EEX introduces Data Reporting Service according to Art. 8 of REMIT
Dear Trading Participants,
In the context of Article 8 of the EU Regulation No. 1227/2011 on Wholesale Energy Market Integrity and Transparency (REMIT), a data reporting requirement for all transactions concluded
on the European Energy Exchange (EEX) will take effect on 7 October 2015. The data reporting obligation is specified in more detail in the Implementing Regulation No. 1348/2014 (REMIT IR).
Therefore, EEX offers a new service for data reporting to all trading participants. Below, you
will find information on the arrangements you should make in advance to the reporting start
date as well as more details about the EEX Data Reporting Service.
Registration of the Market Participants
Trading participants that conclude transactions on an Organised Market Place (OMP) are
obliged to register as market participants before the start of the data reporting obligation on
7 October 2015. Since EEX has already been recognised as an OMP by the Agency for the
Cooperation of Energy Regulators (ACER), all EEX trading participants need to register.
Pursuant to Article 9 of REMIT, the registration is mandatory for all market participants. Market
participants are all members that conclude transactions which are reportable according to Article 8 Paragraph 1 REMIT IR.
Registration shall be made with the National Regulatory Authority (NRA) of the member state
within which the market participant is established or resident. If a market participant is not
based in the European Union, registration shall be made with the NRA of a member state within which it operates. A list of the NRAs is available on the ACER website:

ACER has specified the data to be provided for the registration as well as the format. More detailed information on the registration process has been published by the NRAs, such as the
German Federal Network Agency and Energie-Control Austria, following the launch of their
registration portals.

Publication of Insider Information via the Transparency Platform
During their registration with the NRAs, market participants are e.g. asked where their insider
information is published. This is also the case for market participants without technical production, storage or consumption facilities for electricity or natural gas.
EEX already offers the publication of insider information for both the electricity and the natural
gas market via its transparency platform (www.eex-transparency.com). The transparency platform has been registered with ACER.
According to Article 4 of REMIT, trading participants are obliged to publish their insider information effectively and in due time. Since the highest possible level of publicity is reached with
a central platform like the transparency platform, ACER expressly supports its use.

New Service for REMIT Data Reporting
EEX will offer its trading participants a new service with regard to transaction reporting under
REMIT. This service enables all trading participants to delegate the transmission of transaction
data according to Article 8 of REMIT to EEX. This includes all transactions concluded on EEX
as well as all orders. The service will be available as of the introduction of the reporting requirement on 7 October 2015.
The conclusion of a data reporting agreement with EEX is a precondition for the use of the service; this agreement is currently being prepared. EEX has already submitted the application to
ACER to receive the status of a Registered Reporting Mechanism (RRM), which is required for
transaction reporting. Furthermore, the list of the standard contracts which can be traded on
EEX is available via the ACER REMIT portal.

EEX führt Datenmeldeservice nach REMIT, Artikel 8, ein
Sehr geehrte Handelsteilnehmer,
im Zuge der EU-Verordnung Nr. 1227/2011 über die Integrität und Transparenz des Energiegroßhandelsmarktes (REMIT), Artikel 8, gilt ab dem 7. Oktober 2015 für alle an der European Energy Exchange (EEX) getätigten Transaktionen eine Datenmeldepflicht. Die Verpflichtung zur Datenmeldung wurde durch die Durchführungsverordnung (EU) Nr. 1348/2014 (REMIT-DVO) konkretisiert.
In diesem Zusammenhang wird die EEX ihren Teilnehmern einen neuen Service zur Meldung
der Daten anbieten. Nachfolgend finden Sie Informationen zu den Maßnahmen, die Sie als
Vorbereitung auf die Datenmeldungen treffen sollten sowie zum REMIT-Datenmeldeservice
der EEX.
Registrierung der Marktteilnehmer
Handelsteilnehmer, die Transaktionen an einem Organised Market Place (OMP) abschließen,
sind dazu verpflichtet, bis zum Start der Datenmeldungen am 7. Oktober 2015 ihre Registrierung als Marktteilnehmer vorzunehmen. Da die EEX bereits als OMP durch die Agentur für die
Zusammenarbeit der Energieregulierungsbehörden (ACER) anerkannt ist, gilt die Registrierungspflicht für sämtliche Handelsteilnehmer der EEX.
Gemäß REMIT, Artikel 9, ist die Registrierung für alle Marktteilnehmer verbindlich. Marktteilnehmer ist, wer Transaktionen abschließt, die nach Artikel 8 Absatz 1 der REMIT-DVO meldepflichtig sind.
Die Registrierung hat bei der nationalen Regulierungsbehörde des Mitgliedstaates zu erfolgen,
in dem der Marktteilnehmer seinen Sitz hat. Falls ein Marktteilnehmer nicht in der Europäischen Union ansässig ist, ist die Registrierung bei der nationalen Regulierungsbehörde eines
Mitgliedstaates, in dem er tätig ist, vorzunehmen. Eine Liste der nationalen Regulierungsbehörden

ACER hat die bei der Registrierung anzugebenden Daten sowie deren Format festgelegt. Nähere Informationen zum Registrierungsprozess haben die nationalen Regulierungsbehörden
wie unter anderem die Bundesnetzagentur und Energie-Control Austria zum Start ihrer Registrierungsportale veröffentlicht.
Veröffentlichung von Insider-Informationen über die Transparenzplattform
Im Rahmen der Registrierung bei den nationalen Regulierungsbehörden wird von den Marktteilnehmern unter anderem abgefragt, an welcher Stelle ihre Insider-Informationen veröffentlicht werden. Dies gilt auch für Marktteilnehmer, die keine technischen Produktions-, Speicheroder Verbrauchsanlagen für Strom oder Erdgas betreiben.
Schon heute bietet die EEX über ihre Transparenzplattform www.eex-transparency.com eine
solche Veröffentlichung von Insider-Informationen sowohl für den Strom- als auch für den Erdgasmarkt an. Die Transparenzplattform ist bereits bei ACER registriert.
Laut REMIT, Artikel 4, sind die Marktteilnehmer dazu verpflichtet, ihnen vorliegende InsiderInformationen effektiv und rechtzeitig bekannt zu geben. Da durch zentrale Plattformen wie der
Transparenzplattform eine größtmögliche Öffentlichkeit erreicht wird, unterstützt die ACER
ausdrücklich deren Verwendung.

Neuer Service für die REMIT-Datenmeldung
Die EEX wird ihren Handelsteilnehmern einen neuen Service für die Durchführung des Transaktionsreportings nach REMIT anbieten. Dieser Service ermöglicht allen Handelsteilnehmern
die Delegation ihrer Verpflichtung für die Übermittlung von Transaktionsdaten nach REMIT, Artikel 8, an die EEX. Dies betrifft alle Handelsgeschäfte, die an der EEX geschlossen werden,
sowie sämtliche Orders. Der Service wird ab dem Start der Meldepflicht am 7. Oktober 2015
verfügbar sein.
Bedingung für die Nutzung des Services ist der Abschluss einer Datenmeldevereinbarung mit
der EEX; diese Vereinbarung wird derzeit erstellt. Den für das Transaktionsreporting notwendigen Status als Registered Reporting Mechanism (RRM) hat die EEX bereits bei ACER beantragt. Des Weiteren ist die Liste der an der EEX handelbaren Standardverträge über das REMIT-Portal der ACER abrufbar.
