angabe oder Zusage vertraut haben bzw. dadurch verleitet
wurden, die nicht ausdrücklich in diesem Lizenzvertrag enthalten war.
1.18.4 Beschränkungen der Haftung.
Wenn Sie als Unternehmen oder Endverbraucher im Vereinigten Königreich ansässig sind, werden die
Absätze 1.13 und 7.3 sowie sonstige Haftungsbestimmungen dieses Lizenzvertrages, soweit sie nicht mit
diesem Absatz vereinbar sind, durch diesen Absatz 1.18.4 ersetzt bzw. geändert. Corel haftet weder Ihnen
noch Dritten gegenüber für direkte oder indirekte Verluste, Verbindlichkeiten, Kosten, Schäden oder
Verletzungen, die aus Design-, Material- oder Verarbeitungsmängeln nach Vertrag, unerlaubter Handlung
(dazu gehört uneingeschränkt auch Fahrlässigkeit), Irreführung oder anderweitig entstanden sind; davon
ausgenommen sind die Bestimmungen dieses Absatzes 1.18 sowie die Haftung (i) wegen Tod oder
Verletzung durch Fahrlässigkeit von Corel; (ii) wegen Verletzung der Verpflichtungen aus Absatz 12 des "Sale
of Goods Act" von 1979; (iii) gemäß Teil I des "Consumer Protection Act" von 1987; und (iv) wegen Betrugs.
Corel haftet Ihnen gegenüber weder aus Vertrag, aus unerlaubter Handlung (dazu gehört uneingeschränkt
auch Fahrlässigkeit), aus Irreführung noch anderweitig für (i) indirekt oder als Folgeschäden bei Ihnen oder
Dritten aufgetretene Verluste oder Aufwendungen, unabhängig von deren Ursache; (ii) Verluste oder
Schäden, die Sie aufgrund von Ansprüchen Dritter erleiden; (iii) den Verlust von Gewinnen, Firmenwert, Ruf,
Geschäftsabschlüssen oder Aufträgen sowie Verluste oder Aufwendungen aufgrund von Ansprüchen Dritter.
Die Gesamthaftung von Corel Ihnen gegenüber ist unabhängig davon, ob sie sich aus Vertrag, aus
unerlaubter Handlung (dazu gehört uneingeschränkt auch Fahrlässigkeit), aus Irreführung oder anderweitig
ergibt, im Hinblick auf jedes einzelne Ereignis bzw. auf jede Folge von zusammenhängenden Ereignissen auf
die Kosten des mangelhaften oder beschädigten Produktes beschränkt, aus dem diese Haftung entsteht.
1.19 ALLGEMEINES:
Diese Lizenz stellt die gesamten Vereinbarungen zwischen Ihnen und uns dar und ersetzt jegliche sonstigen
mündlichen oder schriftlichen Vereinbarungen oder Absprachen, Erklärungen oder Ankündigungen, es sei
denn, zwischen Ihnen und Corel oder einer ihrer Tochtergesellschaften ist ein gesonderter, wirksam
bestehender Lizenzvertrag (die "Andere Lizenz") abgeschlossen worden; in einem solchen Fall wäre bei
Widersprüchen zwischen dieser Lizenz und der Anderen Lizenz die Andere Lizenz maßgeblich. Diese Lizenz
kann nur durch ein schriftliches Dokument geändert werden, das von einer autorisierten Führungskraft von
Corel unterzeichnet wurde. Diese Lizenz unterliegt dem Recht der Provinz Ontario, Kanada, und wird gemäß
diesem Recht ausgelegt, und die Parteien verpflichten sich, sich der ausschließlichen Gerichtsbarkeit der
Gerichte der Provinz Ontario, Kanada, zu unterwerfen, wenn dies durch das geltende Recht zugelassen ist,
es sei denn, es besteht eine Andere Lizenz, in welchem Fall die in der Anderen Lizenz gewählte
Rechtsordnung maßgeblich wäre. In dieser Lizenz werden insbesondere (i) die Bestimmungen über eine
Rechtwahl nach internationalem Privatrecht und (ii) das Übereinkommen der Vereinten Nationen über den
internationalen Warenkauf und insoweit bestehende Durchführungsregelungen ausgenommen. Sollte eine
Bestimmung dieses Lizenzvertrages durch ein zuständiges Gericht für unwirksam, rechtswidrig oder
undurchführbar erklärt werden, so wird diese Bestimmung aus diesem Lizenzvertrag herausgetrennt, ohne
dass dadurch die Wirksamkeit der übrigen Bestimmungen berührt wird. Sofern in diesem Lizenzvertrag nicht
anderweitig im Rahmen des geltenden Rechts festgelegt, hat diese Lizenz keinen Einfluss auf die nicht
ausschließbaren gesetzlichen Rechte jeder Partei, die als Endverbraucher Geschäfte tätigt.
1.20 EINHALTUNG VON LIZENZVERTRÄGEN:
Wenn Sie ein Geschäft oder ein Unternehmen führen, stimmen Sie zu, dass Sie nach Aufforderung durch
Corel oder den bevollmächtigten Vertreter von Corel innerhalb von dreißig (30) Tagen vollständig belegen
und bescheinigen, dass die Nutzung aller Corel-Produkte zum Zeitpunkt dieser Aufforderung mit Ihren
gültigen Lizenzen von Corel übereinstimmt.
2. BESTIMMUNGEN ZUM GEBRAUCH VON CLIPART UND STOCK PHOTO IMAGES:
Corel-Produkte enthalten zahlreiche Clipart- und Photoabbildungen (nachstehend gemeinsam die "Bilder"
genannt); die Rechte an den Bildern werden teils von Corel selbst gehalten und sind teils Gegenstand von
Lizenzvereinbarungen zwischen Corel und Dritten. Vorbehaltlich der nachstehenden Beschränkungen sind Sie
als Nutzer von Corel-Produkten berechtigt, die Bilder nach Belieben zu nutzen, zu verändern und zu
veröffentlichen. Sollten Sie Zweifel haben, ob eine beabsichtigte Verwendung der Bilder den nachstehenden
Bestimmungen entspricht, empfiehlt Corel Ihnen, einen eigenen Anwalt oder sonstigen Rechtsberater
hinzuzuziehen. Corel gibt Ihnen gegenüber keine Stellungnahme zu der Frage ab, ob eine bestimmte
Verwendung der Bilder mit diesen Bestimmungen vereinbar ist.
2.1 WAS SIE DÜRFEN, unbeschadet der nachstehend aufgeführten Beschränkungen:
(i) Sie dürfen Bilder in von Ihnen im Original erstellte Werke einfügen und diese Werke über beliebige
Medien veröffentlichen, verteilen oder zur Schau stellen, wobei Sie jedoch verpflichtet sind, Ihr Werk wie
folgt mit einem Urheberrechtsvermerk zu versehen, der auf Ihre sowie Corels Rechte hinweist:
"Copyright (c) 200_ [Ihr Name] und seine/ihre Lizenzgeber. Alle Rechte vorbehalten."
(ii) und Sie dürfen von Bildern eine (1) Kopie zu Archivierungs- oder Sicherungszwecken erstellen.
2,2 WAS SIE NICHT DÜRFEN:
(i) Es ist Ihnen jedoch nicht gestattet, Rechte an Bildern weiterzuveräußern, Unterlizenzen daran zu erteilen
oder sie Dritten auf andere Weise getrennt von einem Produkt oder einer Web-Seite zur Verfügung zu
stellen. So dürfen Bilder beispielsweise als Teil einer Web-Seite genutzt werden, jedoch nicht separat zum
Herunterladen oder in einem Format bereitgestellt werden, das für eine dauerhafte Speicherung oder
Wiederverwendung durch Dritte geeignet ist;
(ii) Bilder oder Nutzungsrechte an Bildern dürfen Kunden separat oder als Teil eines von Ihnen angebotenen
Werkes für eine weitere Nutzung nicht zur Verfügung gestellt werden; jedoch können Kunden Kopien von
Bildern (einschließlich digitaler Dateien) als Bestandteil eines Werkes zur Verfügung gestellt werden;
(iii) Sie dürfen keine anstößigen, obszönen, beleidigenden oder unsittlichen Werke unter Verwendung von
Bildern erstellen oder Bilder für verbotene Zwecke verwenden;
(iv) Sie dürfen Bilder oder Teile von Bildern nicht als Waren- bzw. Dienstleistungszeichen benutzen oder eine
solche Benutzung gestatten und keinerlei Eigentumsrechte an Bildern oder Teilen derselben geltend machen;
(v) Sie dürfen Bilder, die sich auf erkennbare Einzelpersonen oder juristische Personen beziehen, nicht für
kommerzielle Zwecke oder auf eine Weise benutzen, die deren Verbindung mit einem Produkt oder einer
Dienstleistung oder deren Zustimmung dazu nahe legt.
(vi) Sie dürfen Bilder nicht in elektronischem Format, online oder in Multimediaanwendungen benutzen, es
sei denn, das Bild bzw. die Bilder sind nur zur Ansicht integriert, und es wird keine Erlaubnis gegeben, die
Bilder für irgendeinen Zweck herunterzuladen oder abzuspeichern;
(vii) Sie dürfen Bilder oder Kopien von Bildern nicht an eine dritte natürliche oder juristische Person
vermieten oder ihr entgeltlich oder unentgeltlich Nutzungs- oder Lizenzrechte daran gewähren. Sie dürfen
jedoch die Ihnen lizenzierten Nutzungsrechte an einem oder mehreren Bildern auf einen Dritten übertragen,
sofern (i) Sie das bzw. die betreffenden Bild(er) zusammen mit dieser Lizenz und allen Kopien (mit
Ausnahme von Kopien, die gemäß den Bestimmungen dieses Lizenzvertrages in von Ihnen erstellte Werke
integriert sind) auf die betreffende natürliche oder juristische Person übertragen, (ii) davon keinerlei Kopien
zurückbehalten, was auch für auf einem Computer oder sonstigen Datenträger abgespeicherte Kopien gilt,
und (iii) der Übertragungsempfänger die Verbindlichkeit sämtlicher Bestimmungen dieses Lizenzvertrages für
sich selbst anerkennt;
(viii) Sie dürfen Bilder stets nur so nutzen, wie dies nach dem Wortlaut dieses Vertrages ausdrücklich erlaubt
ist.
2.3 HOHEITSWAPPEN, SIEGEL UND SONSTIGE INSIGNIEN:
In dem Produkt enthaltene hoheitliche und sonstige Insignien sind durch verschiedene Gesetze gegen
missbräuchliche Verwendung geschützt. Grundsätzlich gilt, dass alle Logos, Insignien, Abzeichen, Siegel,
Flaggen und Wappen nur für offizielle Zwecke verwendet werden dürfen. Es obliegt Ihnen, für die Einhaltung
aller nationalen und internationalen Vorschriften über das Zurschaustellen von in dem Produkt enthaltenen
Insignien, Siegeln, Flaggen und Wappen zu sorgen.
3. ANHANG ZU DER ALLGEMEINEN LIZENZVEREINBARUNG: SONDERBEDINGUNGEN FÜR
PROBEVERSIONEN:
3.1 SOFERN DAS PRODUKT ALS PROBEVERSION GEKENNZEICHNET IST, GELTEN FÜR SEINE NUTZUNG IN
ERGÄNZUNG ZU DEN BESTIMMUNGEN DER ALLGEMEINEN LIZENZVEREINBARUNG DIE VORLIEGENDEN
SONDERBEDINGUNGEN FÜR PROBEVERSIONEN, BIS SIE EINE LIZENZ FÜR DIE IM HANDEL ERHÄLTLICHE
VOLLSTÄNDIGE NORMALVERSION ERWERBEN. Bei Widersprüchen zwischen der Allgemeinen
Lizenzvereinbarung und diesen Sonderbedingungen für Probeversionen sind diese Sonderbedingungen
maßgeblich.
DIE PROBEVERSION DES PRODUKTES KANN NACH EINEM FESTGELEGTEN ZEITRAUM (z. B. 30, 45 ODER 60
TAGE) ODER NACH EINER BESTIMMTEN ANZAHL VON ANWENDUNGEN GEMÄSS ANGABE NACH DER
INSTALLATION NICHT MEHR BETRIEBEN WERDEN. NACH ABLAUF DIESER FRIST ODER DIESER ANZAHL
VON ANWENDUNGEN ENDET DIESE LIZENZ, UND SIE WERDEN KEINEN ZUGRIFF MEHR AUF UNTER
VERWENDUNG DER PROBEVERSION ERSTELLTE DATEIEN HABEN, SOFERN SIE BIS DAHIN KEINE IM
HANDEL ERHÄLTLICHE LIZENZIERTE NORMALVERSION DES PRODUKTES INSTALLIERT HABEN.
DIESE PROBEVERSION ERMÖGLICHT IHNEN DEN ZUGRIFF AUF EINE BEGRENZTE ANZAHL DES BZW. DER
MODULE DER IM HANDEL ERHÄLTLICHEN NORMALVERSION DES PRODUKTES, UND NUR DIESES BZW.
DIESE MODULE KÖNNEN MITTELS DIESER PROBEVERSION INSTALLIERT WERDEN. FÜR DIE WEITEREN
KOMPONENTEN UND ANWENDUNGEN DER IM EINZELHANDEL ERHÄLTLICHEN NORMALVERSION ERHALTEN
SIE MIT DIESER PROBEVERSION KEINE LIZENZ. SÄMTLICHE IN DER PROBEVERSION ENTHALTENEN
VERWEISE AUF ANDERE ANWENDUNGEN, ZUSÄTZLICHE BIBLIOTHEKEN ODER ANDERE CD-ROMS SIND
FÜR DIE NUTZUNG DER PROBEVERSION OHNE RELEVANZ. COREL LIZENZIERT DIESE PROBEVERSION DES
PRODUKTES IN DEM BESTEHENDEN ZUSTAND NUR ALS DEMONSTRATIONSMODELL, UND DIESE VERSION
SOLLTE LEDIGLICH IN EINER DEDIZIERTEN TESTUMGEBUNG GENUTZT WERDEN, IN DER KEINE GEFAHR
HINSICHTLICH DES VERLUSTES ODER DER BESCHÄDIGUNG VON PRODUKTIONSDATEN BESTEHT.
Ihnen wird hier lediglich eine Lizenz für die Nutzung der Probeversion des Produktes gewährt. Diese Lizenz
gilt nur für den in der Probeversion des Produktes genannten Zeitraum und endet nach dessen Ablauf.
Jeder Versuch, das elektronische Verfallsdatum bzw. den "Zeitbombenmechanismus" oder andere Funktionen
zu umgehen, die in dem Produkt enthalten sind und deren Zweck es ist, die Nutzbarkeit des Produktes
ausschließlich auf eine Probeversion bzw. auf einen bestimmten Zeitraum zu beschränken, stellt einen
Verstoß gegen die Lizenzbestimmungen dar und hat die automatische und unmittelbare Beendigung Ihrer
Lizenz zur Nutzung des Produktes zur Folge.
3.2 COREL LEHNT IHNEN GEGENÜBER GEWÄHRLEISTUNGS- ODER HAFTUNGSVERPFLICHTUNGEN
JEGLICHER ART (EINSCHLIESSLICH VERPFLICHTUNGEN AUFGRUND VON FAHRLÄSSIGKEIT) AB; SOFERN
JEDOCH EINE GESETZLICHE, MÖGLICHERWEISE BESCHRÄNKTE HAFTPFLICHT FÜR SOFTWAREPROBEVERSIONEN NICHT AUSGESCHLOSSEN WERDEN KANN, BESCHRÄNKT COREL SEINE HAFTUNG
SOWIE DIE HAFTUNG SEINER LIEFERANTEN UND HÄNDLER DARAUF, NACH EIGENER WAHL DEN VON
IHNEN FÜR DAS PRODUKT BEZAHLTEN BETRAG ZU ERSTATTEN, DIE WAREN ZU REPARIEREN ODER ZU
ERSETZEN, ÄQUIVALENTE WAREN NEU ZU LIEFERN ODER DIE DAMIT VERBUNDENEN KOSTEN ZU TRAGEN.
4. ANHANG ZU DER ALLGEMEINEN LIZENZVEREINBARUNG: SONDERBEDINGUNGEN FÜR EDUCATION
EDITIONS:
4.1 SOFERN DAS PRODUKT ALS EDUCATION EDITION GEKENNZEICHNET IST, GELTEN FÜR SEINE
NUTZUNG IN ERGÄNZUNG ZU DEN BESTIMMUNGEN DER ALLGEMEINEN LIZENZVEREINBARUNG DIE
VORLIEGENDEN SONDERBEDINGUNGEN FÜR EDUCATION EDITIONS. Bei Widersprüchen zwischen der
Allgemeinen Lizenzvereinbarung und diesen Sonderbedingungen für Education Editions sind diese
Sonderbedingungen maßgeblich. Sie haben nur dann Anspruch auf Nutzung des Produktes, wenn Sie in
Ihrem Rechtssystem die entsprechende Berechtigung als Endnutzer für Education Editions besitzen. Bitte
wenden Sie sich an den Corel-Kundendienst, um zu erfahren, ob Sie zur Nutzung des Produktes berechtigt
sind.
UNGEACHTET ANDERSLAUTENDER BESTIMMUNGEN DER ALLGEMEINEN LIZENZVEREINBARUNG IST ES
IHNEN NICHT GESTATTET, DIESES PRODUKT, KOPIEN DIESES PRODUKTES ODER IHRE INSOWEIT
BESTEHENDEN LIZENZRECHTE AUF EINEN DRITTEN ZU ÜBERTRAGEN.
4.2 Wenn Sie dieses Produkt als Teil des Student Campus Reward Option for Learning (SCROL) Programms
erworben haben, wird Absatz 1.10 der Lizenz gestrichen und durch folgenden Wortlaut ersetzt:
1.10 LAUFZEIT: Diese Lizenz gilt nur so lange, wie Sie ein ordnungsgemäß immatrikulierter Vollzeitstudent
oder Mitglied des Lehrkörpers einer anerkannten höheren Lehranstalt oder Hochschule sind und endet nach
Ablauf der Lizenz. Als "anerkannte höhere Lehranstalt oder Hochschule" im Sinne dieses Lizenzvertrages
gelten alle privaten oder öffentlichen Berufsschulen, Fernlehrinstitute, Junior Colleges, Colleges,
Universitäten oder geistes- oder naturwissenschaftlichen bzw. technischen Institute, die von dem
zuständigen Ministerium als solche anerkannt sind. Ferner endet diese Lizenz, falls Sie gegen eine ihrer
Bestimmungen verstoßen. Sie verpflichten sich, bei Beendigung des Lizenzverhältnisses sämtliche Exemplare
und Kopien des Produktes zu vernichten. Die in den Absätzen 1.9, 1.11, 1.12, 1.13, 1.17, 1.18, 3.2, 6.3 und
7.3 genannten Rechte an geistigem Eigentum, Beschränkungen der Gewährleistung und Haftung sowie
Haftungsausschlüsse bleiben auch nach einer Beendigung in Kraft.
5. ANHANG ZU DER ALLGEMEINEN LIZENZVEREINBARUNG: SONDERBEDINGUNGEN FÜR OEM-VERSIONEN:
OEM-PRODUKTE WERDEN NUR IN VERBINDUNG MIT VON COREL ZUGELASSENEN "PARTNERPRODUKTEN"
BZW. "-DIENSTLEISTUNGEN", DIE AUF DEM DATENTRÄGER BEZEICHNET SIND, VERKAUFT BZW.
LIZENZIERT, UND SIE HABEN NUR DANN ANSPRUCH AUF NUTZUNG DIESES PRODUKTES, WENN ES IN
ÜBEREINSTIMMUNG DAMIT ERWORBEN WURDE. SIE HABEN KEINEN ANSPRUCH AUF NUTZUNG DIESES
PRODUKTES, WENN SIE ES ALS SELBSTÄNDIGES PRODUKT ERHALTEN HABEN. Sofern das Produkt als
OEM-Version gekennzeichnet ist, gelten für seine Nutzung in Ergänzung zu den Bestimmungen der
Allgemeinen Lizenzvereinbarung die vorliegenden Sonderbedingungen für OEM-Versionen. Bei
Widersprüchen zwischen der Allgemeinen Lizenzvereinbarung und diesen Sonderbedingungen für OEMVersionen sind diese Sonderbedingungen maßgeblich.
UNGEACHTET ANDERSLAUTENDER BESTIMMUNGEN DER ALLGEMEINEN LIZENZVEREINBARUNG IST ES
IHNEN NICHT GESTATTET, DIESES PRODUKT, KOPIEN DIESES PRODUKTES ODER IHRE INSOWEIT
BESTEHENDEN LIZENZRECHTE AUF EINEN DRITTEN ZU ÜBERTRAGEN.
6. ANHANG ZU DER ALLGEMEINEN LIZENZVEREINBARUNG: SONDERBEDINGUNGEN FÜR SDK-VERSIONEN:
SOFERN DAS PRODUKT EINEN COREL-TOOLKIT FÜR SOFTWARE-ENTWICKLER (NACHSTEHEND
"SOFTWARE DEVELOPER'S TOOLKIT" GENANNT, ABGEKÜRZT "SDK") ENTHÄLT, GELTEN FÜR JEDE
NUTZUNG DES ENTSPRECHENDEN TEILS DES PRODUKTES IN ERGÄNZUNG ZU DEN BESTIMMUNGEN DER
ALLGEMEINEN LIZENZVEREINBARUNG DIE VORLIEGENDEN SONDERBEDINGUNGEN FÜR SDK-VERSIONEN.
Bei Widersprüchen zwischen der Allgemeinen Lizenzvereinbarung und diesen Sonderbedingungen für SDK-
Versionen sind diese Sonderbedingungen maßgeblich.
Bei der Entwicklung des SDK war Corel bemüht, diesen mit früheren SDK-Versionen kompatibel zu machen.
Da der Software Developer's Kit jedoch laufend geändert und neu gestaltet wird, wobei bei jeder neuen
Version bzw. jedem neuen Produkt bestimmte Eigenschaften neu hinzukommen und andere entfallen, kann
Corel weder zusichern noch gewährleisten, dass das Produkt mit anderen Versionen oder Produkten
kompatibel ist.
Sie sind alleine dafür verantwortlich zu prüfen, dass der SDK für die von Ihnen beabsichtigte Verwendung
geeignet ist. Der SDK wird in der Erwartung geliefert, dass er von Personen genutzt wird, deren Fähigkeiten
ausreichen, eigene Programme zu schreiben und zu testen; Corel übernimmt keinerlei Verpflichtung, im
Zusammenhang mit dem SDK bzw. dessen Einsatz irgendwelche Supportleistungen zu erbringen. Jegliche
von Ihnen vorgenommene Versuchs-, Entwicklungs- oder Bewertungstätigkeit erfolgt ausschließlich auf
eigenes Risiko.
6.1 WAS SIE DÜRFEN:
(i) Sie dürfen den SDK ausschließlich zu Entwicklungs-, Herstellungs-, Marketing- und Supportzwecken eines
oder mehrerer Software-Anwendungspakete ("Software-Anwendungsprodukt") verwenden;
(ii) Sie dürfen die Software-Programmdateien, die im Ordner "Redistributables" des SDK enthalten sind
("SDK-Dateien"), vervielfältigen und unterlizenzieren, sofern die Dateien in ablauffähigem Format vorliegen
und in einem Software-Anwendungsprodukt enthalten sind, das Sie entwickelt haben. Unterlizenzen an SDKDateien sind in jedem Fall auf Verwendungen im Zusammenhang mit einem Software-Anwendungsprodukt
und als unterlizenzierter Teil desselben beschränkt und gelten ausschließlich für Support-, Service-,
Upgrading- und sonstige Unterstützungsleistungen.
6.2 WAS SIE NICHT DÜRFEN:
(i) Sie dürfen Urheberrechtsvermerke, Warenzeichen oder sonstige von Corel auf dem SDK oder einem Teil
desselben angebrachte Eigentumsvermerke weder entfernen noch verändern.
6.3 SCHADLOSHALTUNG:
Sie sind verpflichtet, COREL wegen und im Zusammenhang mit sämtlichen Kosten, Verbindlichkeiten,
Ansprüchen oder Forderungen (einschließlich Rechtsverfolgungs- und sonstiger Kosten in angemessener
Höhe) schadlos zu halten, die durch oder infolge einer Nutzung, Vervielfältigung oder Veröffentlichung von
Ihnen erstellter Software-Anwenderprodukte, Dokumentationen oder Marketing- bzw. Werbematerialien
entstehen.
6.4 WARENZEICHEN UND HANDELSNAMEN VON COREL:
Verweise auf Corel oder das Anbringen von Warenzeichen von Corel sind nur in dem Umfang erlaubt, wie
dies ausschließlich dem Zweck dient, das ein Software-Anwenderprodukt zusammen mit bestimmter CorelSoftware genutzt werden kann. Sofern Sie Verweise auf Corel oder Warenzeichen von Corel in oder auf
Programmen, Verpackungen, Marketing- oder Werbematerialien anbringen, muss jede Erwähnung dieser
Zeichen oder Handelsnamen auf der gleichen Seite durch eine Fußnote (Mindestschriftgröße 10) mit
nachstehendem Wortlaut ergänzt werden:
"Dieses Produkt wurde nicht von der Corel Corporation hergestellt, genehmigt oder bearbeitet."
7. ANHANG ZU DER ALLGEMEINEN LIZENZVEREINBARUNG: SONDERBEDINGUNGEN FÜR VORABVERSIONEN:
SOFERN DAS PRODUKT ALS VOR- ODER BETA-VERSION GEKENNZEICHNET IST, GELTEN FÜR JEDE
NUTZUNG DES PRODUKTES IN ERGÄNZUNG ZU DEN BESTIMMUNGEN DER ALLGEMEINEN
LIZENZVEREINBARUNG DIE VORLIEGENDEN SONDERBEDINGUNGEN FÜR VORAB-VERSIONEN. Bei
Widersprüchen zwischen der Allgemeinen Lizenzvereinbarung und diesen Sonderbedingungen für VorabVersionen sind diese Sonderbedingungen maßgeblich. Sofern Sie eine von Corel zugelassene Vorab- oder
Beta-Testanlage betreiben (Authorized Corel Beta Test Site) und von Corel die Genehmigung erhalten haben,
eine von Corel auf dem freien Markt nicht angebotene Beta-Version eines Corel-Produktes zu testen,
unterliegt Ihre Nutzung dieser Beta-Version den Bestimmungen der zwischen Ihnen und Corel
abgeschlossenen Lizenzvereinbarung über den Einsatz von Beta-Testanlagen, wobei in diesem Fall jede
Anwendung der nachstehenden Bestimmungen ausgeschlossen ist, soweit mit den Sonderbedingungen für
die Vorab- oder Beta-Testanlageversion Widersprüche bestehen.
7.1 LIZENZGEWÄHRUNG: Corel gewährt Ihnen eine nicht-ausschließliche Lizenz, die Sie für einen
begrenzten Zeitraum berechtigt, das Produkt zu Versuchs- und Testzwecken zu verwenden. Durch diese
Lizenzgewährung entsteht kein Anspruch auf Erhalt von gedruckter Dokumentation, Supportleistungen oder
telefonischer Unterstützung bzw. Beratung. Corel beabsichtigt zwar, eine kommerzielle Version des
Produktes auf den Markt zu bringen, behält sich aber dennoch das Recht vor, diese Absicht jederzeit
aufzugeben oder Preise, Eigenschaften, Lizenzbedingungen oder sonstige Merkmale bei dieser kommerziellen
Version zu verändern.
7.2 BEENDIGUNG: Die Laufzeit der entsprechend den Sonderbedingungen für Vorab-Versionen gewährten
Lizenz endet dreißig (30) Tage nach der Markteinführung einer kommerziellen Version des Produktes. Die
Lizenz endet ferner, ohne dass es einer weiteren Erklärung bedarf, wenn Sie die in diesen
Lizenzbedingungen vorgesehenen Beschränkungen nicht einhalten. Bei Beendigung des Lizenzverhältnisses
sind Sie in jedem Fall verpflichtet, sämtliche Exemplare des Produktes zu vernichten.
7.3 GEWÄHRLEISTUNGSAUSSCHLUSS: SIE BESTÄTIGEN, DASS ES SICH BEI DEM PRODUKT UM EINE
VORAB-VERSION HANDELT, DIE IN IHREM BESTEHENDEN ZUSTAND UND OHNE GEWÄHRLEISTUNG FÜR
MÄNGELFREIHEIT ZUR VERFÜGUNG GESTELLT WIRD. ES IST NICHT AUSZUSCHLIESSEN, DASS DAS
PRODUKT PROGRAMMFEHLER UND/ODER ANDERE FEHLER ODER MÄNGEL ENTHÄLT, DIE AUCH ZU
SYSTEMSTÖRUNGEN FÜHREN KÖNNEN, ODER DASS NICHT ALLE FUNKTIONEN, FÜR DIE DAS PRODUKT
BESTIMMT IST BZW. ENTWICKELT WURDE, TATSÄCHLICH ZUR VERFÜGUNG STEHEN. DAS PRODUKT
SOLLTE LEDIGLICH IN EINER DEDIZIERTEN TESTUMGEBUNG GENUTZT WERDEN, IN DER KEINE GEFAHR

Wenn es sich bei dem Produkt um iGrafx Process Central 2003, Starter Edition, handelt, gilt ungeachtet
gegensätzlicher Bestimmungen in der allgemeinen Lizenzvereinbarung Folgendes:
8.1 Sie dürfen Datenbanken von iGrafx Process Central 2003, Starter Edition, auf einem einzelnen Server
erstellen. Wenn der Server über mehrere Prozessoren verfügt, müssen Sie für jeden Prozessor auf diesem
Server eine separate Lizenz erwerben.
8.2 Sie dürfen die Komponenten "Client", "Server Administrator" und "Web Central" von iGrafx Process
Central 2003, Starter Edition, auf einem beliebigen internen Gerät installieren. Außerdem darf iGrafx Process
2003 Viewer Software auf einem beliebigen internen Gerät installiert werden.
8.3 Auf die Datenbanken von iGrafx Process Central 2003, Starter Edition, dürfen fünf Benutzer gleichzeitig
zugreifen, vorausgesetzt, Sie haben eine gültige Lizenz für jeden Prozessor auf dem Server erworben, auf

1.1 DEFINITIONS:
1.1.1 "Computer" means one (1) central processing unit (CPU) that accepts information in digital or similar
form and manipulates it for a specific result based on a sequence of instructions;
1.1.2 "Documentation" means any accompanying printed materials, this License, any other agreement you
may have with Corel relating to this Product, and "online" or electronic documentation;
1.1.3 "Permitted Number" means one (1) unless otherwise indicated under a valid license granted by Corel
or one of its subsidiaries;
1.1.4 "Product" means a computer program, computer software (including its code) objects (including their
APIs) as well as any images, photographs, templates, animations, video, audio, music, text and "applets"
incorporated into the software, and where applicable, storage media containing all the above, including any
Documentation; and
1.1.5 "Use" means to access, install, download, copy or otherwise benefit from using the functionality of the
Product in accordance with the Documentation.
1.2 LICENSE:
Corel provides you with a Product and grants you a non-exclusive license to Use the Product in accordance
with the terms of this License. Any supplemental software code and supporting materials provided to you as
part of support services provided by Corel for the Product shall be considered part of the Product and subject
to the terms and conditions of this License. The copyright and all other rights to the Product shall remain
with Corel or its licensors. You must reproduce any copyright or other notice marked on the Product on all
copies you make. Some third party materials included in the Product may be subject to other terms and
conditions which are typically found in the "Help About" box.
1.3 YOU MAY:
(i) install and use one (1) copy of the Product on a Computer up to the Permitted Number of Computers. You
may also make and use a second copy of the Product on a home or portable computer provided that copy is
never loaded in the RAM of the home or portable computer at the same time it is loaded in the RAM of the
primary computer;
(ii) install one (1) copy of the Product on a storage device, such as a network server, used only to install or
run the Product on your other Computers within an internal network up to the Permitted Number. You must
acquire and dedicate a license for each Computer on which the Product is installed or run from the storage
device. A single license for the Product may not be shared or used concurrently on different Computers
unless you have another agreement with Corel permitting you to do so;
(iii) make one copy of the Product solely for archive or backup purposes;
(iv) if this Product includes Clipart and/or Photo Images, use the Clipart and/or Photo Images only if you
comply with the terms set out in the Corel Guidelines for the Use of Clipart and Stock Photo Images below;
(v) except in the case of Academic Edition, OEM Edition and Pre-release Version Products which are nontransferable (see Academic Edition Addendum, OEM Edition Addendum and Pre-release Version Addendum
below), transfer the Product to someone else only if you assign all of your rights under this License, cease all
Use of the Product, erase or destroy any copy (including the hard disk copy) made in support of your Use of
the Product, and ensure that the person to whom you wish to transfer the Product agrees to the terms of
this License;
(vi) if you have purchased this Product as an upgrade to either a Corel product or another vendor's product,
you may continue to Use your previous product with this Product. If you transfer this Product, you must
either transfer the previous product at the same time you transfer the Product or destroy the previous
product at the same time you transfer the Product. If the Product you have purchased is an upgrade of a
Corel product, you now may Use that previous product only in accordance with this License; and
(vii) Use only one (1) of the language versions if the Product provides you with a selection of multiple
language versions;
(viii) if this Product includes NetPerfect(R), use NetPerfect to manage up to one hundred (100) documents. If
you wish to manage more than one hundred (100) documents you must obtain an additional NetPerfect
license from Corel;
(ix) if this Product includes Show On The Go(TM), Corel PRESENTS Runtime Player(TM) or a similar feature
that permits the creation of a runtime slide show presentation, freely copy and distribute the runtime
program files together with slide show graphic files developed using the Product; provided you (a) do not
use the logo, name, or trademarks of Corel or its licensors other than to indicate that the slide show file was
created using Corel(R) Presentations(TM) or another Corel product, (b) include your copyright notice on
media containing the runtime program files and/or in a conspicuous place within your slide show file, and (c)
indemnify Corel and its licensors against any claims or lawsuits arising from your use or distribution of the
runtime program files as part of the slide show file you distribute. You are responsible for all primary
technical support to the end user of any runtime program file you distribute; and
(x) if this Product contains Trellix software (the "Program"), install and use one copy of the Program on a
single computer. The primary user of the computer on which the Program is installed may install the
program for his or her exclusive use on a single portable computer. Notwithstanding the foregoing, you may
duplicate or make copies of the "Viewers Setup.exe" file and distribute those copies to others for their use,
solely for the purpose of viewing Trellix documents you have created. The Viewers Setup.exe file must be
unmodified, include the EULA contained in the file, and retain any legal notices associated with such file.
Trellix Corporation and Corel assume no responsibility or liability for the distribution of such copies. You may
also distribute Trelligram files produced by the Trelligram creator program, a component of the Program to
third parties solely for the purpose of enabling such third parties to view the user materials packaged in such
files, provided that you have the requisite rights or permission to distribute such materials. You (and not
Corel or Trellix Corporation) assume all responsibility and liability for the content of such materials and for
suitability of the Program for the recipient of such materials.
1.4 YOU MAY NOT:
(i) Use the Product or make copies of it other than as permitted in this License except to the extent the
foregoing restriction is, by operation of applicable law, prohibited or of no effect;
(ii) translate, reverse engineer, decompile, or disassemble the Product except to the extent the foregoing
restriction is, by operation of applicable law, prohibited or of no effect;
(iii) rent, lease, assign, sell, sublicense, lend or transfer the Product except as set out in Section 1.3 above;
(iv) modify the Product or merge all or any part of the Product with another program;
(v) redistribute the fonts or sound files included with the Product;
(vi) separate the component parts of the Product for Use on more than one (1) Computer except to the
extent the foregoing restriction is, by operation of applicable law, prohibited or of no effect; and
(vii) if this Product is an OEM Edition, Use or copy the Product if you received the Product as a stand-alone
product. The Use of the OEM Edition Product is subject to the restrictions set out in Section 5.
1.5 UNISYS TECHNOLOGY LIMITATION:
Corel products that provide PDF and/or TIFF-LZW and/or GIF and/or Postscript-LZW and/or LZW graphics
capability utilize technology covered by U.S. Patent No. 4,558,302, and all foreign counterparts ("Unisys
Patent"). The License granted to you hereunder permits you to use the Unisys Patent in conjunction with
your Use of this Product only. Use of any other product or the performance of any other activity involving the
compression/decompression technology covered by the Unisys Patent requires a separate license from
Unisys Corporation.
1.6 SPEECH RECOGNITION DISCLAIMER:
If this Product includes speech recognition software the following disclaimer is included as part of the
License:
IT IS UNDERSTOOD BY YOU THAT SPEECH RECOGNITION IS A STATISTICAL PROCESS, THAT
RECOGNITION ERRORS ARE INHERENT IN THE PROCESS OF SPEECH RECOGNITION, AND THAT SPEECH
RECOGNITION APPLICATIONS MUST BE DESIGNED TO ALLOW FOR SUCH ERRORS IN THE RECOGNITION
PROCESS. YOU UNDERSTAND THAT SUCH ERRORS ARE INEVITABLE AND THAT IT IS YOUR
RESPONSIBILITY TO CORRECT RECOGNITION ERRORS BEFORE USING THE RESULTS OF THE
RECOGNITION.
1.7 RESTRICTED RIGHTS RELATED TO DRAGON SOFTWARE:

this License, pursuant to FAR 12.212(a) and/or DFARS 227.7202-1(a), as applicable.
1.8 PRODUCT PATCH, PLUG OR UPDATE:
If this Product is a patch, plug, update or other file you are downloading or that is contained on storage
media (such as on CD-ROM), the Product is designed for use with a Corel application software product (the
"Original Application") and is subject to Corel's Limited Warranty, Disclaimer and Limitation of Liability (as set
out in Sections 1.11, 1.12 and 1.13) and Eligibility provisions (as set out in Section 1.16), as applicable. You
are granted a non-exclusive license to use such Product only with the Original Application provided that you
still possess a valid license from Corel for the Original Application. Except as provided in this Section, the
Product is subject to the terms and conditions of the license from Corel accompanying the Original
Application. IF YOU ARE DOWNLOADING THIS PRODUCT, ALL RISK OF DAMAGE TO THE PRODUCT
DURING TRANSMISSION AND DOWNLOAD IS ASSUMED BY YOU.
1.9 INTELLECTUAL PROPERTY RIGHTS:
Except as expressly licensed to you in this License, Corel retains all right, title and interest in and to the
Product and any copies you are authorized by Corel to make. The Product is protected by copyright,
including without limitation by Canadian copyright law, international treaty provisions and applicable laws in
the country in which it is being Used. Except as expressly stated herein, this License does not grant you any
intellectual property rights in the Product. All rights not expressly granted are reserved by Corel.
1.10 TERM:
This License shall remain in effect only for so long as you are in compliance with the terms and conditions of
this License. This License will terminate if you fail to comply with any of its terms or conditions. You agree,
upon termination, to destroy all copies of the Product. The Intellectual Property Rights, Limited Warranty,
Disclaimer and Limitation of Liability provisions set out in Sections 1.9, 1.11, 1.12, 1.13, 1.17, 1.18, 3.2, 6.3
and 7.3 shall continue in force even after any termination. If you have purchased this product as part of the
Student Campus Reward Option for Learning (SCROL) Program, you are bound by the conditions as stated in
Section 4.2 herein.
1.11 LIMITED WARRANTY:
Except as may be otherwise provided in this Agreement or unless the Product is a Trial Version as set forth
in Section 3 or a Pre-Release Version as set out in Section 7, Corel warrants to the person or entity that first
purchases a license to Use this Product that this Product will be free from defect in materials and
workmanship for ninety (90) days from the date you acquire it. If such a defect occurs, return the media to
Corel at, Corel Customer Service, 1600 Carling Avenue, Ottawa, Ontario, Canada, K1Z 8R7, and Corel will
replace it free of charge. THIS REMEDY IS YOUR EXCLUSIVE REMEDY AND COREL'S AND ITS SUPPLIERS'
AND DEALERS' ENTIRE LIABILITY FOR BREACH OF THIS WARRANTY OR, WHERE PERMITTED BY
APPLICABLE LAW, FOR ANY OTHER CAUSE OF ACTION (INCLUDING NEGLIGENCE) CONCERNING ANY
DEFECT IN MATERIALS OR WORKMANSHIP IN RELATION TO THE PRODUCT. THIS LIMITED WARRANTY

FITNESS FOR A PARTICULAR PURPOSE. COREL AND ITS SUPPLIERS AND DEALERS DO NOT AND CANNOT
WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN BY USING THE PRODUCT. THE ENTIRE RISK
AS TO THE RESULTS AND PERFORMANCE OF THE PRODUCT IS ASSUMED BY YOU. WHERE ANY NON-

BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, OR THEY ARE FORESEEABLE. COREL IS ALSO
NOT RESPONSIBLE FOR CLAIMS BY A THIRD PARTY. IN THE EVENT THAT THE ABOVE LIMITATION OF
LIABILITY IS NOT VALID IN YOUR JURISDICTION, COREL'S MAXIMUM AGGREGATE LIABILITY AND THAT
OF COREL'S DEALERS AND SUPPLIERS SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE

1.14 U.S. GOVERNMENT RIGHTS:
The Product under this License consists of "Commercial Computer Software" and "Commercial Computer
Software Documentation" as those terms are described in 48 C.F.R. 252.227-7014(a)(1). If acquired by or on
behalf of a civilian agency, the U.S. Government acquires this Commercial Computer Software and/or
Commercial Computer Software Documentation subject to the terms of this License as specified in 48 C.F.R.
12.212 (Computer Software) and 12.211 (Technical Data) of the Federal Acquisition Regulations ("FAR") and
its successors. If acquired by or on behalf of any agency within the Department of Defense ("DOD"), the U.S.
Government acquires this Commercial Computer Software and/or Commercial Computer Software
Documentation subject to the terms of this License as specified in 48 C.F.R. 227.7202 of the DOD FAR
Supplement ("DFAR") and its successors.
1.15 EXPORT CONTROLS:
If the Product is identified as a not-for-export product (for example, on the box, media or in the installation

GOVERNMENT REGULATIONS, INCLUDING WITHOUT LIMITATION, ANYONE WHO IS NOT A CITIZEN,
NATIONAL OR LAWFUL PERMANENT RESIDENT OF THE UNITED STATES. BY AGREEING TO THE TERMS OF
THIS LICENSE YOU ARE WARRANTING TO COREL THAT YOU ARE NOT A "FOREIGN PERSON" OR UNDER
THE CONTROL OF A "FOREIGN PERSON".
1.16 ELIGIBILITY:
To be eligible to Use or download the Product you must be in compliance with applicable export laws. You
may only download, install and/or Use the Product if: (i) you are not a citizen, national or resident of, and
are not under the control of, the government of: Cuba, Iran, Iraq, Libya, North Korea, Sudan, Syria, Serbia,
Taliban-controlled areas of Afghanistan, nor any other country to which the United States has prohibited
export; (ii) you will not download or otherwise export or re-export the Product, directly or indirectly, to the
countries mentioned in clause (i) nor to citizens, nationals or residents of those countries; (iii) you are not
listed in the United States Department of Treasury lists of Specially Designated Nationals, Specially
Designated Terrorists, and Specially Designated Narcotic Traffickers, nor are you listed on the United States
Department of Commerce Table of Denial Orders; (iv) you will not download or otherwise export or re-export
the Product, directly or indirectly, to persons on the lists mentioned in clause (iii); and (v) you will not use
the Product for, and will not allow the Product to be used for, any purposes prohibited by United States law,
including, without limitation, for the development, design, manufacture or production of nuclear, chemical or
biological weapons of mass destruction.
If you are not in compliance with the above statements, you are not eligible to Use or download the Product.
IF YOU ARE DOWNLOADING THIS PRODUCT, ALL RISK OF DAMAGE TO THE PRODUCT DURING
TRANSMISSION AND DOWNLOAD IS ASSUMED BY YOU.
1.17 EXCEPTIONS FOR USERS LOCATED IN GERMANY OR AUSTRIA:
1.17.1 Limited Warranty for Users Located in Germany or Austria.
If you obtained the Product in Germany or Austria and such country is your usual domicile, then Sections
1.11, 7.3 and other warranty provisions contained in this License are, to the extent inconsistent with this
Section, replaced or amended by the statutory provisions on the substance and remedy of defects of goods,
provided that: Corel may remedy substantial defects of the Product at its reasonable discretion by (i)
providing a patch, update or replacement product or (ii) asking for return of the Product and cancelling the
License. You are entitled to a reduction of the purchase price or a rescission of the License only if Corel has
repeatedly failed to remedy the defect after a reasonable period of time. If you are a consumer, your claims
under this clause are time-barred in 24 months or, if you are a business, in 12 months. If you alter the
Product in any way without being authorised by Corel, Corel will not remedy defects caused by such
alteration and you are liable for any damages incurred by Corel due to your unauthorised alteration. IF YOU
INSTALL PRE-RELEASE PRODUCTS MARKED AS SUCH, YOU DO SO AT YOUR OWN RISK, Pre-release
products are to be used only for test purposes in testing environments and must not be used for production
purposes. For further details, please see the Pre-Release Addendum below. To make a warranty claim you
must provide a detailed error description to Corel Customer Service or, at Corel's request, return the Product,
at Corel's expense, to Corel Corporation, 1600 Carling Avenue, Ottawa, Ontario, K1Z 8R7, Canada. For
further warranty information, please contact Corel Customer Service.
1.17.2 Limitation of Liability for Users Located in Germany or Austria.
If you obtained the Product in Germany or Austria and such country is your usual domicile, then Sections
1.13 and other liability provisions contained in this License are, as far as inconsistent with this Section,
replaced or amended as follows: Corel may be liable (i) without limitation for damages you have incurred
under or in connection with this License only if the damage has been caused by the wilful or grossly
negligent act of Corel or its agents; and (ii) for those typical damages that were reasonably foreseeable and
which have been caused by any other negligent breach of an essential contractual duty by Corel or its
agents. Any further liability of Corel or its agents is excluded. These aforementioned limitations apply
irrespective of their legal basis, in particular with regard to any pre-contractual or auxiliary contractual
claims. These limitations shall not apply, however, to any mandatory liability under the applicable German or
Austrian Product Liability Act, nor to any damage which is caused due to the breach of an express warranty
to the extent that such express warranty was intended to protect the user against the specific damage
incurred, nor to damages due to loss of life, injury or prejudice to health.
1.17.3 If you are a business in Germany or Austria, the courts of the Province of Ontario, Canada shall have
exclusive jurisdiction over any matter arising hereunder.
1.18 EXCEPTIONS FOR USERS LOCATED IN ENGLAND OR WALES:
1.18.1 Limited Warranty.
If you are acting as a consumer with your habitual residence in the United Kingdom, and you entered into
this License in the United Kingdom (a "Consumer"), then Sections 1.11, 7.3 and other warranty provisions
contained in this License, to the extent inconsistent with this Section, will be replaced or amended by
Sections 1.18.1 and 1.18.2.
Corel warrants to the person or entity who first purchases a license for the Product that the Product will be
free from defects in material and workmanship for a period of six (6) months following receipt or download
when used on the recommended hardware configuration and otherwise in accordance with the terms and
conditions of this License, provided that Corel shall not be liable for any (i) damage or loss which arises by
way of accident, misuse, unauthorised repair or modification of the Product or use of the Product for a
purpose other than that for which it was designed, by you or a third party; (ii) defect in the Product caused
by fair wear and tear, abnormal or unsuitable conditions or storage or use or an act, neglect or default by
you or a third party; or (iii) defect in the Product unless Corel is notified within six (6) months from the date
of delivery.
To make a warranty claim you must return the Product, at Corel's expense to Corel Corporation, 1600
Carling Avenue, Ottawa, Ontario, Canada within such six (6) month period. Corel will not be liable for any
warranty claims arising after the expiry of the warranty period. If Corel is liable under this warranty, Corel's
only obligation is to: (i) replace or repair the Product; (ii) reduce the purchase price of the Product; or (iii)
rescind the License and refund to you the amount paid by you for the Product
1.18.2 Consumers.
If you are dealing as a Consumer (pursuant to the Unfair Contract Terms Act 1977), Section 1.18.3 shall not
apply to you to the extent English law prohibits the exclusion of those matters. In respect of consumer
transactions only (as defined by the Consumer Transactions (Restrictions on Statements) Order 1976),
nothing in this License affects your statutory rights as a Consumer.
1.18.3 Disclaimer.
If you are a business in the United Kingdom or a Consumer, Sections 1.12, 7.3 and other disclaimer
provisions contained in this License, to the extent inconsistent with this Section, will be replaced or amended
by this Section 1.18.3. Except as expressly set out in this License (including Section 1.18.2), all conditions,
warranties and representations, express or implied by statute, common law or otherwise, in relation to the
Product are excluded. Corel will not be liable to you (in equity, contract or tort, under the Misrepresentation
Act 1967 or in any other way) for a representation that is not set out in this License and you agree that you
have not relied on or been induced by any statement or representation in entering into this License other
than as expressly set out in this License.
1.18.4 Limitation of Liability.
If you are a business in the United Kingdom or a Consumer, Sections 1.13, 7.3 and other liability provisions
contained in this License, to the extent inconsistent with this Section, will be replaced or amended by this
Section 1.18.4. Corel will not be liable to you or any third party for any loss, liability, cost, damage or injury,
direct or indirect, resulting from defects in design, materials or workmanship whether in contract, tort
(including without limitation negligence), misrepresentation or otherwise, save as provided under this Section
1.18 and save for liability: (i) for death or personal injury resulting from Corel's negligence; (ii) for breach of
the obligations arising from section 12 of the Sale of Goods Act 1979; (iii) arising under Part I of the
Consumer Protection Act 1987; and (iv) for fraud.
Corel will not be liable to you whether in contract, tort (including without limitation negligence),
misrepresentation or otherwise for: (i) any indirect or consequential losses or expenses suffered by you or
any third party, howsoever caused; (ii) loss or damage incurred by you as a result of third party claims; (iii)
loss of profits, goodwill, reputation, business receipts or contracts, or losses or expenses resulting from third
party claims.
Corel's aggregate liability to you, whether in contract, tort (including without limitation negligence),
misrepresentation or otherwise is limited in respect of each event or series of connected events to the cost
of the defective or damaged Product which gives rise to such liability.
1.19 GENERAL:
This License is the entire agreement between you and Corel, superseding any other agreement or
discussions, representations or advertising, oral or written, other than a separate, valid and existing license
agreement entered into between you and Corel or any of its subsidiaries (the "Other License") in which case
that Other License governs to the extent of any inconsistency between this License and that Other License.
This License may be modified only by a written document signed by an authorized officer of Corel. This
License shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada,
and the parties agree to submit to the exclusive jurisdiction of the courts of the Province of Ontario, Canada
where permitted by applicable law, unless there is an Other License, in which case the choice of law and
jurisdiction specified in that Other License shall prevail. This License specifically excludes (i) that body of law
applicable to choice of law, and (ii) the United Nations Convention on Contracts for the International Sale of
Goods and any legislation implementing such Convention, if otherwise applicable. If any provision of this
License is declared by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such a
provision shall be severed from the License and the other provisions shall remain in full force and effect.
Except as expressly set forth herein to the extent permitted by applicable law, this License shall not
prejudice the non-excludable, statutory rights of any party dealing as a consumer. You agree that this
Agreement and all documents contemplated hereby be drawn up in English. Vous consentez à ce que cette

1.20 COMPLIANCE WITH LICENSES:
If you are a business or organization, you agree that upon request from Corel or Corel's authorized
representative, you will within thirty (30) days fully document and certify that use of any and all Corel
product at the time of the request is in conformity with your valid licenses from Corel.
2. COREL GUIDELINES FOR THE USE OF CLIPART AND STOCK PHOTO IMAGES:
Corel products contain numerous clipart and photo images (collectively referred to as the "Images") which
are either owned by Corel or licensed from a third-party. As a user of Corel products you are free to use,
modify and publish the Images as you wish subject to the restrictions set out below. If you are uncertain as
to whether your intended use is in compliance with the Guidelines set out below, Corel recommends that you
seek the advice of your own attorney or legal counsel. Corel will not provide you with an opinion as to
whether your use is in compliance with these Guidelines.
2.1 YOU MAY, subject to any restrictions set out below:
(i) incorporate any Image(s) into your own original work and publish, display and distribute your work in any
media, provided you include a copyright notice in your work reflecting on the copyright ownership of both
you and Corel as follows:
"Copyright (c) 200__ [your name] and its licensors. All rights reserved."; and
(ii) make one (1) copy of the Image(s) for backup or archival purposes.
2.2 YOU MAY NOT:
(i) resell, sublicense or otherwise make available the Image(s) for use or distribution separately or detached
from a product or web page. For example, the Image(s) may be used as part of a web page design, but not
be made available for downloading separately or in a format designed or intended for permanent storage or
re-use by others;
(ii) provide the Image(s) to third parties or permit the use of the Image(s) by third parties separately or as
part of any other product, however, third parties may be provided with copies of the Image(s) (including
digital files) as part of a work product;
(iii) create scandalous, obscene, defamatory or immoral works using the Image(s) nor use the Image(s) for
any other purpose which is prohibited by law;
(iv) use or permit the use of the Image(s) or any part thereof as a trademark or service mark, or claim any
proprietary rights of any sort in the Image(s) or any part thereof;
(v) use any of the Images related to identifiable individuals or entities for any commercial purpose or in a
manner which suggests their association with or endorsement of any product or service;
(vi) use the Image(s) in electronic format, on-line or in multimedia applications unless the Image(s) are
incorporated for viewing purposes only and no permission is given to download and/or save the Image(s) for
any reason;
(vii) rent, lease, sublicense or lend the Image(s), or a copy thereof, to another person or legal entity. You
may, however, transfer all your license to use the Image(s) to another person or legal entity, provided that
(i) you transfer the Image(s) and this License, including all copies (except copies incorporated into your work
product as permitted under this License), to such person or entity, (ii) that you retain no copies, including
copies stored on a computer or other storage device, and (iii) the receiving party agrees to be bound by the
terms and conditions of this License; or
(viii) use any Image(s) except as expressly permitted by this License.
2.3 GOVERNMENT CRESTS, SEALS AND OTHER INSIGNIA:
The national and municipal insignia contained in this product are protected by various laws against misuse.
Generally speaking, all logos, insignia, patches, seals, flags and coats of arms are for official use only. It is
your responsibility to obey all national and international laws regulating display of the insignia, seals, flags
and coats of arms contained herein.
3. TRIAL VERSION ADDENDUM TO THE GENERAL LICENSE AGREEMENT:
3.1 IF THIS PRODUCT IS A TRIAL VERSION, YOUR USE OF THE TRIAL VERSION PRODUCT IS GOVERNED
BY THE TERMS OF THE GENERAL LICENSE AGREEMENT AS MODIFIED BY THE TERMS OF THIS TRIAL
VERSION ADDENDUM UNTIL SUCH TIME AS YOU PURCHASE A LICENSE TO THE FULL RETAIL VERSION OF
THE PRODUCT. In the event of any conflict between the terms of the General License Agreement and this
Trial Version Addendum, the terms of the Trial Version Addendum shall govern.
THE TRIAL VERSION OF THE PRODUCT WILL BECOME INOPERABLE AFTER A DESIGNATED PERIOD OF
TIME (e.g. 30, 45 OR 60 DAYS) OR AFTER A SPECIFIC NUMBER OF PRODUCT EXECUTIONS AS SPECIFIED
BY THE PRODUCT AFTER INSTALLATION. AFTER THIS DATE OR THIS NUMBER OF PRODUCT EXECUTIONS,
THE LICENSE HEREUNDER SHALL TERMINATE AND YOU WILL NOT BE ABLE TO ACCESS ANY FILES
CREATED WITH THIS TRIAL VERSION UNLESS YOU HAVE LICENCED A RETAIL VERSION OF THE PRODUCT.
THIS TRIAL VERSION ALLOWS YOU TO ACCESS A LIMITED NUMBER OF MAJOR MODULE(S) INCLUDED IN
THE RETAIL VERSION OF THE PRODUCT AND THESE ARE THE ONLY MODULE(S) YOU WILL BE ABLE TO
INSTALL. EXTRA VALUE COMPONENTS AND APPLICATIONS OF THE RETAIL VERSION OF THE PRODUCT
ARE NOT LICENSED TO YOU WITH THIS TRIAL VERSION. ALL REFERENCES TO OTHER APPLICATIONS,
EXTRA LIBRARIES OR OTHER CD-ROMS THAT MAY APPEAR IN THIS TRIAL VERSION OF THE PRODUCT ARE
NOT APPLICABLE. COREL IS LICENSING THIS TRIAL VERSION OF THE PRODUCT ON AN "AS IS" BASIS,
SOLELY AS A DEMONSTRATION MODEL AND IT SHOULD ONLY BE USED IN A DEDICATED TEST
ENVIRONMENT THAT DOES NOT HOLD ANY RISK OF LOSS OR DAMAGE TO PRODUCTION DATA.
You are granted a license to use the trial version of the Product only. Such license shall continue for the
period specified in the trial version of the Product, after which time your license to use the trial version shall
terminate.
Any attempt to circumvent any expiry date technology/time bomb mechanism or other mechanism contained
within the product which is intended to limit your ability to use the Product only as a trial version or to a
specified period is a violation of this License and shall result in the automatic and immediate termination of
your License to use the Product.
3.2 COREL DISCLAIMS ANY WARRANTY OR LIABILITY OBLIGATIONS TO YOU OF ANY KIND (INCLUDING
IN NEGLIGENCE), HOWEVER, WHERE LEGAL LIABILITY CANNOT BE EXCLUDED FOR TRIAL VERSION
SOFTWARE, BUT IT MAY BE LIMITED, COREL'S LIABILITY AND THAT OF ITS SUPPLIERS AND DEALERS
SHALL BE LIMITED TO, AT COREL'S OPTION, THE AMOUNT PAID BY YOU FOR THE PRODUCT, OR THE
REPAIR OR REPLACEMENT OF THE GOODS, THE RE-SUPPLY OF EQUIVALENT GOODS, OR THE COSTS
THEREOF.
4. ACADEMIC EDITION ADDENDUM TO THE GENERAL LICENSE AGREEMENT:
4.1 IF THIS PRODUCT IS IDENTIFIED AS AN ACADEMIC OR EDUCATION EDITION, YOUR USE OF THIS
PRODUCT IS GOVERNED BY THE TERMS OF THE GENERAL LICENSE AGREEMENT AS MODIFIED BY THE
TERMS OF THIS ACADEMIC EDITION ADDENDUM TO THE GENERAL LICENSE AGREEMENT. In the event of
any conflict between the terms of the General License Agreement and this Academic Edition Addendum, the
terms of this Academic Addendum to the General License Agreement shall govern. You are not entitled to
Use the Product unless you qualify in your jurisdiction as an Academic End User. Please contact Corel
Customer Service to find out whether you qualify.
NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THE GENERAL LICENSE AGREEMENT, YOU MAY
NOT TRANSFER OR ASSIGN THE PRODUCT OR ANY COPY THEREOF, OR YOUR LICENSE TO USE THE
PRODUCT TO A THIRD PARTY.
4.2 If you have purchased this Product as part of the Student Campus Reward Option for Learning (SCROL)
Program, Section 1.10 of the License shall be deleted and replaced with the following:
1.10 TERM: This License shall remain in effect only for so long as you are a registered full-time student or a
faculty member at an accredited higher education institution, after which time this License shall terminate.
For the purposes of this License, "accredited higher education institution" shall mean either a publicly or
privately owned vocational or correspondence school; junior college; college; university or scientific or
technical institute recognized by the appropriate ministry or department of education. In addition this License
will terminate if you fail to comply with any of its terms or conditions. You agree, upon termination, to
destroy all copies of the Product. The Intellectual Property Rights, Limited Warranty, Disclaimer and
Limitation of Liability provisions set out in Sections 1.9, 1.11, 1.12, 1.13, 1.17, 1.18, 3.2, 6.3 and 7.3 shall
continue in force even after any termination.
5. OEM EDITION ADDENDUM TO THE GENERAL LICENSE AGREEMENT:
OEM PRODUCT IS SOLD UNDER LICENSE IN CONJUNCTION WITH COREL APPROVED PARTNER PRODUCTS
OR SERVICES WHICH ARE DESCRIBED IN THE WARNING LOCATED ON THE STORAGE MEDIA AND YOU
ARE NOT ENTITLED TO USE THIS PRODUCT UNLESS IT WAS PURCHASED IN ACCORDANCE THEREWITH.
YOU ARE NOT ENTITLED TO USE THIS PRODUCT IF YOU RECEIVED IT AS A STAND-ALONE PRODUCT. IF
THIS PRODUCT IS IDENTIFIED AS AN OEM EDITION, YOUR USE OF THIS PRODUCT IS GOVERNED BY THE
TERMS OF THE GENERAL LICENSE AGREEMENT AS MODIFIED BY THE TERMS OF THIS OEM EDITION
ADDENDUM TO THE GENERAL LICENSE AGREEMENT. In the event of any conflict between the terms of the
General License Agreement and this OEM Edition Addendum, the terms of this OEM Addendum to the
General License Agreement shall govern.
NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THE GENERAL LICENSE AGREEMENT, YOU MAY
NOT TRANSFER OR ASSIGN THE PRODUCT OR ANY COPY THEREOF, OR YOUR LICENSE TO USE THE
PRODUCT TO A THIRD PARTY.
6. SDK ADDENDUM TO THE GENERAL LICENSE AGREEMENT:
IF THIS PRODUCT CONTAINS A COREL SOFTWARE DEVELOPER'S TOOLKIT ("SDK"), YOUR USE OF THE SDK
PORTION OF THE PRODUCT IS GOVERNED BY THE TERMS OF THE GENERAL LICENSE AGREEMENT AS
MODIFIED BY THE TERMS OF THIS SDK ADDENDUM TO THE GENERAL LICENSE AGREEMENT. In the event
of any conflict between the terms of the General License Agreement and this SDK Addendum, the terms of
this SDK Addendum to the General License Agreement shall govern.
It is Corel's intention in designing the SDK to make it compatible with other versions of the SDK. However,
since it is constantly being modified and reorganized, with certain capabilities added to or eliminated from
any particular version or product, Corel makes no representations or warranties concerning compatibility with
other versions or products.
You are solely responsible for determining the usefulness of the SDK for your particular purpose. The SDK is
provided to software developers with the expectation that the developers are capable of writing and
debugging their own programs; Corel does not assume any support obligations with respect to the SDK or
the use thereof. Any research, development, or evaluations you perform is done entirely at your own risk.
6.1 YOU MAY:
(i) use the SDK solely for the purpose of developing, manufacturing, marketing and supporting one or more
applications software package(s) ("Software Application Product"); and
(ii) reproduce and sublicense the software program files included in the SDK's 'Redistributables' folder ("SDK
files"), provided the files are in executable format and incorporated into a Software Application Product
developed by you. Any sublicense of the SDK files shall be granted solely for the use of these SDK files in
connection with and as a sublicensed part of a Software Application Product for any support, service,
upgrades or other assistance.
6.2 YOU MAY NOT:
(i) remove or alter any copyright notice, trademark, or other proprietary rights notice placed by Corel on the
SDK or any portion thereof.
6.3 INDEMNIFICATION:
You agree to indemnify and hold Corel harmless from and against any and all costs, liabilities, claims, or
demands (including reasonable attorney's fees and expenses of any kind whatsoever) that arise or result
from the use, reproduction or distribution of your Software Application Product, documentation, or
promotional or sales materials.
6.4 COREL TRADEMARKS AND TRADENAMES:
You may not refer to Corel or include any Corel trademarks in or on any material except for the sole purpose
of stating that a Software Application Product may be utilized in connection with the specific Corel software
product. In the event you refer to Corel or include the trademarks in or on any program materials or any
packaging, marketing, or advertising materials, the trade name or trademarks must be accompanied with the
following footnote disclaimer printed in a clearly legible manner on the same page in no smaller than tenpoint type:
"This product is not manufactured, approved, or supported by Corel Corporation."
7. PRE-RELEASE VERSION ADDENDUM TO THE GENERAL LICENSE AGREEMENT:
IF THIS PRODUCT IS IDENTIFIED AS A PRE-RELEASE OR BETA VERSION ("PRE-RELEASE VERSION"), YOUR
USE OF THIS PRODUCT IS GOVERNED BY THE TERMS OF THE GENERAL LICENSE AGREEMENT AS
MODIFIED BY THE TERMS OF THIS PRE-RELEASE VERSION ADDENDUM TO THE GENERAL LICENSE
AGREEMENT. In the event of any conflict between the terms of the General License Agreement and this Prerelease Version Addendum, the terms of this Pre-Release Version Addendum to the General License
Agreement shall govern. In the event that you are an authorized Corel Pre-release or Beta Test Site and
have been authorized to test a Pre-release Version product that has not been made publicly available by
Corel, your Use of the Pre-release Version product shall be governed by the terms of the Pre-release or Beta
Test Site License Agreement entered into between Corel and yourself and the provisions set out below shall
not apply to the extent of any conflict or inconsistency with the terms of the Pre-release or Beta Test Site
License Agreement.
7.1 LICENSE GRANT: Corel grants to you a non-exclusive license to use the Product for evaluation and trial
purposes only for a limited time. This license does not entitle you to hard-copy documentation, support or
telephone assistance. While Corel intends to distribute a commercial release of the Product, Corel reserves
the right at any time not to release a commercial release of the Product or, if released, to alter prices,
features, licensing terms, or other characteristics of the commercial release.
7.2 TERMINATION: The license granted under this Pre-release Version Addendum will terminate thirty (30)
days following Corel's release of a commercial release of the Product. The license will terminate
automatically if you fail to comply with the limitations described herein. You must destroy all copies of the
Product upon termination.
7.3 DISCLAIMER OF WARRANTIES: YOU ACKNOWLEDGE THAT THE PRODUCT IS A PRE-RELEASE

8. IGRAFX(r) PROCESS CENTRAL(tm) 2003, STARTER EDITION, ADDENDUM TO THE GENERAL LICENSE
AGREEMENT:
If the product is the iGrafx Process Central 2003, Starter Edition, notwithstanding anything to the contrary in
the General License Agreement, the following applies:
8.1 You may create iGrafx Process Central 2003, Starter Edition, repositories on a single Server. If the
Server has more than one processor, you must obtain a separate license for each processor on that Server.
8.2 You may install the Client, Server Administrator, and Web Central components of iGrafx Process Central
2003, Starter Edition, on any internal device. In addition, iGrafx Process 2003 Viewer Software may be
installed on any internal device.
8.3 Five concurrent users may access the iGrafx Process Central 2003, Starter Edition, repositories so long
as you have acquired a valid license for each processor on the Server where the iGrafx Process Central 2003,
Starter Edition, repositories reside. The five user limit is automatically enforced by the iGrafx Process Central
2003, Starter Edition.
Please contact a Corel sales representative if you wish to upgrade your license to iGrafx Process Central
2003, Standard Edition, which allows an unlimited number of concurrent users.
9. IGRAFX(r) PROCESS CENTRAL(tm) 2003, STANDARD EDITION, ADDENDUM TO THE GENERAL LICENSE
AGREEMENT:
If the product is iGrafx Process Central 2003, Standard Edition, notwithstanding anything to the contrary in
the General License Agreement, the following applies:
9.1 You may create iGrafx Process Central 2003, standard Edition, repositories on a single Server. If the
Server has more than one processor, you must obtain a separate license for each processor on that Server.
9.2 You may install the Client, Server Administrator, and Web Central components of iGrafx Process Central
2003, Standard Edition, on any internal device. In addition, iGrafx Process 2003 Viewer Software may be
