Kriminalpolitik wird verstanden als ein PolicyProgramm, das die Strategien, Taktiken und Sanktionsinstrumente beschreibt, mit denen die Institutionen eine Optimierung der Verbrechenskontrolle zu erreichen versuchen. 2. Die bislang national und staatlich ausgerichteten Kriminalpolitiken „entgrenzen“ sich: sichtbar vor allem in der zunehmenden Europäisierung der Inneren Sicherheit und der steigenden Einbeziehung kommerzieller Akteure in die Produktion öffentlicher Sicherheit. Internationale Projektarbeit Rechtsstaatlichkeit ist eine Dimension der politischen Kultur und Rechtskultur, keine bloße technisch- administrative Organisationsform Kein ‚Produkt‘ von Geber und Empfänger, sondern ein Kommunikationsprozess zwischen Partnern mit unterschiedlichem Rechtsverständnis Internationale Projektarbeit Rechtskultur- Legal Culture Recht ist immer Teil, „Sphäre“ einer Kultur. Es ist ein Produkt des Umgangs einer Kultur mit normativen Fragen. Recht bildet und entwickelt sich im Kontext einer Normkultur, die in einem Wechselverhältnis mit anderen „Sphären“ dieser Kultur: Moral, Politik, Religion, Geschichte etc. seht Eine Rechtskultur verweist auf die allgemeine politische Kultur einer Gesellschaft und bietet ihrerseits den normativen Rahmen für die Entwicklung der „Kultur eines politischen Gemeinwesens“ Internationale Projektarbeit Rechtskultur- Legal Culture Der Grundgedanke von Hegels Rechtsphilosophie ist, dass sich Rechtsbegriffe und Institutionen nicht aus einer (vermeintlich) zeitlosen Vernunft ableiten lassen, sondern sich über die Jahrtausende menschlicher Gesellschaftspraxis entwickelt haben. Die Völker haben die Institutionen, Verfahren und Regeln im Laufe ihrer Geschichte „gefunden“. Interkulturelles Lernen ist unverzichtbar. Das Rechtssystem muss in der Tiefenstruktur ergründet werden. Recherchen über NGOs, Human Rights Organisationen, Blogs Internationale Projektarbeit Rechtspolitik und Kriminalpolitik Fixierung auf Rechtsanwendung aufheben: Grundsatzfragen lösen mit Interdisziplinärer Rechtsgestaltung statt Falllösungen Recht muss mehr Leitplanke und Katalysator werden und weniger Hindernis der „Bedenkenträger“ für Innovation und Rechtspolitik Eigene Rechtsvorstellungen auf europäischer und internationaler Ebene formulieren und in interkulturelle Diskurse einbringen Internationale Projektarbeit Governance: Verklammerung außerrechtlicher und rechtlicher Regelwerke; Instrument der Regelsetzung mit Perspektivwechsel: statt ex post anhand vorgegebener Regeln zu entscheiden, wird ex ante nach der verhaltenssteuernden Wirkung von Regeln gefragt und deren effektive Ausgestaltung angestrebt. Staaten, die der EU beitreten wollen, müssen den "Acquis Communautaire" in komplettem Umfang übernehmen – eine große Herausforderung, bei der ihnen TAIEX hilft: TAIEX (Technical Assistance Information Exchange) ist ein Programm der EK, das ausgewählte Staaten gezielt bei der Übernahme und Umsetzung des AC unterstützt. Verfahren bei EU- Projekten: 'shortlisted'? 1. Die EU-Kommission erstellt selbst sog. "Terms of Reference (ToR)„ für ein "großes" EU-Projekt oder lässt diese ToR wiederum extern (sprich von EU-Experten) erstellen. 2. Von der Existenz solcher "Terms of Reference" erfahren Konsortien (die aus consulting-Firmen bestehen) und reichen bei Interesse "Expressions of Interest" (EoI) bei der EUKommission ein, mit denen sie zum Ausdruck bringen, dass sie am Ausschreibungsverfahren teilnehmen wollen. 3. Die EU-Kommission erstellt eine sog. "Short-List" mit bis zu acht Konsortien, sprich hier fliegen schon einige Konsortien raus. 4. Dann werden diese "Short-Listed Consortia" eingeladen ein Angebot abzugeben, sprich ein technical and financial proposal einzureichen in dem sie darstellen wie sie das Projekt durchführen wollen. Die Konsortien erhalten mit der Einladung, ein technical and financial proposal einzureichen. 5. Die Konsortien reichen ein technical and financial proposal (Technical offer and a Financial offer) ein. Ein financial proposal wird immer streng geheim gehalten. 6. Die EU-Kommission wählt dann das beste technical and financial proposal aus und vergibt das Projekt an ein Konsortium. 7. Dann wird das EU-Projekt durchgeführt. Die "Terms of Reference (ToR)" und das technical and financial proposal sind bei der Durchführung die absoluten Vorgaben. It is headquartered in Strasbourg, France. By using prison as an answer to all offences committed the bad cycle of loss of jobs, weakening of employment chances, damage to relationships, worsening of psychological and mental illnesses and continued or increased drug use is perpetuated. There are also many health risks associated with overcrowded prisons, including the spread of infectious disease, such as tuberculosis and HIV. Violence is a common element of prison life Short-term inmates learn to become criminals easily Support to Penitentiary Reform in Jordan Europe Aid/131-461/M/ACT/JO The European Way: operating on a restorative “welfare” policy (humanistic tradition) • To prevent offending and re-offending (recidivism) • Imprisonment as a last resort (“ultima ratio”) • Individual re-integration/re-sozialisation principle and addressing needs/ interests of victims • Counterpart to the US- American penal culture (i.e. war on crime; Zero- Tolerance; Three-Strikes-and- youare-out; Just desert; Death penalty, etc.) United States has the highest prison population rate in the world, 743 per 100,000 of the national population. Over 10.1 million people in the world are incarcerated, with 23% held in the Unites States (2.2 Mio). • Requirement No 1 for 47 Member States of the Council of Europe: no Death penalty. Intermediate: intensive supervision, probation, special probation Must include one or more special conditions: boot camp, a split sentence (jail followed by supervision), house arrest with electronic monitoring, a residential center and day reporting center 3. Community: thought of as basic probation supervised or unsupervised May also include community service, fines and restitution >> Sentence breakdown: community 22%, intermediate 43%, active 35% (prison) >> Type of sentence determined by structured sentencing grid Two factors considered: severity of offense and prior criminal history Support to Penitentiary Reform in Jordan Europe Aid/131-461/M/ACT/JO European Prison Rules Pre-release measures Prison to be used as a last resort for the most dangerous, persistent offenders Preparation for release to start at the first day of prison for all types of prisoners Life in prison to reflect as much as possible life in free society (“normalization”) Rehabilitation, re-socialization, developing of regime activities Reducing the length of imprisonment Support to Penitentiary Reform in Jordan Europe Aid/131-461/M/ACT/JO Re-integration of prisoners into society Principle 6 EPR: “All detention shall be managed so as to facilitate the reintegration into free society of persons who have been deprived of their liberty”. Putting this principle into practice requires a range of measures, such as developing training of prison staff, elaborating on education and vocational training programmes for detained juveniles and women, and adopting a more differentiated approach to contacts. We need a good classification and risk assessment. Support to Penitentiary Reform in Jordan Europe Aid/131-461/M/ACT/JO ternative Sentencing Community sanctions and measures Provision should be made for a sufficient number of suitably varied community sanctions and measures of which the following are examples: • alternatives to pre-trial detention such as requiring a suspected offender to reside at a specified address, to be supervised and assisted by an agency specified by a judicial authority; • probation as an independent sanction imposed without pronouncement of a sentence to imprisonment; • conditional release: suspension of the enforcement of a sentence to imprisonment with imposed conditions; Dramatisierung des Bösen Da sich Identitäten um so leichter vermitteln und stabilisieren lassen, je eindeutiger und drastischer das abschreckende Gegenbild ausfällt, besitzt der Diskurs über Kriminalität eine Tendenz zur (Über)Dramatisierung des Bösen und zur (Über)Pointierung seiner Merkmale. Dämonisierung Verwendung sprachlicher Typisierungen, die kriminelle Abweichungen dämonisieren und eine lebenslange Neigung zu krimineller Betätigung suggerieren. Abweichendes Verhalten wird nicht einzeln als Normbruch verstanden, sondern als Indikator für die Kluft zwischen den Moralvorstellungen der “schweigenden Mehrheit” und der sozialen Wirklichkeit.
