ANEXO 1 - SERVIÇO DE ASSISTÊNCIA AO VEÍCULO.. ANEXO 2 – TERMOS E CONDIÇÕES DOS SEGUROS E PROTEÇÕES Obrigada por alugar com a InterRent! InterRent é uma marca do Grupo Europcar que opera em Portugal através da EUROPCAR INTERNACIONAL – Aluguer de Automóveis, SA, sociedade anónima, com o capital social EUR 2.244.600,00 e sede na Rua Carlos Alberto Mota Pinto, nº 17-2º, 1099-095, em Lisboa, com número de identificação de pessoa coletiva 500.074.135, matriculada na Conservatória do Registo Comercial de Lisboa sob o mesmo número de pessoa coletiva (adiante apenas “InterRent”). De acordo com os presentes Termos e Condições Gerais de Aluguer (‘T&C’), a InterRent está obrigada a cumprir os seguintes deveres: ● ● Alugar um “Veículo” (definido na cláusula 4ª) a Si (a pessoa indicada no Contrato de Aluguer – tal como definido em 1), pelo período de tempo (que não excede 30 dias), especificado no Contrato de Aluguer (o “Período de Aluguer”), acrescido de quaisquer acessórios que pretenda alugar, os quais devem estar também especificados no Contrato de Aluguer. Prestar certos serviços de mobilidade integrados em todos os nossos alugueres e oferecer-Lhe outros serviços que estão disponíveis a um custo extra. A relação contratual estabelecida entre Si e a InterRent é regulada pelos seguintes documentos: ● ● ● ● O “Contrato de Aluguer” e as suas cláusulas específicas (o documento assinado por Si no momento do levantamento do Veículo (check-out) ou no primeiro dia do aluguer); O email de confirmação da reserva (caso tenha reservado previamente on line o Seu aluguer); O Tarifário Recomendado de Custos; As presentes T&C que se aplicam a quaisquer dos referidos documentos. Em caso de contradição entre quaisquer dos documentos referidos acima, prevalecem os termos do primeiro documento referido. 1) A QUEM SE APLICAM OS TERMOS E CONDIÇÕES DE ALUGUER? Os T&C aplicam-se a Si, a pessoa que paga o aluguer e quaisquer custos associados (e Você pode ser também o condutor), bem como a qualquer (outro) condutor que esteja expressamente indicado no Contrato de Aluguer e, como tal, esteja autorizado a conduzir o Veículo. Todas as pessoas indicadas no Contrato de Aluguer são solidariamente responsáveis pelo pagamento de quaisquer quantias devidas no âmbito do mesmo. 2) QUEM PODE ALUGAR E QUEM PODE CONDUZIR? a) Quem pode alugar? Qualquer pessoa que: ● seja legalmente capaz de assinar um contrato com a InterRent e esteja preparada para assumir a responsabilidade pelo Veículo durante o Período de Aluguer. ● ● tenha os meios aceites pela InterRent local (conforme tabela abaixo) para pagar o aluguer do Veículo e quaisquer custos associados; seja portador de documentos de identificação válidos, conforme indicados na tabela abaixo. b) Quem pode conduzir? (o “Condutor") Um Condutor autorizado do Veículo é qualquer pessoa física que cumpra todos os seguintes requisitos: ● ● ● esteja expressa e completamente identificado no Contrato de Aluguer ou em qualquer documento anexo ao mesmo (que também pode ser quem paga o Contrato de Aluguer); seja portador de carta de condução e de documentos de identificação válidos (identificação nacional ou passaporte); seja portador de carta de condução válida por um período de tempo que varia de acordo com a categoria do Veículo e com a lei aplicável no país do aluguer e, ou com a idade do Condutor: c) Quem não pode conduzir? Qualquer pessoa que não esteja expressamente mencionada/identificada no Contrato de Aluguer não está autorizada a conduzir o Veículo. Da mesma forma, qualquer pessoa que não seja portadora dos documentos de identificação válidos mencionados nas secções 2a) e 2b). Se Você permitir que uma pessoa não autorizada conduza o Veículo, estará a violar os T&Cs e Será responsável por quaisquer consequências que daí resultem, incluindo a possibilidade de responder perante a InterRent pelos danos causados por Si ou pela pessoa não autorizada. Nessas circunstâncias, nem Você nem o condutor não autorizado estarão cobertos por qualquer seguro ou produto de proteção oferecido através da InterRent, salvo o seguro obrigatório de responsabilidade civil. 3) ONDE POSSO CONDUZIR O VEÍCULO? Só pode conduzir o Veículo em Portugal Continental (o “Território”). Se Você e/ou qualquer Condutor pretender conduzir, a seu próprio risco, para Espanha, excluindo Ilhas, Ceuta e os enclaves Melilla, deve: Obter o consentimento prévio escrito da InterRent e subscrever a proteção além fronteiras, que tem um custo associado (“suplemento de autorização de saída do País”), conforme Tarifário Recomendado de Custos e, Avisar o representante da InterRent e assegurarem juntos, antes de levantar o Veículo, que este tem o equipamento adequado, de acordo com as regras locais do País que Você e/ou qualquer Condutor irão dirigir-se ou atravessar. Note que Tem de cumprir as regras de trânsito e demais regulação rodoviária do país onde esteja a conduzir o Veículo. 4) QUE TIPO DE VEÍCULO PODE SER ALUGADO E PARA QUE FINALIDADE? Pode alugar um automóvel de passageiros e deve conduzi-lo de acordo com a sua finalidade própria: transportar um número de pessoas variável (dependendo do que estiver aprovado no Documento Único Automóvel). Fica desde já informado que a InterRent não cobre as mercadorias transportadas nos Veículos e não pode ser responsabilizada por quaisquer bens ou objetos que Você possa ter esquecido dentro do Veículo. Da mesma forma, a InterRent não é responsável por quaisquer lucros cessantes ou prejuízos de exploração ocorridos na vigência do aluguer. 5) QUAIS SÃO AS MINHAS OBRIGAÇÕES PARA COM O VEÍCULO? Quando aluga um Veículo na InterRent, Você e/ou qualquer Condutor devem cumprir as seguintes obrigações: ● ● ● ● ● ● ● Deve devolver o Veículo e as respetivas chaves, acessórios e documentos à InterRent na estação de devolução indicada no Contrato de Aluguer, na hora e na data do termo do aluguer indicadas no Contrato de Aluguer (a InterRent permite 29 minutos de período de tolerância) e no estado em que a InterRent o entregou a Si no início do Período de Aluguer. Se Você não devolver o Veículo nos termos referidos, a InterRent poderá tomar as medidas previstas na cláusula 11 das presentes T&C (“Que procedimentos adotar quando devolver o Veículo”). Você e/ou qualquer Condutor devem conduzir, em condições de razoabilidade, de acordo com o Código da Estrada, as leis e as regulamentações de trânsito aplicáveis e devem assegurar-se que estão familiarizados com as regras de trânsito e de condução locais. Deve assegurar que qualquer bagagem ou bens transportados no Veículo estão seguros na medida em que não causem danos ao Veículo ou risco a qualquer ocupante do mesmo. Você e/ou qualquer Condutor devem cuidar do Veículo com a diligência de um bom pai de família e, em qualquer caso, assegurarem-se que o mesmo está trancado e protegido com os dispositivos anti-roubo quando estiver estacionado ou sem vigilância. Você e/ou qualquer Condutor nunca devem conduzir enquanto estiverem sob a influência de álcool, drogas alucinogénias, narcóticos, barbitúricos, outras drogas ilegais ou qualquer substância (legal ou ilegal) suscetível de afetar ou prejudicar a Sua capacidade de condução e /ou a de qualquer Condutor. Você e/ou qualquer Condutor devem reabastecer o Veículo com o tipo de combustível apropriado. Se o Veículo for abastecido com o combustível errado, Você será responsável por quaisquer custos incorridos com a deslocação do Veículo e/ou com a reparação dos Danos ao mesmo causados, calculados de acordo com as regras descritas abaixo (ver cláusula 12), salvo se demonstrar que o erro foi imputável a terceiro. Você e/ou qualquer Condutor não podem utilizar o Veículo nem permitir que seja utilizado para: subaluguer, hipoteca, penhor, venda ou qualquer espécie de garantia, quer em relação ao Veículo como um todo quer a qualquer das suas componentes, bem como ao Contrato de Aluguer, às chaves, aos documentos, às ferramentas, ou qualquer dos seus acessórios; transportar passageiros por conta de outrem ou contra pagamento, salvo se expressamente autorizado pela InterRent (para fins de “car sharing” por exemplo); transportar ocupantes em excesso, para além dos autorizados pelo Documento Único Automóvel; transportar mercadoria com peso, em quantidade e/ou volume que exceda o autorizado pela lei e pelo Documento Único Automóvel; transportar mercadoria inflamável, ou perigosa, tóxica, produtos nocivos e/ou radioativos ou que sejam ilegais, (desde que tal exclusão não o impeça de satisfazer as Suas necessidades diárias lícitas e cujo transporte corresponda ao uso normal do Veículo); provas desportivas, fora de estrada, ensaios de confiança, testes de velocidade, para fazer parte ❍ ❍ ❍ ❍ ❍ ❍ ❍ ❍ ❍ ❍ ❍ ❍ ❍ ● em rallies, concursos, ou ensaios, independentemente do local, oficiais ou não; transportar animais vivos (exceto animais domésticos ou de estimação, com autorização escrita expressa da InterRent); dar aulas de condução ou “condução acompanhada”, empurrar ou puxar outro veículo ou reboque (exceto se o Veículo que tiver alugado estiver equipado com um dispositivo de acoplamento/engate de reboque e para o peso bruto rebocável que estiver devidamente averbado); conduzir em estradas de cascalho ou em estradas cuja superfície, tamanho ou condição envolva risco para o Veículo, tais como praias, estradas não adequadas, caminhos florestais, montanhas, etc., ou quaisquer estradas não autorizadas ou pavimentadas, salvo expressa autorização escrita dada pela InterRent; praticar uma infração dolosa, ser transportado a bordo de qualquer tipo de barco, navio, comboio, camião ou avião, salvo com o consentimento expresso da InterRent; conduzir dentro das faixas não admitidas ao trânsito nos portos, aeroportos, e/ou aeródromos e/ ou locais análogos ou similares, não acessíveis ao trânsito público, ou em refinarias e instalações de petróleo, sem o expresso e escrito consentimento da InterRent. No caso de a InterRent O autorizar nos termos referidos, informá-Lo-á do seguro de responsabilidade civil que é aplicável a estes casos e que varia de acordo com as circunstâncias. Durante o Aluguer, deve tomar todas as medidas de proteção necessárias para manter o Veículo nas mesmas condições em que lhe foi entregue. Em especial, Você e/ou qualquer Condutor devem efectuar inspeções regulares ao estado do Veículo quanto ao óleo, à água e à pressão dos pneus. Você pode ser responsabilizado perante a InterRent pelos prejuízos que resultem da violação de quaisquer das acima mencionadas obrigações. Por favor note que o incumprimento de quaisquer das acima mencionadas obrigações implica ainda a ineficácia e inaplicabilidade de eventuais limitações ou exclusões de responsabilidade a que Você tivesse direito no âmbito dos seguros facultativos ou outro produtos de proteção. Nesse caso, InterRent reserva- se também o direito de exigir a imediata devolução do Veículo. 6) QUAIS SÃO OS SERVIÇOS DE MOBILIDADE INCLUIDOS NO MEU ALUGUER? O valor básico de aluguer inclui os seguintes serviços de mobilidade: 7) QUAIS SÃO OS OUTROS SERVIÇOS DE MOBILIDADE NÃO INCLUÍDOS NO MEU ALUGUER? A InterRent propõe-Lhe diversos serviços de mobilidade adicionais, nos termos seguintes: Pode encontrar os custos destes produtos e serviços no Tarifário Recomendado de Custos, anexado ao seu email de confirmação ou disponibilizado no website ou em qualquer estação InterRent. 8) QUE ESTÁ INCLUÍDO NO PREÇO QUE EU PAGO? A informação que presta à InterRent no momento da reserva (tal como a duração do aluguer, a Sua idade ou a idade do Condutor adicional) vai ter impacto no preço que Vai pagar. Qualquer alteração a essa informação poderá, em consequência, alterar esse preço. O preço do Seu aluguer será o que estiver em vigor no momento da reserva ou no momento em que fizer qualquer alteração subsequente à mesma. O preço que Você vai pagar inclui os seguintes custos: ● ● ● ● ● O valor do aluguer diário do Veículo pelos dias de calendário contratados, calculados por períodos de 24 horas (que inclui os serviços padrão de mobilidade acima referidos); O valor de quaisquer quilómetros extra; O valor de quaisquer outros serviços de mobilidade adicionais que Você pretenda contratar; O imposto aplicável (IVA); Outros custos que estejam associados à Sua pessoa (por exemplo: a Sua idade, se for um jovem condutor). Ao contratar com a InterRent, Você autoriza expressamente a InterRent a debitar nos meios de pagamento por si disponibilizados qualquer montante não pago decorrente do Seu aluguer. Para este efeito, o Seu consentimento expresso será dado na estação da InterRent quando disponibilizar o meio de pagamento, antes de levantar o Veículo. 9) QUE OUTROS VALORES POSSO TER QUE PAGAR? ● ● O Depósito/Caução. Para além do preço do aluguer (que Você pagou previamente no momento da reserva ou que irá pagar no momento do levantamento), a InterRent requer que lhe deixe uma garantia. Esta garantia é dada na modalidade de pré-autorização bancária, ou depósito. No caso de ter reservado o Veículo por meios de comunicação à distância (website, aplicação móvel ou telefone) o montante da caução ser-lhe-á relembrado no email de confirmação que recebeu após a sua reserva. De qualquer maneira, o montante da caução será novamente recordado na estação da InterRent. O montante da caução/depósito é determinado de acordo com a categoria do Veículo que vai alugar. No caso de precisar de mais informações sobre o depósito, consulte cláusula 19 (“Tenho que pagar a Caução antes de levantar o Veículo? A InterRent pode ainda cobrar-Lhe por serviços ou custos que tenha que executar ou suportar por causa de incidentes que possam ter ocorrido durante o Período de Aluguer e/ou pela forma como Você utilizou o Veículo. O valor (incluindo IVA) desses serviços ou custos estão descritos no Tarifário Recomendado de Custos que lhe foi disponibilizado na estação InterRent e que se encontra no website InterRent. Tais serviços e custos incluem, sem limitar: Custos administrativos pela gestão dos processos de coimas ou portagens, até ao montante de Euros 30,00 por processo. Note que tais custos administrativos são pagos para além das coimas e das portagens a que se referem e pelas quais Você é total e exclusivamente responsável; Custos administrativos pela gestão do processo, em caso de danos, até ao montante de Euros 36,00; Custo da limpeza. no caso de o Veículo ser devolvido num estado inaceitável (para além do uso normal) e, ou de sujidade; Custo das chaves perdidas, danificadas ou roubadas; “Danos” causados ao Veículo (qualquer dano material ou acto de vandalismo causado no Veículo) e/ou “Roubo do Veículo” (roubo e/ou tentativa de roubo do Veículo propriamente dito ou das suas componentes). A sua responsabilidade pode ser limitada, nos termos e em conformidade com o tipo de proteção que tiver escolhido (por favor confira o Guia dos Seguros e Proteções InterRent anexado ao Seu email de confirmação ou disponível no website ou em qualquer estação InterRent); Custo do combustível utilizado durante o Período de Aluguer; Custo do reabastecimento, no caso de não devolver o tanque cheio; ❍ ❍ ❍ ❍ ❍ ❍ ❍ ❍ ❍ ❍ Quilómetros adicionais para além dos que estavam incluídos no valor do seu aluguer (se for o caso); Custo do dispositivo de portagem eletrónica, em caso de desaparecimento ou dano; Os seguintes custos específicos adicionais: (i) nos levantamentos ou devoluções nas estações situadas no aeroporto ou nas estações de comboio (ii) no retorno do Veículo para uma estação InterRent que não aquela em que procedeu ao levantamento (“One Way”) (iii) no prolongamento do Seu aluguer (iv) em caso de assistência devido a culpa Sua (acidente, perda de chaves, combustível errado), saIvo se demonstrar que a responsabilidade pela reparação é de uma terceira pessoa, devidamente identificada. 10) O QUE DEVO FAZER QUANDO LEVANTAR O VEÍCULO? Quando levantar o Veículo junto da InterRent, vai-Lhe ser solicitado que assine, para além de outras, uma secção no Contrato de Aluguer que descreve o estado do Veículo naquele momento. Se Você verificar qualquer defeito aparente ou Dano que não esteja descrito no Contrato de Aluguer, deve assegurar-se que é feita essa menção no documento e que ambos, Você e o representante da InterRent, assinam tal alteração. No caso de nada estar mencionado, considera-se que o Veículo Lhe foi entregue no estado referido no Contrato de Aluguer e ser-lhe-ão cobrados quaisquer novos Danos que sejam verificados por Si e pelo representante da InterRent quando o Veículo for inspecionando por ambos no momento da sua devolução. 11) QUE PROCEDIMENTOS ADOPTAR QUANDO DEVOLVER O VEÍCULO? a) Devolução do Veículo durante o horário de funcionamento das Estações InterRent Você deve devolver o Veículo na estação InterRent na data e na hora indicadas no Contrato de Aluguer. Pode devolver o Veículo noutra estação InterRent pelo custo indicado no Tarifário Recomendado de Custos anexo ao seu email de confirmação, no caso de ter feito a reserva por meios à distância. Este documento pode também ser consultado nas estações ou no website da InterRent. O Período de Aluguer termina quando devolver o Veículo na estação InterRent e entregar a respetiva chave e os documentos do Veículo a um representante InterRent. No caso de devolver o Veículo antes da data mencionada no Contrato de Aluguer, não terá direito a qualquer reembolso. Quando devolver o Veículo à InterRent deve inspecionar o mesmo juntamente com o representante da InterRent e assinar o relatório de danos pós aluguer. A InterRent deve entregar-lhe um documento no qual declara que o Veículo foi devolvido é aceite pela InterRent (“Declaração de devolução do Veículo”). A InterRent não será responsável por quaisquer bens ou objetos que possa ter esquecido no Veículo. b) Devolução do Veículo fora do horário de funcionamento das Estações InterRent (“Fora de horas”) A InterRent recomenda que a devolução do Veículo seja feita durante o horário de funcionamento das estações. No entanto, para ir ao encontro de necessidades específicas dos seus clientes, a InterRent oferece, em certas estações, o serviço adicional “fora de horas”. No caso de subscrever este serviço “fora de horas”, Você aceita que o relatório que atesta o estado do Veículo seja elaborado pelo representante da InterRent sem a Sua presença e após as chaves terem sido entregues. Nas estações que oferecem o serviço “fora de horas”, o procedimento de devolução do Veículo descrito acima (11a)) foi adaptado, de forma a que as mesmas prestem este serviço nas melhores condições possíveis. Em especial, Você deve declarar qualquer incidente e, ou Dano que afete a condição do Veículo no documento que lhe foi entregue para o efeito no momento em que levantar o Veículo. Esse documento deve ser deixado no Veículo ou devolvido, juntamente com as chaves, na “caixa de entrega das chaves” (“drop off box”), consoante os sistemas disponíveis e a informação que receber da InterRent. Por favor note que o seu Contrato de Aluguer não termina quando entrega as chaves: o Veículo vai ficar estacionado no local onde o deixar até à hora de abertura da estação InterRent que irá proceder à inspeção do Veículo e dar por terminado o seu Contrato de Aluguer. Por essa razão, a InterRent recomenda que estacione o Veículo numa área destinada para esse efeito e de modo a que o Veículo não cause perigo para outros ou perturbe o trânsito, nos termos do Código da Estrada. Deve também deixar os documentos do Veículo no porta luvas. Tendo em conta que o Veículo será inspecionado numa fase posterior ao da sua entrega – durante o horário de funcionamento da estação - a InterRent recomenda que Você tire fotografias ao Veículo como meio de prova do estado do mesmo no momento do estacionamento e antes da entrega das chaves. Após a inspeção ter sido efetuada e na ausência de qualquer Dano, a InterRent enviar-Lhe-á a Declaração de Devolução do Veículo. A InterRent não será responsável por quaisquer bens ou objetos que possa ter esquecido no Veículo. c) Devolução do Veículo sem a Sua presença e durante o horário de funcionamento das Estações InterRent No caso de não ser possível e ou, Você se recusar a inspecionar o Veículo juntamente com o representante da InterRent, esta fica autorizada a inspecionar o Veículo sem a Sua presença e a registar a sua recusa ao contraditório. Nesta situação aplica-se o mesmo procedimento referido em 11 b). d) Atraso na devolução do Veículo No caso de o Veículo não ser devolvido na data mencionada no Contrato de Aluguer e se no período de 24 horas não houver qualquer informação justificativa do atraso na devolução, a InterRent reserva-se no direito de: ● ● ● Considerar que Você se apropriou ilegalmente do Veículo e reportar tal facto às autoridades locais competentes. Cobrar o valor do aluguer por cada dia em que ficar com o Veículo para além da data do termo do aluguer, acrescido de uma indemnização equivalente ao dobro do valor a pagar, salvo se Você demonstrar que já não tem a posse do Veículo ou que a não restituição do mesmo resultaram de facto que não lhe seja imputável. Reclamar de Si todos os danos e perdas sofridos, bem como as coimas, portagens, multas ou ● demais sanções ou penalidades que recaiam sobre o Veículo em resultado dos processos instaurados pelas autoridades públicas com a finalidade de identificar o infrator ou de clarificar outras circunstâncias relacionadas com o incumprimento ou com a infração criminal. Iniciar os procedimentos judiciais necessários para reclamar a imediata restituição do Veículo. Note que neste caso, as proteções, seguros facultativos e serviços adicionais que tenha contratado não produzirão qualquer efeito. 12) DANOS NO VEÍCULO No caso de o Veículo não ser devolvido nas mesmas condições em que foi entregue, Você terá de pagar as quantias referidas em baixo. a) Danos identificados no momento da devolução do Veículo e na Sua presença No caso de serem identificados Danos no âmbito da inspeção realizada na Sua presença e na do representante da InterRent aquando da devolução do Veículo e dos quais tomou conhecimento quando assinou a Declaração de Devolução do Veículo e o relatório de danos pós aluguer, a InterRent entregar-lhe-á uma avaliação com os custos da reparação que lhe poderão ser cobrados. Os custos da reparação variam, dependendo da natureza dos Danos: ● ● “Pequenos Danos” (danos menores e não substanciais causados ao Veículo, sem afetar a sua devolução ao Locador e sem afetar a sua mobilidade nos termos do Código da Estrada, tais como e sem limitar: pequenos riscos ou mossas no para-brisas) são cobrados de acordo com a lista de preços recomendados pela InterRent, disponível em qualquer estação, que incluem o custo da imobilização do Veículo, juntamente com os custos administrativos de gestão de danos. Quaisquer outros danos não incluídos na lista acima referida e/ou outros danos mais graves (danos substanciais que impedem a devolução do Veículo e exigem a sua temporária imobilização para reparação, tais como e sem limitar: danos na corroçaria), serão avaliados por um perito e cobrados de acordo com o relatório do mesmo ou pelo custo orçamentado de uma oficina de reparações. No caso de contestar os Danos e, ou a respetiva faturação, através da recusa em assinar a Declaração de Devolução do Veículo, a InterRent irá aplicar o procedimento descrito em 12b). b) Danos identificados em caso de devolução “fora de horas” e sem a Sua presença No caso de os Danos serem identificados no âmbito da inspeção ao Veículo feita pelo representante da InterRent sem a Sua presença, a InterRent enviar-Lhe-á os seguintes documentos: ● ● ● Declaração de Devolução do Veículo com descrição dos Danos identificados; Fotografias dos Danos; Uma estimativa (orçamento) dos custos de reparação, que dependerão da natureza dos Danos (v. supra 12a) §2), dos custos de imobilização do Veículo e dos custos administrativos pela gestão do processo de Danos. Você pode contestar os Danos identificados e a respetiva facturação no prazo de (14) catorze dias corridos após o envio dos documentos, por e-mail para [email protected] , ou por carta para o Apartado 8332, Cabo Ruivo, 1804-001 Lisboa. No caso de não contestar no referido prazo de 14 dias, a InterRent reserva-se o direito de Lhe cobrar os referidos custos. c) Regras comuns Por favor note que, dependendo do Dano sofrido pelo Veículo e do tipo de proteção que tenha subscrito com a InterRent, (confira os Seguros eProteções InterRent anexado ao Seu email de confirmação ou disponível no website ou em qualquer estação InterRent) Você pode ser ou não cobrado pelo montante total do custo da reparação. Em qualquer caso, Você pode contestar os Danos e, ou a respetiva faturação, nos termos referidos na cláusula 24) 13) O QUE DEVO FAZER QUANTO À MANUTENÇÃO DO VEÍCULO? Durante o Seu aluguer Você deve tomar todas as medidas de proteção necessárias para manter o Veículo nas mesmas condições em que lhe foi entregue. Você deve estar atento a qualquer sinal de aviso das luzes do painel do Veículo e tomar as medidas de proteção necessárias. É proibida qualquer modificação ou intervenção mecânica ao Veículo sem a prévia autorização escrita da InterRent. No caso de violar esta norma, Você terá de suportar os custos de repor o Veículo nas mesmas condições em que lhe foi entregue. Você será responsável perante a InterRent por quaisquer prejuízos que decorram da violação de qualquer das acima mencionadas obrigações de manutenção. 14) O QUE DEVO FAZER EM CASO DE ACIDENTE, AVARIA MECÂNICA OU ROUBO DO VEÍCULO? ● ● ● ● Em caso de avaria mecânica ou acidente, que O impeça de continuar a conduzir e/ou que O obrigue a parar para evitar o agravamento do dano, Você tem disponível um serviço de assistência, incluído no preço do Seu aluguer. Os termos desta assistência estão descritos no Anexo I das presentes T&Cs. Em caso de acidente, Você deve, no prazo de 5 (cinco) dias úteis ou logo que seja razoavelmente possível de acordo com as circunstâncias, (i) comunicar tal facto à InterRent e chamar as autoridades policiais locais e (ii) preencher a Declaração Amigável de Acidente Automóvel. Nestes casos, deve contactar o serviço de assistência para o número que está indicado no interior do pára-brisas. Em caso de roubo do Veículo, deve enviar à InterRent uma cópia da participação do mesmo às autoridades policiais no prazo de 2 (dois) dias úteis, juntamente com as chaves e os documentos do Veículo, no caso destes não terem sido roubados. Estes procedimentos são aplicáveis nos territórios acordados entre Si e a InterRent. 15) QUANDO DEVO RECEBER A MINHA FACTURA E PAGAR PELO ALUGUER? Irá receber a sua fatura assim que todos os elementos do Seu Aluguer estejam definidos e nunca antes do dia seguinte ao da devolução do Veículo. O valor total será pago ou ser-lhe-á cobrado de uma só vez ou em diferentes fases, dependendo da situação. ● Pode optar pelo pré-pagamento do Seu aluguer (na sua reserva feita on line, via call center ou numa estação InterRent), que incluirá o valor diário do aluguer do Veículo e acessórios para o Período de Aluguer, bem como quaisquer serviços de mobilidade adicionais. O valor acordado será ● ● ● debitado no seu meio de pagamento. No caso de decidir selecionar serviços de mobilidade adicionais, o valor dos mesmos será debitado no seu meio de pagamento no momento do levantamento de Veículo. Quaisquer taxas ou custos adicionais serão cobrados quando devolver o Veículo (se puderem ser calculados na altura). A InterRent emitirá depois uma fatura do seu aluguer, que inclui todos os serviços de mobilidade selecionados por Si, bem como os valores e custos adicionais identificados no momento da devolução do Veículo. Caso tenha incorrido em custos extras, tais como coimas e portagens ou causado Danos no Veículo identificados sem a Sua presença, a InterRent irá cobrá-los, juntamente com os respetivos custos administrativos (pela gestão dos processos de coimas e de portagens e pelo processo de gestão de danos) mais tarde, quando tomar conhecimento dos mesmos. Neste caso, Você terá catorze (14) dias a contar da data do envio da notificação da cobrança, para contestar e, ou justificar não ser o responsável pelos custos de gestão, podendo fazê-lo através de e-mail para [email protected], ou por carta para o Apartado 8332, Cabo Ruivo, 1804-001 Lisboa). No caso de não contestar no período mencionado, ser-lhe-á cobrado o montante dos referidos custos administrativos. ● A fatura ser-lhe enviada eletronicamente para o endereço de email que nos tiver fornecido para o efeito. Caso não pretenda receber a fatura eletronicamente, pode optar por recebê-la em papel. 16) E SE EU QUISER CANCELAR OU ALTERAR A MINHA RESERVA? a) Alterações Poderá alterar a sua reserva, sem qualquer custo, desde que dê conhecimento à InterRent de tais alterações pelo menos 2 horas antes do aluguer estar previsto para começar. Por favor tenha em atenção que, caso altere a sua reserva, poderão ser aplicáveis novos preços de aluguer e que deverá usar sempre o mesmo canal de comunicação que tenha utilizado quando efetuou, pela primeira vez, a reserva do Veículo. Em alternativa, pode ligar para o nosso Call Center para o número 219407790 (custo de chamada local). b) Cancelamento Poderá cancelar a sua reserva sem quaisquer custos desde que notifique a InterRent com pelo menos 2 horas antes do aluguer estar previsto para começar. Caso não proceda ao cancelamento e não levante o Veículo, o valor do pré-pagamento será reembolsado sendo deduzida uma taxa de não comparência (“No-show fee”) no valor até cinco (5) dias de aluguer. Para os efeitos desta secção, o cancelamento da reserva ou o não levantamento do Veículo devido a causa de Força Maior significa que o Cliente está impossibilitado ou impedido por força de atos de guerra e outras hostilidades e comoções civis, acidentes, greves, lock-outs, ou outros conflitos laborais, embargos ou decisões governamentais de restrições de importações ou exportações ou qualquer outra causa ou circunstância insuscetível do seu controlo (direto ou indireto). 17) O QUE DEVO FAZER SE QUISER PROLONGAR O MEU CONTRATO DE ALUGUER? No caso de pretender prolongar o Período de Aluguer previsto no Seu Contrato de Aluguer, deve executar os passos seguintes: ● ● ● Para prolongamentos inferiores a 24 horas, contactar a estação InterRent de devolução do Veículo e, ou, dirigir-se à mesma para obter a prévia aprovação da InterRent para o prolongamento. Assinar um aditamento ao Contrato ou um novo Contrato de Aluguer, consoante o que se lhe aplicar; Para prolongamentos superiores a 24 horas, Você deve: - Efetuar uma inspeção ao Veículo juntamente com o representante InterRent; - Pagar o aluguer, bem como quaisquer custos adicionais; ● Assinar um aditamento ao Contrato ou um novo Contrato de Aluguer, consoante o que se lhe aplicar; Se não cumprir os passos acima referidos e ficar com o Veículo, aplica-se o disposto na cláusula 11 d): “Atraso na devolução do Veículo”. 18) QUAL É A POLÍTICA DE COMBUSTÍVEL? As regras aplicáveis ao abastecimento e ao reabastecimento de combustível dependem do país de aluguer e da modalidade de aluguer que escolher. Por favor confira cuidadosamente as regras de combustível aplicáveis a cada aluguer que faça. Todos os Veículos são entregues com o tanque cheio de combustível. No momento da devolução do Veículo, podem ocorrer as seguintes situações: 1) Devolução do Veículo com o mesmo nível de combustível ● ● ● Nós entregamos o Veículo com o tanque cheio de combustível, com um nível mencionado no Contrato de Aluguer. Você devolve o Veículo com o mesmo nível de combustível. Você não nos paga nada pelo reabastecimento ou pelo combustível. Por favor note que a InterRent pode solicitar prova da compra do combustível (recibo). 2) Devolução do Veículo com um nível diferente de combustível do que estava mencionado no momento do levantamento (Custo do Reabastecimento) ● No caso de não devolver o Veículo com o mesmo nível de combustível identificado no momento da entrega do Veículo, ser-Lhe-á cobrado o custo do combustível em falta, acrescido de um valor correspondente ao custo do reabastecimento (Ver o Tarifário Recomendado de Custos junto ao email de confirmação e disponível no website ou nas estações InterRent). 3) Compra do Tanque de combustível (Full Tank Option) ● ● ● No ato de levantamento do Veículo, Você tem a possibilidade de pagar o preço de um tanque de combustível cheio. Este custo depende da categoria do Veículo. Neste caso, pode devolver o Veículo, independentemente do nível de combustível que tiver no momento. A InterRent não lhe cobrará qualquer valor adicional, mas não o reembolsará pelo combustível não utilizado. 19) TENHO DE PAGAR UM DEPOSITO/CAUÇÃO ANTES DE LEVANTAR O VEÍCULO? Quando levantar o Veículo, Você concede uma autorização de cartão de crédito para um depósito. O montante do depósito depende da categoria do Veículo. O depósito visa cobrir os custos de aluguer adicionais e, ou os produtos adicionais e, ou os serviços de mobilidade que tenha subscrito no momento do levantamento do Veículo. O modo de cálculo do montante do depósito encontra-se devidamente detalhado numa secção especialmente dedicada para o efeito no website da InterRent e pode sempre ser esclarecido ao balcão. Em qualquer caso, o montante definitivo do depósito está especificado no email de confirmação que Lhe foi enviado no momento da sua reserva e no Contrato de Aluguer. Se não forem identificados custos de aluguer adicionais, a caução será reembolsada no prazo acordado entre Si e o seu Banco. A caução deve ser efetuada por Si ou por um Condutor adicional devidamente identificado no Contrato de Aluguer e deve apresentar o mesmo cartão de crédito que indicou no momento da reserva. 20) POSSO PAGAR O MEU ALUGUER COM UM CARTÃO DE CRÉDITO ESTRANGEIRO? Se for um locatário estrangeiro, portador de um cartão de crédito Visa ou MasterCard (em moeda corrente diferente do Euro) Você pagará na moeda do seu País de Aluguer. 21) QUAIS SÃO AS PROTEÇÕES CONTRATUAIS FACULTATIVAS QUE DISPONHO? 1) Proteção contra Danos e Roubo O valor do aluguer já inclui a proteção para cobrir os Danos e o Roubo (“CDW/TP/TW”) do Veículo, limitando a sua responsabilidade ao valor da Franquia. Mas tem a possibilidade de subscrever uma opção adicional de proteção contra Danos e Roubo, que lhe permite reduzir o valor da Franquia ou, dependendo da categoria de Veículo, eliminá-lo por completo. Estas proteções adicionais estão devidamente explicadas no Anexo 2, que detalha a sua natureza, finalidade e condições de aplicabilidade, em especial os valores da Franquia. As referidas proteções devem ser subscritas no início do aluguer, contra o pagamento de um valor fixo por cada dia de aluguer, o que será confirmado pela correspondente abreviatura registada ou selecionada no Contrato de Aluguer, bem como pela indicação do valor de qualquer franquia residual aplicável. Estas proteções, mesmo que prevejam a total eliminação da Franquia, não cobrem os Danos causados na parte superior ou inferior do Veículo, nem os casos em que se verifique a ineficácia das coberturas, nos termos do artigo 21 §2 infra, que é plenamente aplicável. Nenhuma proteção cobre os Danos ou o Roubo dos objetos transportados no Veículo. Consoante o nível de proteção que tenha subscrito, os Danos ser-Lhe-ão debitados no valor da Franquia, o qual varia de acordo com a categoria do Veículo e que está indicado no Contrato de Aluguer e no Anexo 2 dos presentes T&C. No caso de os Danos suportados pela locadora serem de valor inferior ao da Franquia, ser-Lhe-á cobrado o valor mais baixo. Se Você não tiver qualquer responsabilidade nos Danos, o valor que lhe foi cobrado será reembolsado integralmente logo que pago pelo terceiro responsável. 2) Exclusão da proteção A proteção contra Danos e Roubo só está disponível para o Condutor expressamente mencionado no Contrato de Aluguer. Se Você permitir que qualquer pessoa não autorizada conduza o Veículo, Você será responsável por todas e quaisquer consequências que daí possam resultar, incluindo a possibilidade de responder perante a InterRent pelos danos causados por si e, ou pela pessoa não autorizada. Nesse caso, o condutor não autorizado não será também coberto por nenhum seguro ou proteção oferecido através da InterRent. Só será aplicável o Seguro obrigatório de Responsabilidade Civil. Por favor consulte o Anexo 2 dos presentes T&C. 3) Seguro/Assistência Todos os nossos veículos estão cobertos por um Seguro de Responsabilidade Civil contra terceiros, de acordo com a lei em vigor, subscrito junto da AIG Europe Limited. Os veículos estão também cobertos com um contrato de Assistência. Você também pode subscrever as nossas proteções que cobrem o condutor e os seus objetos pessoais e dos passageiros. As condições e os limites das apólices de seguro, obrigatórias ou facultativas, das proteções contratuais, e do contrato de assistência técnica, estão descritas no Anexo 2. 22) QUAL A POLÍTICA DA INTERRENT PARA PROTEGER OS MEUS DADOS PESSOAIS? A InterRent poderá utilizar qualquer informação pessoal que tenha prestado à InterRent, incluindo os dados de qualquer Condutor Autorizado, com a finalidade de prestar os serviços de aluguer, nomeadamente para verificar a identidade, para proceder à cobrança de valores, monitorizar fraudes e gerir quaisquer situações antes, durante e após o Período de Aluguer. A nossa política de privacidade está disponível em InterRent.pt A InterRent poderá fornecer os seus dados pessoais constantes do Contrato de Aluguer, e detalhes da performance das obrigações abrangidas por este Contrato de Aluguer, a entidades terceiras, tais como às autoridades policiais, às entidades de cobrança de portagens, a entidades de recuperação de crédito (incluindo advogados) e qualquer outra organização relevante. Em caso de incumprimento por falta de pagamento, a InterRent poderá igualmente, e caso o consinta especificamente no final dos presentes T&C’s comunicar a sua informação pessoal à ARAC – Associação dos Industriais de Aluguer de Automóveis Sem Condutor (“ARAC”), para efeitos de inserção no respetivo ficheiro de clientes incumpridores e que, por sua vez, poderá ser acessível a qualquer dos seus membros para ajudar os mesmos a decidir se devem aceitá-lo a Si ou a qualquer condutor identificado com um cliente. Por favor note que a celebração do Contrato de Aluguer não fica dependente do seu consentimento para a utilização, por qualquer forma, em bases de dados de clientes incumpridores e da sua comunicação à ARAC, dos dados pessoais fornecidos no âmbito do presente contrato. A InterRent recolhe e processa dados com a finalidade de lhe fornecer os serviços de aluguer de veículos e para fins de marketing tais como promoções e para efeitos do programa de fidelização de clientes. Será informado de qualquer informação pessoal sua que deva ser recolhida pela InterRent na estação ou online, por via da indicação de um asterisco. Os destinatários de tais dados serão unicamente as empresas que integram o Grupo InterRent bem como os seus franchisados. Alguns dos destinatários dos dados recolhidos poderão estar localizados em países nos quais a legislação relativa a dados pessoais não confere um nível de proteção equivalente aos standards da lei Portuguesa e da Comissão Nacional de Proteção de Dados (CNPD). Não obstante, a transferência de dados pessoais para um país com um insuficiente nível de proteção só será feita no caso de alugar um Veículo na InterRent localizada num país fora da União Europeia, tal como exigido para executar o Seu Contrato de Aluguer, nos termos do artigo 19º da Lei nº 67/98, de 26 de Outubro. Nestes termos terá direito de acesso, retificação e eliminação de quaisquer dados que lhe digam respeito. Poderá exercer este direito mediante o acesso a [email protected] , ou envio para o Apartado 8332, Cabo Ruivo, 1804 – 001 Lisboa. Informamos que com o objetivo de prevenir riscos associados, a InterRent poderá declinar o aluguer de Veículos a pessoas que não ofereçam garantias de cumprimento do contrato. Informamos ainda que os seus dados pessoais poderão ser notificados às autoridades policiais a respetivo pedido em caso de transgressão ao Código da Estrada e/ou pela prática de qualquer crime perpetrado durante o Seu aluguer. Ao aceitar os presentes T&C, expressamente reconhece ter prestado o seu consentimento explícito à supra mencionada política de privacidade. 23) OS VEÍCULOS ESTÃO EQUIPADOS COM DISPOSITIVOS ELECTRÓNICOS? Para manter e proteger o Veículo e para prevenir e detetar práticas criminais, a InterRent pode utilizar dispositivos eletrónicos de geo-localização para monitorizar o estado, a funcionalidade e operacionalidade do Veículo e/ou para detetar os movimentos do mesmo. Esta informação pode ser utilizada durante e após o Período de Aluguer. Nos termos da Lei portuguesa de Proteção de Dados, Você tem direito de acesso, retificação e eliminação de quaisquer dados que lhe digam respeito. Pode exercer este direito mediante o acesso a [email protected], ou envio para o Apartado 8332, Cabo Ruivo, 1804-001 Lisboa. Os Veículos podem estar ainda equipados com um dispositivo de portagem eletrónica que permite determinar e debitar o valor das taxas de portagem, pelo que Você obriga-se a assegurar o seu correto funcionamento e conservação, podendo a InterRent proceder ao débito do custo do mesmo em caso de desaparecimento ou dano. 24) O QUE ACONTECE EM CASO DE LITÍGIO RELACIONADO COM O MEU ALUGUER? a) Lei aplicável Em caso de litígio entre Si e a InterRent relativo ao seu aluguer, a lei aplicável será a do país do levantamento do Veículo. Por exemplo, se é um cidadão Português e levantou o Veículo em Portugal, a lei aplicável será a Portuguesa. No entanto, se alugar um Veículo enquanto está na Alemanha, o seu aluguer será regulado pela lei alemã. b) Serviço de Apoio ao Cliente Independentemente do local em que tiver celebrado o Contrato de Aluguer, pode optar por contactar o Serviço de Apoio ao Cliente no Seu país de residência. A sua equipa de Apoio ao Cliente contactará, em seu nome, o país do aluguer e tentará resolver a sua questão. Pode contactar o Serviço de Apoio ao Cliente para [email protected] ou para o Apartado 8332, Cabo Ruivo, 1804-001 Lisboa. c) Notificações Todas as notificações a efetuar ao abrigo do Contrato de Aluguer devem ser enviadas para as moradas constantes do mesmo, que Você e nós reconhecemos ser o domicílio convencionado para todos os efeitos legais, obrigando-se a comunicar qualquer alteração. Você e Nós conferimos à assinatura manuscrita aposta digitalmente ou por quaisquer meios biométricos, digitais ou eletrónicos força probatória idêntica à de um documento escrito, nos termos da lei, tendo a assinatura realizada naqueles termos a mesma validade que a assinatura manuscrita. d) Conciliação junto da ECRCS Se o país em que celebrou o Contrato de Aluguer é diferente do Seu país, pode escolher apresentar a sua reclamação junto do European Car Rental Conciliation Services (ECRCS). (http://www.ecrcs.eu) A InterRent aderiu ao ERCRS de forma a permitir que os Seus clientes possam resolver as suas queixas relativas a alugueres transfronteiriços dentro da Europa. Deve ser sublinhado que este Serviço de Conciliação só pode intervir em litígios relacionados com alugueres transfronteiriços ocorridos dentro da União Europeia.- Você tem que ser residente na UE e o aluguer tem de ter ocorrido noutro país da UE. e) Documentos contratuais Os documentos obrigatórios e vinculativos entre Si e a InterRent são, por ordem de prioridade, os seguintes: ● ● ● ● O Contrato de Aluguer e respetivas cláusulas específicas; O email de confirmação que recebeu quando reservou o Veículo; O Tarifário Recomendado de Custos; As presentes T&C e os respetivos anexos, que se aplicam a todos os referidos documentos. 25) EXISTE ALGUM CÓDIGO DE CONDUTA APLICÁVEL À INDÚSTRIA DE ALUGUER DE AUTOMÓVEIS? A Leaseurope publicou um código de conduta para a indústria de aluguer de automóveis. Pode consultar uma cópia no seguinte endereço eletrónico: www.leaseurope.org. [ ] Tomei conhecimento que o Veículo pode estar equipado com dispositivo de geo- localização (GPS) que pode ser utilizado em caso de incumprimento contratual, roubo ou transposição de fronteira. [ ] Autorizo que, em caso de incumprimento, os meus dados pessoais sejam comunicados à ARAC (Associação dos Industriais de Alugueres de Automóveis sem condutor) para inclusão em bases de dados de incumpridores e posterior divulgação pelas empresas associadas. [ ] Não autorizo que os meus dados sejam utilizados para efeitos de marketing direto. Li e concordo com os T&Cs. Data e assinatura ANEXO 1 - SERVIÇO DE ASSISTÊNCIA AO VEÍCULO Nota: Neste anexo, o Iva está incluído no preço, quando aplicável. Na vigência do Período de Aluguer, Você beneficia, sem custos extra, de um serviço de assistência 24 horas associado à utilização do Veículo. Atenção que em caso de avarias ou acidentes causadas por Si e/ou qualquer condutor ou em consequência da utilização de combustível errado ou pela perda/ danos causados às chaves do Veículo, bem como em caso de furo ou dano nos pneus, Você tem de pagar os seguintes custos: ● ● ● ● Reboque no valor de EUR 250 Chaves perdidas ou partidas: EUR 200 a 260; Combustível errado, embora sem causar danos na mecânica ou no motor: EUR 250, não incluindo reboque (acrescido do combustível em falta); Furo e/ou dano que destrua apenas o pneu: EUR 130 a 200 + fee administrativo de EUR 36 por sinistro. Este serviço de assistência ao Veículo inclui: ● ● ● ● ● Remoção do Veículo avariado; Envio e pagamento dos custos de reboque de um veículo que não tenha estado envolvido num acidente ou tenha avariado e não possa ser reparado no local; Encontrar um veículo de substituição num raio de 50 Km, no caso de o Veículo não poder ser reparado no local (NB: o Contrato de Aluguer continua em vigor até ao último dia do aluguer originalmente acordado), Transporte dos beneficiários até à estação de aluguer onde a substituição possa ser feita; No caso de não ser identificado nenhum veículo de substituição: Quarto de hotel com pequeno-almoço por uma noite ou, transporte de táxi ou de comboio para o local de residência ou de destino ou partida em Portugal no caso de não residentes. Este benefício é prestado até ao montante de EUR 60 por beneficiário. Exclusões Este serviço de assistência técnica ao Veículo exclui: ● ● Quaisquer incidentes ou danos causados pelo facto de tomar parte em eventos desportivos, rallies ou qualquer outro tipo de competição; Veículos comerciais alugados em Portugal e que foram para o estrangeiro. SERVIÇO DE PORTAGENS Você pode adquirir junto da InterRent o Serviço de Portagens (“Toll Management”), que assegura o pagamento atempado das taxas de portagem devidas por Si pela utilização das infra-estruturas rodoviárias (auto-estradas e pontes) portuguesas, incluindo as que apenas disponham do sistema de cobrança eletrónica. No caso de Não aderir ao Serviço de Portagens obriga-se a pagar junto das Entidades de Cobrança competentes todas e quaisquer taxas de portagem e respetivos custos administrativos, que sejam devidas pela utilização do Veículo, por Si ou por qualquer Condutor adicional, durante a vigência do Contrato de Aluguer, ficando responsável pelas consequências resultantes do seu incumprimento, incorrendo, nomeadamente, na prática de uma contra-ordenação punível com coima nos termos da lei. No caso de Aderir ao Serviço de Portagens, autoriza que a InterRent proceda ao pagamento junto das Entidades de Cobrança de Portagens das taxas de portagem que sejam devidas pela utilização do Veículo durante a vigência do Contrato de Aluguer e as debite no seu cartão de crédito, juntamente com os respectivos custos administrativos. Os referidos débitos podem ser efetuados até 30 dias após o termo do Contrato, nos casos em que as taxas de portagem apenas sejam disponibilizadas nesse prazo à InterRent. No caso de Você aderir ao Serviço de Portagens e posteriormente recusar ou impedir a InterRent, por qualquer forma, de receber o pagamento das taxas de portagem ou demais custos associados, fica esta desde já autorizada a, nos termos da lei, identificar o condutor do Veículo junto das entidades competentes para efeitos do respetivo processo de cobrança e de contra-ordenação, ficando Você ainda responsável pelas quantias que a InterRent ou outras entidades incorram com o mesmo. ANEXO 2 – TERMOS E CONDIÇÕES DOS SEGUROS E PROTEÇÕES SEGUROS Todos os Veículos que fazem parte da frota da InterRent estão segurados contra danos, materiais ou corporais, causados a terceiros. A Europcar é segurada pela AIG EUROPE Limited, com sede na Tour CHARTIS, 92079 PARIS LA DEFENSE 2 (Apólice nº 1.902.122). Os danos corporais estão cobertos por montante ilimitado e os danos materiais até 1,000,000€ Proteção incluída no valor do seu aluguer De acordo com os requisitos legalmente exigidos nos países de aluguer da InterRent, todos os veículos da InterRent beneficiam de um Seguro de Responsabilidade Civil contra terceiros (TPLI), subscrito localmente junto das principais seguradoras do ramo e que cobre os danos corporais ou morte que Você possa causar a um terceiro na sequência de um acidente que envolva o Veículo. O TPLI está sempre incluído no valor do aluguer pré-pago e não se aplica a dedução na Franquia. Proteções complementares incluídas no valor do seu aluguer Proteção contra Danos e Roubo (“CDW/TP/TW): cobre perdas ou danos causados ao Veículo, incluindo por Roubo, tentativa de Roubo ou vandalismo, até certo montante e sujeito ao pagamento de uma Franquia, cujo valor depende da categoria do Veículo. Por favor note que as proteções supra referidas só se aplicarão se Você cumprir os Termos e Condições do Aluguer, em especial as regras respeitantes ao uso e manutenção do Veículo, bem como todas as leis e regras do Código da Estrada e demais legislação aplicável quando estiver a conduzir o Veículo. Se assim não for, Você será responsável pelo montante total da reclamação, de acordo com o T&C previstos no seu Contrato de Aluguer. Você pode reforçar a cobertura acima referida, adquirindo os seguros e proteções facultativos, adiante referidos, que estão sujeitos aos requisitos específicos locais previstos no presente Anexo e nos T&C. Se pretender adquirir tais seguros e proteções adicionais, por favor consulte o anexo em que os preços estão discriminados por cada país de aluguer InterRent. Exclusões Você será responsável pela totalidade dos danos, se os mesmos forem causados: ● ● ● por atos intencionais do condutor; ou por uma explosão ou incêndio no Veículo decorrentes do facto de o ter utilizado para o transporte de mercadorias perigosas (considerando-se mercadorias perigosas qualquer produto ou substância que, devido à sua natureza e/ou características principais, seja razoavelmente considerado perigoso e que, se não for transportado com segurança e proteção apropriadas pode causar danos ao Veículo, e a qualquer Terceiro a uma distância razoável do Veículo); ou por Sua negligência (comportamento abaixo do padrão esperado de uma pessoa razoavelmente sensata em circunstâncias semelhantes) ou pela negligência dos seus Ocupantes (por exemplo, um incêndio causado pela utilização ou pelo apagar de um cigarro ou charuto);ou em caso de perda ou roubo das chaves. Este produto não O protegerá, ainda, no caso de: ● ● o Veículo ser roubado, furtado ou danificado devido à Sua negligência ou, mais especificamente (mas sem limitação), em resultado de as chaves terem sido deixadas no Veículo enquanto este estava sem vigilância; ao facto de não ter sido adequadamente usado o sistema anti-roubo; no caso de não Nos devolver as chaves; ou no caso de ter deixado o Veículo destrancado quando não o estava a usar; roubo, furto ou dano de quaisquer bens ou pertences pessoais e/ou relacionados com o trabalho e quaisquer bens transportados no Veículo ou sobre o mesmo. Proteção facultativa “Seguro Proteção Acidentes Pessoais (PAI)”: protege-o a Si e aos ocupantes do Veículo, limitado ao número de ocupantes autorizado por veículo, em caso de morte ou incapacidade permanente, cujo valor depende da categoria do Veículo. “Seguro Super Proteção Acidentes Pessoais (SPAI)”: protege-o a Si e aos ocupantes do Veículo, limitado ao número de ocupantes autorizado por veículo, em caso de morte ou incapacidade permanente, bem como a sua bagagem e, ou objetos pessoais por perdas e danos, cujo valor depende da categoria do Veículo. Coberturas facultativas ● ● ● ● “Super Cobertura”: reduz o valor da Franquia no caso do “CDW”, “TW/TP”, dependendo da categoria do Veículo; “Assistência Rodoviária Mais”: permite-Lhe reduzir o custo extra de EUR 250 (IVA incluído), em caso de avarias ou acidentes causadas pelo cliente ou em resultado da utilização de combustível errado, da quebra ou perda das chaves do Veículo ou do furo e/ou danos nos pneus. “Paz de Espírito – Cobertura Total (“Peace of Mind”): permite-lhe conduzir e aproveitar, sem se preocupar com o custo dos danos no Veículo ou o custo da assistência que seria aplicado em caso de subscrever apenas o “CDW”, o “TP/TW” e o eventual custo da assistência em estrada, eliminando o valor da Franquia, que depende da categoria do Veículo. Inclui também a Proteção vidros, faróis e pneus (“WWI”) Proteção vidro, faróis e pneus (“WWI”): cobre os danos causados no vidro da frente ) - salvo ● ● no teto de abrir e no espelho causados intencionalmente pelo Locatário –; em qualquer janela lateral ou traseira; bem como nas óticas (reflexão de luz), nos faróis e nos pneus do Veículo, se tais danos ocorrerem no âmbito de condições normais de condução. Note que este produto não se aplica aos casos em que tais danos ocorram em consequência de uma colisão, pois nesse caso estarão cobertos pelo CDW. Pacote Familia: Este pacote inclui a Cobertura Total, um Condutor Adicional e uma Cadeira de Bébé. Pacote de Segurança Premium: Este pacote inclui a Cobertura Total, a Proteção pessoal/SPAI e os seus bens Por favor note que as proteções supra referidas só se aplicarão se Você cumprir os Termos e Condições do Aluguer, em especial as regras respeitantes ao uso e manutenção do Veículo, bem como todas as leis e regras do Código da Estrada e demais legislação aplicável quando estiver a conduzir o Veículo. Este produto não o protege da responsabilidade por danos causados ao Veículo que resultem de atos dolosos ou negligentes por si praticados durante o uso do Veículo e que causem danos. Se não cumprir o acima exposto, Você será responsável pelo montante total da reclamação, de acordo com o T&C previstos no seu Contrato de Aluguer. Seguros Adicionais facultativos ● PROTEÇÃO ACIDENTES PESSOAIS (PAI): Seguro da AXA Corporate Solutions - Apólice nº XFR0078448GP O que está incluído na cobertura? No âmbito desta proteção poderá reclamar o valor de algumas destas possíveis consequências resultantes da Sua morte ou danos corporais, na sequência de uma colisão que ocorra quando estiver a conduzir o Veículo: ● O pagamento de um valor fixo até ao montante máximo de €50,000 no caso da Sua morte (ou presunção de morte), no prazo de 24 meses a contar da data da colisão ou do incidente; ou no caso de ficar definitivamente incapaz, total ou parcialmente, em consequência da colisão ou do incidente. O pagamento de despesas médicas até ao montante máximo de €2,500 (inclui hospitalização, consultas e medicamentos; raios X e exames médicos relevantes; tratamentos ou próteses dentárias) cuja necessidade tenha decorrido da colisão ou do incidente. ❍ ❍ ● Se Você e/ou os Seus Ocupantes forem vítimas de uma colisão durante o período de aluguer, desde que tenha adquirido este produto (que neste caso se aplicará a Si e a todos os Ocupantes do Veículo), pode apresentar uma reclamação, independentemente de quem for o culpado pelo acidente. Assim: ● ● Os Ocupantes, que são sempre considerados Terceiros nos termos do Seguro obrigatório de Responsabilidade Civil, podem ser indemnizados, independentemente da culpa do Condutor, pela seguradora no âmbito do Seguro de Responsabilidade Civil mas podem também cobrar o montante fixo indemnizatório a que têm direito no âmbito do produto de Seguro Proteção Acidentes Pessoais. Se você não for responsável pela colisão enquanto estava a conduzir o Veículo (condutor «não culposo»), Você pode acumular a indemnização recebida pela seguradora no âmbito do Seguro de ● Responsabilidade Civil, com o montante fixo indemnizatório a que tem direito no âmbito do produto de Proteção Acidentes Pessoais. Se você for responsável pela colisão enquanto estava a conduzir o Veículo (condutor «culposo»), só será coberto pelo produto de Seguro Proteção Acidentes Pessoais. O que está (principalmente) excluído da cobertura? Este Seguro Proteção Acidentes Pessoais não cobre: ● ● ● ● quaisquer valores acima indicados no caso de tais despesas não terem sido incorridas como resultado direto da colisão ou do incidente que ocorreu enquanto tinha o controlo do Veículo, ou se intencionalmente causou ou deu origem ao acidente ou à colisão ; ou quaisquer valores relacionados com tratamentos que estivesse a receber ou com problemas médicos que estivesse a sofrer antes da ocorrência do acidente ou do incidente ; ou quaisquer danos materiais ou perda relacionados com os Seus pertences ou bens materiais ; ou quaisquer danos causados ao Veículo. Qual o nível da minha exposição patrimonial? Desde que não tenha violado qualquer lei aplicável (incluindo qualquer norma do Código da Estrada ou demais legislação rodoviária, em especial, relacionada com a utilização de cintos de segurança e com o limite de ocupantes que se pode transportar no Veículo – por exemplo, se 7 pessoas sofrerem danos num veículo de 5 lugares, a Proteção de Acidentes Pessoais não se irá, pura e simplesmente, aplicar), terá direito à proteção até ao limite de indemnização acima referido. No entanto, se tiver desrespeitado qualquer uma dessas leis e/ou regulamentos, a nossa seguradora pode recusar a cobertura, ou, no caso de se demonstrar que Você foi parcialmente responsável pelas lesões sofridas na colisão ou no incidente, a seguradora pode reduzir a sua responsabilidade pelos custos. ● SUPER PROTEÇÃO ACIDENTES PESSOAIS (SPAI) Seguro da AXA Corporate Solutions - Apólice nº XFR0078449GP O que está incluído na cobertura? No âmbito desta proteção poderá reclamar o valor de algumas destas possíveis consequências resultantes da Sua morte, de danos corporais, de danos materiais ou da perda dos seus objetos de uso pessoal na sequência de uma colisão que ocorra quando estiver a conduzir o Veículo: ● O pagamento de um valor fixo até ao montante máximo de €200,000 no caso da Sua morte (ou presunção de morte), no prazo de 24 meses a contar da data da colisão ou do incidente; ou no caso de ficar definitivamente incapaz, total ou parcialmente, em consequência da colisão ou do incidente; O pagamento de despesas médicas até ao montante máximo de €10,000 (inclui hospitalização, consultas e medicamentos; raios X e exames médicos relevantes; tratamentos ou próteses dentárias) cuja necessidade tenha decorrido da colisão ou do incidente. Esta Super-Proteção Acidentes Pessoais não cobre: ● ● ● quaisquer valores acima indicados no caso de tais despesas não terem sido incorridas como resultado direto da colisão ou do incidente que ocorreu enquanto tinha o controlo do Veículo, ou se intencionalmente causou ou deu origem ao acidente ou à colisão ; ou quaisquer valores relacionados com tratamentos que estivesse a receber ou com problemas médicos que estivesse a sofrer antes da ocorrência do acidente ou do incidente; ou o valor da perda, da destruição ou dos danos da sua bagagem se for: Danos causados por desgaste natural, depreciação ou defeitos originários da bagagem; Danos causados por traças ou bicharada ou métodos de limpeza, reparação ou restauro ou mau tratamento da bagagem por ação do condutor; Danos resultados pelo confisco, penhora ou destruição, ordenados por uma autoridade administrativa ou judicial; Roubada na sequência de não ter fechado e trancado o Veículo; Roubada na sequência de intrusões no Veículo pelo compartimento dos passageiros em veículos abertos ou convertíveis. Contudo, a cobertura aplica-se se a bagagem estiver situada na bagagageira de tais veículos, desde que a mesma esteja trancada e seja inacessível por dentro do veículo. ❍ ❍ ❍ ❍ ❍ ❍ ● A Bagagem seguinte não está coberta: Dentaduras, olhos artificiais e outras próteses, óculos e lentes de contato. Jóias, peles e outros objetos de valor deixados em Veículo não vigiado a qualquer momento. In case of a contradiction between the document above listed, the terms of the first document will prevail over the following document. 1) TO WHOM DO THE RENTAL TERMS AND CONDITIONS APPLY? The T&Cs will apply to You, the person who is paying for the rental and any associated costs (and You may also be a driver), as well as any (other) driver who is expressly indicated in the Rental Agreement and therefore being authorised to drive the Vehicle. All persons named in the Rental agreement are jointly and severally liable for payment of sums due under the contract. 2) WHO CAN RENT AND WHO CAN DRIVE? a) Who can rent? Any physical person: ● ● who is legally capable of entering into an agreement with InterRent and is prepared to accept responsibility for the Vehicle throughout the Hire Period; and who has the means that will be accepted by the relevant local InterRent company (see table below) to pay for the hire of the Vehicle and any associated costs; And ● who provides valid identification documents as indicated in the table below. *Only for new clients, to confirm the surname, name and address used during the booking process b) Who can drive? (the “Driver") An authorized Driver of a Vehicle will be any physical person who complies with all of the following requirements: ● ● ● is expressly mentioned and fully identified on the Rental Agreement (and this may also be the person who will pay the Rental Agreement) provides a valid driver license and/or a valid identification document (national ID card or passport); holds a valid driver license for a period which varies according to the category of vehicle and the applicable law in the country of rental, and/or the driver’s age. c) Who cannot drive the Vehicle? Neither person expressly mentioned / identified on the Rental Agreement is authorized to drive the Vehicle. In addition, any person who cannot provide valid identification documents as indicated in the sections 2 a) and 2 b). If You allow an unauthorized person to drive the Vehicle then this is considered as a breach of the T&Cs and You will be responsible for any consequences that may arise as a result included the possibility to responding before InterRent for the damages caused by you and/or an unauthorized person. In such circumstances the unauthorized driver will not be covered by any insurance or protection products offered through InterRent. Only liability insurance (compulsory protection) will apply. 3) WHERE CAN I DRIVE THE VEHICLE? You can drive a Vehicle in the Portuguese continental territory only (“Territory”). If You and/or any Driver intend to drive at your/her/his own risk the Vehicle in Spain, except islands, Ceuta and Melilla enclave, then: ● ● You and/or the Driver must obtain InterRent’s prior written consent and shall subscribe the cross-border protection (please refer to the Recommended Tariffs Guide). You should warn the InterRent agent and ensure together, during the check-out that, the Vehicle has the proper equipment in accordance with local traffic rules of the country that You and / or the Driver will drive or cross. Please be aware that You must comply with traffic road regulations in the country where You drive the Vehicle. 4) WHAT TYPE OF VEHICLE CAN BE RENTED AND FOR WHAT PURPOSE? You can rent a passenger car, and You must drive the Vehicle in accordance with its intended use as follows: the passenger cars are intended for the carriage of varying numbers of people (depending on the approval resulting on the vehicle registration certificate). You are informed that InterRent does not cover the goods carried into the vehicles and cannot be held liable for eventual property and/or objects You may have forgotten into the Vehicle. Similarly, InterRent cannot be held liable for any loss of opportunity and intervening operating loss in the context of the execution of the lease. 5) WHAT ARE MY OBLIGATIONS TOWARD THE VEHICLE? When renting a Vehicle from InterRent, You and/or any Driver must comply with the following obligations: ● ● ● ● ● ● You and/or any Driver must return the Vehicle and its keys, accessories and documentation to InterRent at the return station mentioned in the Rental Agreement on the expiry time and date specified on the Rental Agreement (The rental period is calculated per 24 hours non divisible from the time of pick-up of the Vehicle. InterRent allows a 29 minutes tolerance period at the end of the rental) and in the condition that InterRent provided it to You at the start of the Hire Period. If You do not return the Vehicle as stipulated here above, InterRent will take all necessary measures outlined in these Terms and in particular Article 11 (What is the Vehicle return policy). You and/or the Driver must reasonably drive the Vehicle in accordance with all applicable road traffic laws and regulations and You should ensure You and/or any Drivers are familiar with all relevant local driving regulations. You and/or any Driver must ensure that any luggage or goods transported in the Vehicle are secured to the extent will not cause damage to the Vehicle or cause risk to any passengers. You and / or any Driver must guard the Vehicle with the utmost care as a good father, and in all circumstances, You shall make sure it is closed and protected by its anti-theft devices when parked or left unattended. You and/or any Driver must never drive the Vehicle whilst under the influence of alcohol, hallucinatory drugs, narcotics, barbiturates, other illegal drugs or any other substance (whether legal or illegal) that is liable to impair either Yours and/or any Driver’s driving ability. You and/or any Driver You must refill the vehicle with the appropriate type of fuel. If unsuitable fuel should be added, unless You demonstrate that the mistake is attributable to a third-party; You will be responsible for any expenses incurred by the transfer of the Vehicle and/or repair of the Damage caused to it calculated according to the rules described in the section below (Damage to the Vehicle). ● You and/or any Driver may not use the Vehicle nor allow the Vehicle to be used: for rehire, mortgage, pawn, sell or in any way pledge not only the Vehicle or any part of the same but, the Rental Agreement, the keys, the documentations, the equipment, the tools and/or any of its accessories, for carrying passengers for hire or reward (for instance for car sharing purpose), unless otherwise expressly agreed by InterRent, to carry a number of persons in excess of that mentioned on the Vehicle's registration certificate, for carrying inflammable and/or dangerous merchandise, toxic, harmful and/or radioactive products or those that infringe current legal provisions (provided that such exclusion does not prohibit You from satisfying the needs of everyday life which do not infringe the applicable laws and whose transportation would correspond to a normal use of the rented Vehicle); for the transport of merchandise with a weight, quantity and/or volume in excess of what is authorised in the vehicle’s Traffic Circulation Permit and/or Technical Inspection Sheet, for racing, off-roading, reliability trials, speed testing or to take part in rallies, contests, or trials, wherever they are located, official or not, for transporting live animals (with the exception of pets and/or domestic animals, subject to InterRent express written authorisation), to give driving lessons, accompanied driving (“conduite accompagnée”) to push or tow another vehicle or trailer (except where the Vehicle You are renting is already fitted with a tow-hook when the maximum load complies with the applicable law), on gravel roads or roads which the surface, size or state of repair poses risks to the Vehicle, as beach, impassable roads, forest roads, mountains, etc. or any roads that are not authorized and paved roads, except special dispensation given in writing by InterRent, to commit an intentional offence, for being transported on board any type of boat, ship, train, lorry or aeroplane unless express written authorisation given by InterRent, Inside the no-traffic lanes of the ports, airports, and/or aerodromes and/or analogous or similar of a character not accessible to public traffic, or in refinery and oil company premises or installations without InterRent express written authorisation. If InterRent grants our consents to You in accordance with the above, InterRent will inform You of the third party insurance cover that may be applicable in this case and which will vary depending on the circumstances. During the rental, You must take all necessary protective measures to keep the Vehicle in the same condition as that in which You have taken possession. In particular, you and/or the Driver are required to perform customary inspections as to the Vehicle condition such as oil and water level, tyre pressure. ❍ ❍ ❍ ❍ ❍ ❍ ❍ ❍ ❍ ❍ ❍ ❍ ❍ ● You can be held liable to InterRent for any detrimental consequence arising out of any infringement to the above mentioned obligations. Please be aware that failing to fulfil the above mentioned obligations may limit any right to compensation for the damage which You could claim for. Likewise, in case of infringement to the above mentioned obligations, InterRent reserves the right to demand immediate return of the Vehicle. 6) WHAT ARE THE MOBILITY SERVICES INCLUDED IF I RENT A VEHICLE ONLY? The basic rental charge includes the following mobility services: *You may find the description of this service in Appendix I 7) WHAT ARE THE OTHER MOBILITY SERVICES NOT INCLUDED IN MY RENTAL? InterRent proposes You several additional services as follows: * You may find the description of this service in Appendix 8) WHAT IS INCLUDED IN THE PRICE YOU PAY? The information You provide InterRent with at the time of booking (such as the duration of the rental or Your age or any additional driver’s age) will have an impact on the price You will pay. Any change to that information could therefore mean that the price also changes. The price of Your rental will be those in force at the time of booking or at the time You make any subsequent changes to the booking. The price You will pay comprises the following costs: ● ● ● ● ● The daily rental charge for the Vehicle for the agreed number of calendar days, calculated on the basis of 24 hour periods (this will include the standard mobility services above mentioned) Any additional fees for extra mileage, Any other mobility services You choose to add at Your further cost VAT Any additional fees that are linked to You personally (for example: Your age (if You are a young driver…). By contracting with InterRent, You expressly allow InterRent to charge Your means of payment for any unpaid amount related to Your rental. In this regard, Your express consent will be given at the InterRent station when you will provide our agent with your mean of payment before picking up the Vehicle. 9) WHAT ARE THE OTHER FEES / CHARGES THAT I MAY HAVE TO PAY? ● ● ● The Deposit. In addition to the rental price (that You have prepaid during the booking or that You will pay at the pick-up time or at the check-in) InterRent is requiring You to leave a deposit. The deposit takes the form of a bank pre-authorization. If you have booked your Vehicle by remote means of communication (website, mobile application or phone), the deposit amount is recalled in the confirmation email that You will have received following your booking. In any case, the deposit amount will be reminded at the InterRent station. The deposit amount is determined by the category of vehicle You are renting from InterRent. Should You need any additional information regarding the deposit, please refer to the paragraph 19 Must i pay a deposit before picking up the Vehicle?) InterRent may also charge You for various charges and fees that InterRent will have to apply relating to incidents that may have occurred during the Hire Period and/or how You used the Vehicle. The prices (inclusive of VAT) of these charges and fees are listed in the Recommended Tariffs Guide available from InterRent station and/or on the InterRent website. Such charges and fees include without limitation: Administration fees for handling fines or tolls, up to the amount of Eur 30,00 per file. Please note that such administration fees are payable in addition to the fine or toll to which it relates ❍ ❍ ❍ ❍ ❍ ❍ ❍ ❍ and You are fully liable to pay such fines or tolls Administration fees for handling damages up to Eur 36,00, Cleaning fees for a Vehicle returned in an unacceptable and/or dirty state Charges for lost, damaged or stolen keys “Damage” to the Vehicle (any physical damage to the Vehicle or vandalism apart from glass breakage or puncture) and / or “Theft of the Vehicle” (theft of the Vehicle itself or of accessories and / or attempted theft of the Vehicle or any accessories). Your liability for this can be limited according to the type of protection You have elected to take out (please refer to the InterRent Insurance and Protection Provisions attached to Your confirmation email or available from InterRent stations and/or on the InterRent website) All and any fuel used during the Hire Period and a potential refuelling service charge; Additional mileage over and above the mileage that is included in the rental charge (if any) [not applicable for unlimited mileage rental]. The following additional specific fees and charges (i) pick-ups and drop offs at the airport or railway stations; (ii) the cost to return the Vehicle to a InterRent stations other than the one from which You picked it up; (iii) the extension of Your rental) and (iv) fees that may apply in case of assistance due to Your fault (accident, lost keys, wrong fuel) unless You demonstrate the liability and the responsibility for the repair by an identified third party. 10) WHAT SHOULD I PAY ATTENTION TO WHEN PICKING UP THE VEHICULE? When You pick up the Vehicle from InterRent You will be asked to sign among the others a section on the Rental Agreement that describes the Vehicle’s condition at that particular time. If You notice any apparent defect or Damage that is not described on the Rental Agreement then You should ensure a note is made on the document and that both You and the InterRent agent sign the change to it. [UK also gives 24 hours following time of pick up for the customer to report damage not noted on RA]. Failure to request the above mentioned notice for this additional apparent defect or Damage, InterRent is entitled to assume that You have accepted the Vehicle in the condition set out on the Rental Agreement and to charge You for any new Damage that could be noted by You and the InterRent agent when the Vehicle is inspected by both parties at the time of its return. 11) WHAT PROCEDURES ARE BEING APPLIED WHEN RETURNING THE VEHICLE? a) Return of the Vehicle during opening hours of InterRent’s station You should return the Vehicle to the InterRent station, at the latest, on the date and at the time shown on the Rental Agreement. You may return the Vehicle to another InterRent station for the cost mentioned on the Recommended Tariff document attached to your confirmation e-mail if you made the reservation through distance means. This document may also be consulted on spot in stations and/or on InterRent website. The Hire Period will end when You return the Vehicle to the InterRent station and hand the Vehicle keys and the registration documents to a InterRent agent or its representative. Any return of the Vehicle at an earliest stage than the date and time mentioned on the Rental Agreement shall not give rise to any reimbursement When You do return the Vehicle to InterRent You must take the opportunity to inspect the Vehicle together with the InterRent agent or its representative and countersign a Vehicle restitution damage report. InterRent shall give You a signed document where InterRent declares that the Vehicle was regularly returned to InterRent. InterRent cannot be held liable for eventual property and/or objects You may have forgotten in the Vehicle. b) “Out-of-hours” return Service InterRent recommends to return the Vehicle during opening hours of its stations. However, to meet the specific needs of some of its clients, InterRent offers, in certain stations, an additional “out-of-hours” service If You opt for this “out of hours” service, You accept that the Vehicle condition report can be drawn by the InterRent agent or its representative without your presence and after the drop off the keys. In stations offering “out of hours” return services, the above-described procedure (see point 11)-a)) was adapted to enable these stations to offer this service in the best possible conditions. In particular, You are to declare any incident and/or Damage that affects the conditions of the Vehicle on the document that will have been hand in to You to that matter when You picked up the Vehicle. Depending on the available systems and the information that You will have received from InterRent, this document must be leaved into the Vehicle or returned with the keys in the “keys drop off box” provided for that effect. Please note that your Rental Agreement does not automatically ends when You drop off the keys: the Vehicle will remain on the parking space where You will have parked it until opening of the InterRent station that will proceed to the inspection of the Vehicle and close your Rental Agreement. Therefore, InterRent reminds you that you must park the Vehicle on an area provided for that purpose and in a manner so that the Vehicle is not a danger to others or hamper traffic as aimed by the Highway Code. You must also leave the Vehicle registration papers in the glove box. Providing that the Vehicle is inspected at a later stage – during opening hours of the station – InterRent recommends You to take photographs of the Vehicle in order to keep evidences of the state of return of the Vehicle once it is parked and before the drop off of the keys. Once the inspection is made and in the absence of damage, InterRent will send You a signed document where it will declared that the Vehicle has been regularly returned. InterRent cannot be held liable for eventual property and/or objects You may have forgotten in the Vehicle. c) Return of the Vehicle without your presence and during opening hours of InterRent station. If you are unable and/or refuse to inspect the Vehicle together with the InterRent agent or its representative, InterRent is authorised to inspect the Vehicle itself without your presence and to register your refusal of a contradictory inventory. The same Procedure as the one described above will applied (See 11°-b)). d) Late return of the Vehicle In the event that the Vehicle is not returned on the date shown on the Rental Agreement, and if a period of 24 hour elapses without there being any news regarding the delay in its return, InterRent is entitled to: ● ● ● regard the Vehicle as having been unlawfully appropriated and shall report this to the competent local authorities; Charge You the rental charge for each day that You keep the Vehicle beyond the expiry time and date, plus a compensation equal to twice the payable amount, unless You can demonstrate that You have no longer the disposal of the Vehicle through no fault of your own or that the non restitution of the Vehicle resulted through no fault of Your own; claim to You all the damages and losses suffered by Europcar and all the fines, tolls, penalties or sanctions that falls on the Vehicle as a result of demands issued to it by public administrations for the purpose of identifying the perpetrator or clarifying other circumstances relating to a breach or criminal offence; ● Start legal proceedings in order to claim the immediate return of the Vehicle. Please note that, in such case, protections and additional contractual services would have no effect. 12) DAMAGES TO THE VEHICLE In case of differences between the state of the Vehicle as described upon check out and the one identified upon return, You may pay the amount as defined below. a) Damages identified upon return of the Vehicle and in your presence If some damages are identified upon return of the Vehicle when the inspection made, in your presence and in the presence of the InterRent agent or its representative, and if You acknowledge the damages by signing the statement of return of the Vehicle, InterRent will hand in to You an assessment of repair costs that may be charged to You. Repair costs vary depending if it is qualified as a Light Damage or not: ❍ ❍ Light Damage (minor insubstantial damage caused to the Vehicle without altering its delivery to the rental and permitting its movement in accordance with the provisions of the Highway Code such as, for instance, without being exhaustive: scratches; light impacts on windshield, scratches on bumpers) is charged according to the Recommended InterRent price list available in any InterRent station. Any other damage not included in the above mentioned Recommended price list and/or other more Serious Damage (substantial Damage impairing the delivery of the Vehicle rentals and requiring its temporary immobilization for repair such as, for instance, without being exhaustive: damages bodywork) will be evaluated by an independent expert and charged according to the expert’s report or a cost estimation made with an independent auto-repair garage. If You contest Damages and their invoicing by refusing to sign the statement of return of the Vehicle, InterRent will apply the procedure described below (see article 12)-b). b) Damages identified in case of an out-of-hours return and without your presence. If Damages are identified during the inspection of the Vehicle by an InterRent Agent or its representative without your presence, InterRent will send to you the following documents: ❍ ❍ ❍ statement of return of the Vehicle describing all Damages identified pictures of Damages An estimate (quote) of the costs of repair that will vary depending of the nature of the Damage (see above, article 12)-a) paragraph 2) and administration fees for the treatment of the Damage and the Vehicle immobilisation. You will be able to challenge Damages identified and their invoicing within 14 days after the sending (by e-mail or regular letter) of the documents, at the following address: [email protected] or Apartado 8332, Cabo Ruivo, 1804 – 001 Lisboa. If You fail challenging or justifying within the above mentioned period of 14 days, InterRent reserves the right to invoice You the cost of repair identified. c) Common rules Please note that depending upon the Damage suffered by the Vehicle and the type of protection You have subscribed to with InterRent. You may or may not be charged for the full or for the partial amount of the cost of repair. In any case, You will be able to challenge Damages and their invoicing by acting pursuant to dispositions of article 24. 13) WHAT IS EXPECTED OF ME REGARDING THE VEHICLE MAINTENANCE? During Your rental, You must take all necessary protective measures to keep the Vehicle in the same condition as that in which You have taken possession. You should remain alert to any signal from the warning lights on the Vehicle's dashboard and take any necessary protective actions. Any modification to or mechanical interventions on the Vehicle are forbidden without InterRent’s prior written authorisation. Should this rule be breached, You must bear the duly justified costs of restoring the Vehicle in the same state in which You have taken possession. You will be liable towards InterRent for any detrimental consequence arising out of any infringement to the abovementioned maintenance obligations. 14) WHAT SHOULD I DO IN CASE OF ACCIDENT, MECHANICAL BREAKDOWN, OR THEFT OF THE VEHICLE? ● ● In case of mechanical breakdown or accident which prevents You from continuing your travel and/or obliges you to stop Vehicle to prevent any breakdown, You are provided with an assistance service, included in the price of Your rental. The terms of this assistance are set out in Appendix 1 of the present T&Cs. In case of accident, as soon as You will have been aware or You will have the capability and within five (5) business days at the latest, You shall (i) report the accident to the InterRent pick-up station (or the assistance service) and call the local police authorities and (ii) file an amicable declaration of motor vehicle accident. In those cases, You should call the assistance service number that is displayed inside the windshield of the Vehicle. ● In case of theft of the Vehicle, You shall provide InterRent with a copy of the report of theft filed before the local police authorities within two (2) business days with the keys and official papers of the Vehicle if those have not been stolen. The abovementioned policy is applicable in the agreed territories between You and InterRent. 15) WHEN SHALL I RECEIVE MY INVOICE AND PAY FOR THE RENTAL? You will receive a final invoice once all elements of Your rental have been settled and no earlier than the day after the Vehicle return date. You will pay or be charged the full amount in one or in several lots depending on the situation. ❍ You may prepay (prepayment of your booking made online, via our call center or at the InterRent station) Your rental including the daily rental charge of the Vehicle and accessories for the Hire Period and for any additional mobility services. Your means of payment will be debited by the agreed amount. If you decide to select additional mobility services, Your mean of payment will be charged for this additional cost at check-out time. Any additional fees or charges arising from the rental will be deducted from the deposit when You return the Vehicle (if they can be calculated at that time). InterRent will then issue an invoice for your rental including all the mobility services selected by You and the additional fees and charges identified at check-in. If You have incurred extra costs such as fine or caused Damages to the Vehicle identified without your presence, these costs and the applicable administration fees at a later date, all these administrative fees (damage management fees, fines administrative fees), when InterRent becomes aware of them. In this respect, You will have a fourteen (14) days period starting from the date of sending (by email or regular letter) of the notification of billing to challenge and justify not being the author of the fees at the following address: [email protected] or Apartado 8332, Cabo Ruivo, 1804 – 001 Lisboa. In case of no objection or justification from You within the aforementioned period, the amount of these administrative fees will be charged Your invoice will be sent to You electronically. If You refuse to receive your final invoice electronically, You can elect to receive paper invoice. ❍ ❍ ❍ ❍ ● 16) WHAT IF I WANT TO CANCEL OR MODIFY MY BOOKING? a) Modifications You can modify Your booking, free of charge, provided You let InterRent know at least 2 hours before the rental is due to start. Please be aware that new rental prices may apply if You modify Your booking and You should always use the same communication channel that You used when booking the Vehicle in the first place. Alternatively, You can call our Call Centre on 21 940 77 90 (price of a local call). b) Cancellation You can cancel Your booking free of charge provided that You have given InterRent at least 2 hours’ notice before the rental is due to start. If You have not cancelled and fail to come to the InterRent station to pick up the Vehicle, the prepaid amount will be refunded less a “no show” fee of up to five (5) days of rental. For the purpose of this section, cancellation of the booking or failure to pick up the Vehicle due to Force Majeure means that You are prevented or delayed by reason of war and other hostilities civil commotion, accident, lock-outs, trade disputes acts, embargoes or restraints of governments restrictions of imports or exports or any other cause or circumstance beyond Your reasonable (direct or indirect) control. 17) WHAF IF I WANT TO EXTEND MY RENTAL AGREEMENT? In case You want to extend the Hire Period shown on Your Rental Agreement You should take the following steps: ● ● ● For any extension of less than 24 hours, give a call to the InterRent station of check-out or go to the InterRent station of check out to get InterRent prior approval for such extension. Sign a new Rental Agreement or an addendum to the initial Rental Agreement For any extension higher than 24 hours, You shall: carry out a check of the Vehicle together with a InterRent agent Pay the rental as well as any additional charges Sign a new Rental Agreement or an addendum to the initial Rental Agreement. ❍ ❍ ❍ If You don’t comply with the above mentioned conditions, the terms of the above section 11 d) “Late return of the Vehicle” will apply. 18) WHAT IS THE FUEL POLICY? You must be aware that rules applicable to fuelling and refuelling depend on the country of rental and the type of rental product You have elected. Please check carefully the rules applicable for every rental You make. All Vehicles are supplied with a full tank of fuel. At the return of the Vehicle, three (3) situations may then arise: 1) ● ● ● Return of the Vehicle with the same level of fuel tank: We provide You with a Vehicle with a full tank of fuel of a determined level of fuel mentioned in the Rental Agreement. You return the Vehicle with an identical level of fuel. You pay nothing for either refuelling charge or fuel. Please note that InterRent may require you to provide a proof of fuel purchase (receipt). 2) Return of the Vehicle with a different level of fuel tank than the level of fuel tank mentioned at pick-up time (Refuelling charge): ● If You have not taken up the full tank option and the Vehicle is not returned with the same level of fuel to the one identified at pick-up time, You will be charged the cost of the missing fuel plus a refuelling charge (please refer to the Recommended Tariff Guide attached to Your confirmation email and available from InterRent stations and/or on the InterRent website). 3) ● ● ● Full Tank Option At pick up You have the possibility to pay for the price of a full tank of fuel. The cost of this will depend on the Vehicle rented. You may return the Vehicle with whatever fuel is left in it. Whilst InterRent will not charge You for any refuelling charge InterRent will not reimburse You for any unused fuel. 19) MUST I PAY A DEPOSIT BEFORE PICKING UP THE VEHICLE? When You pick up the Vehicle, You grant a credit card authorization for a deposit. The amount of the deposit takes into account the category of Vehicle. The deposit is intended to cover additional rental costs and/or all the additional products and/or mobility services that you will have selected at the pick-up of the Vehicle. The rule of calculation applied to determine the deposit amount is explained on the InterRent website in a dedicated section and might be clarified at the counter. In any case, its definitive amount is specified in the confirmation email sent to You at the time of your booking and in the Rental Agreement. The deposit will be refunded if no additional costs are identified upon return within the period agreed between You and Your bank. The deposit shall be executed by You or any authorized driver and You shall use the same credit card that was used by You at the time of the booking. 20) CAN I PAY MY RENTAL WITH A FOREIGN CREDIT CARD? If You are a foreign hirer holding a Visa or MasterCard credit card (with a base currency other than the Euro) You will pay in the currency of the country of rental. 21) What are our optional contractual protection ? 1) Damage and/or Theft waiver terms To bring down Your liability to the level of the non-waivable Excess, the contractual protection to cover Damage and Theft of the rental Vehicle (CDW/TP/TW) is already included in our rates. You also have the possibility of subscribing to additional optional protection covering Damage and Theft, which enable You to reduce or to suppress the amount of the Non-Waivable Excess or, depending on the type of Vehicle, eliminate it completely. These additional protections are duly explained in the Appendix 2 which details their nature, scope and applicable conditions, in particular the Excess amounts. The above-mentioned protections are taken out at the start of the rental against payment of a fixed fee per rental day and this is confirmed by the corresponding abbreviation being present or ticked on the Rental Agreement, as well as an indication of any applicable residual excess. These protections, even if they provide for a total elimination of the excess, do not cover Damage to the upper bodywork, or to the under-body, nor if there is invalidation of covers, in accordance with the terms of Article 21) § 2) below, which remain fully applicable. No protection is provided in respect of Damage to or Theft of goods carried in the Vehicle. Depending on the level of protection taken out, You may be charged for each damage event with the Non-Waivable Excess or Reduced Non-Waivable Excess, the level of which varies according to the Vehicle category and is indicated on the Rental Agreement at the start of your rental and in the Appendix 2 of these Terms and Conditions of Hire. If the Damage amount incurred by the company is lower than the excess, You will be charged the lower of the two. If You bear no responsibility whatsoever, and upon refund from the liable third party, the amount charged will be refunded to You in full. 2) Exclusion of protection: The collision damage or theft waivers for the Vehicle are only available for the Driver expressly mentioned in the Rental Agreement. If You allow an unauthorized person to drive the Vehicle, You will be responsible for any consequences that may arise as a result included the possibility to responding before InterRent for the damages caused by you and/or an unauthorized person. In such circumstances the unauthorized driver will not be covered by any insurance or protection products offered through InterRent. Only liability insurance (compulsory protection) will apply. Please refer to Appendix 2 of these T&C. 3) Insurance / Assistance All our Vehicles are covered by a Third Party Liability policy, in accordance with the regulations in force, taken out with AIG Europe Limited. They are also covered by a roadside assistance contract. You may also take out optional driver, passenger and personal effects protection. The conditions and limits of the obligatory or optional insurance policies, of the contractual covers, and those of the assistance contract are set out in Appendix 2. 22) WHAT IS INTERRENT DOING TO PROTECT MY PERSONAL DATA? InterRent may use any information You have given InterRent, including the details of any named driver, for the purposes of Your rental to verify identity, collect payment, monitor fraud and deal with any issues before, during and after the Hire Period. Our data protection policy is available from: InterRent Privacy Policy. InterRent may give the personal details on the Rental Agreement, and details of Your performance of obligations under this Rental Agreement, to third entities, such as the police authorities, for collecting tolls, debt collectors (including solicitors) and any other relevant organisation. In case of lack of payment, InterRent may also, with your express consent given in the end of these T&C’s, give the personal details to the ARAC – Associação dos Industriais de Aluguer de Automóveis Sem Condutor (“ARAC”)], in order to include them in their defaulting customer’s database who may pass the details on to any of its members to help such members decide whether they will accept You or any named driver as a customer. Please note that the conclusion of the Rental Agreement is not dependent on Your consent to the use, in any form, of your personal details in the defaulting customers databases or to the communication of the personal data collected under this Agreement to ARAC. InterRent collects and processes data in order to provide You with vehicles rental services and for marketing purposes such as special promotions and loyalty program. You are informed of any information that must be collected by InterRent whether in station or via an asterisk online. The recipients of such data are only companies that are part of the InterRent Group as well as franchisees. Some of the recipients of the collected data may be located in countries where legislation concerning personal data does not provide a sufficient level of protection equivalent to Portuguese law standards and the Portuguese Data Protection Authority rules [CNPD]. However this transfer of data to a country with an insufficient level of protection is made only if you rent a Vehicle in a country operated a InterRent Group franchisees located outside of the European Union. As it is required for the performance of Your Rental Agreement, this transfer is authorized in accordance with article 19º of the Law nº 67/98, of 26th of October. Based on this You have a right to access, rectify and delete data concerning You. You may perform his right at the following e-mail address: [email protected] or sending it to Apartado 8332, Cabo Ruivo, 1804-001 Lisboa. You are made aware of the existence of data processing aiming at preventing risks, which enables InterRent to decline vehicles rental services to any person listed in the file “Management of the person subject to risk”. You are made aware that Your personal data may be notified to the police authorities at their request in case of any traffic road offence and/or any crime committed during Your rental. By accepting the present T&Cs, You expressly acknowledge having granted your explicit consent with the abovementioned InterRent privacy policy. 23) ARE THE VEHICLES EQUIPPED WITH A TRACKER? To maintain and protect the Vehicle and to prevent and detect crime InterRent may use electronic devices to monitor the condition, performance and operation of the Vehicle and/ or to track the Vehicle’s movements. This information may be used both during and after termination of the Rental Period. In accordance with the provisions of the Portuguese Data Protection legislation, You have a right to access, rectify and delete data concerning You. You may perform this right by sending InterRent a letter at the following address: Apartado 8332, Cabo Ruivo, 1804-001 Lisboa or an e-mail to [email protected] . The Vehicle may be equipped with an electronic toll device that permits to determine the toll fees’ amount, therefore You have to ensure its proper operation and maintenance and InterRent may charge You for its disappearance or damage. 24) WHAT HAPPENS IN CASE OF DISPUTE RELATED TO MY RENTAL? a) Applicable law In case of dispute between You and InterRent regarding Your rental, the applicable law will be the law of the country of the pick-up of the Vehicle. For instance, if You are a Portuguese citizen and You pick up the Vehicle in Portugal, the applicable law will be the Portuguese law. However, if You hired a Vehicle whilst in Germany then Your rental will be subject to the German law. b)Customer Relation Service Wherever Your rental took place You can choose to consult with the Customer Services department in Your country of residence. Your Customer Services team will contact the country of rent on Your behalf and try to resolve Your query. You can contact Customer Services at the following address: [email protected] or Apartado 8332, Cabo Ruivo, 1804-001 Lisboa c)Notifications All notifications to be served upon You and InterRent pursuant to Your Rental Agreement shall be sent to the addresses indicated in the latter, that You and InterRent recognize as the elected domicile for all purposes and any modification must be communicated to the other party. The parties equate to the manuscript signature affixed on the document digitally or by any biometric, digital or electronic means the same probative force of a handwritten document d) Conciliation before ECRCS You may file a claim before the European Car Rental Conciliation Service (ECRCS) ( http://www.ecrcs.eu). Indeed, InterRent has subscribed to the scheme of ERCRS in order to enable its clients to solve their complaints concerning cross border vehicle rentals within Europe. It should be underlined that this conciliation service can only help with disputes involving a ‘cross-border’ rental transaction occurring within the European Union - You must be a resident of the EU and the rental must have taken place in a different EU country. If your complaint concerns a non-cross-border rental you should raise the matter ECRCS will not be able to look at your complaint. e) Contractual documents The binding documents between You and InterRent are, by order of priority, the following: - the Rental Agreement and its specific conditions (the document signed by You at the moment of the check-out or the first day of rental) - the confirmation email (where You have prebooked Your rental) - the Recommended Tariffs Guide; - the present T&Cs which apply to all aforementioned documents. 25) IS THERE A CODE OF CONDUCT APPLICABLE TO THE CAR RENTAL INDUSTRY? Leaseurope has published a code of conduct for the car rental industry. You may obtain a copy at the following address: www.leaseurope.org. [ ] I acknowledge that the vehicle may be equipped with a GPS that may be used in case of contractual infringement, theft or crossing of boarders. [] In case of non-compliance, I authorize my personal data to be communicated to ARAC, for inclusion in a database for non-compliant clients and subsequent communication to associate companies; [ ] I do not wish that my data to be disclosed to third entities for the purpose of direct marketing [ ] I have read and agreed on the T&C‘s. Date and signature APPENDIX 1 – ROADSIDE ASSISTANCE TERMS & CONDITIONS Note: IN THIS APPENDIX PRICES ARE INCLUSIVE OF VAT WHEN APPLICABLE For the duration of the rental, as agreed with InterRent, You have the benefit at no extra cost of a round-the-clock breakdown service linked to the use of the Vehicle. Please note that breakdowns or accidents caused by You or any driver or as a result of using the wrong fuel, breakage or loss of the rental Vehicle's keys, as well as punctures and/or damage to tyres are not coveredfrom the scope of the free service and will be subject to a flat charge: - Trailer: EUR 250 - Lost or broken keys: EUR 200 to 260 - Wrong fuel, but without mechanical or engine damage: EUR 250, not including the trailer (plus the missing fuel) - Puncture and/or damage to tyres: EUR 130 to 200 + administrative fee of EUR 36/per occurrence. The TechnicalAssistance service comprises, amongst other benefits: - Sending out a breakdown Vehicle: - Arranging and paying for the costs of towing a Vehicle which has been involved in an accident or has broken down and cannot be repaired on the spot; - Locating a replacement Vehicle within a radius of 50 Km, if the Vehicle cannot be repaired on the spot (N.B. The rental contract will continue to run until the last day of the rental as originally agreed); - Transportation of the beneficiaries to the rental station where the replacement Vehicle is to be made available; - If no replacement Vehicle can be identified; - Either a hotel room with breakfast for one night Or transportation by taxi or train to the domicile or destination in Portugal or to the point of departure from Portugal for non-residents. This benefit is provided up to 60 € per beneficiary. Exclusions - Any incidents or damage resulting from taking part in sporting events, rallies or any type of competition - Vans rented in Portugal which have been taken abroad. TOLL MANAGEMENT SERVICE You can acquire from InterRent the Toll Management Service, which ensures timely payment of the toll fees dues by You for the utilization of the Portuguese road infrastructures (motorways and bridges), solely including those which have a system of electronic toll collection. If You do not subscribe to the Toll Management Service, You undertake to pay on Your behalf or on the behalf of any other authorized driver, all and any toll fees and the respective administrative costs due for the utilization of the Vehicle to the competent Collecting Entities, during the term of the Rental Agreement, being liable for the consequences resulting from its infringement, namely an infringement punishable by a penalty pursuant to the terms of the law. Should You subscribe to the Toll Management Service, You authorize Europcar to pay the toll fees due to the competent Toll Collecting Entities for the utilization of the Vehicle during the term of the Rental Agreement and charge them on his credit card, together with the respective administrative costs. The referred charges may be effectuated until 30 days after the term of the Rental Agreement, should the toll fees be only made available in that term to Europcar. Should You subscribe the Toll Management Service and later refuse or prevent Europcar from anyhow receiving the payment corresponding to the toll fees or other associated costs, the latter shall be entitled to identify the driver of the Vehicle before the competent entities in accordance with the law and for the purposes of the respective collection process and infringement proceedings, being You liable for the amounts that InterRent or any other entity incur. APPENDIX 2 - INSURANCE AND PROTECTION TERMS AND CONDITIONS Insurance All the Vehicles belonging to InterRent's fleet are insured against bodily injury and property damage to third parties. InterRent is insured by AIG EUROPE Limited, whose head office is at Tour CHARTIS,92079 PARIS LA DEFENSE 2 (Policy No. 1.902.122). Bodily injury cover is granted for unlimited amounts and for up to 1,000,000 € for property damage. Protection included in your rental rate In accordance with the legal requirements applicable in the InterRent rental countries, all InterRent Vehicles benefit from Third Party Liability Insurance (TPLI), subscribed by InterRent with local “best in class” insurers, and which covers bodily harm and physical damage that You may cause to a third party as a result of an accident involving the Vehicle. The TPLI is always included in your pre-paid rental rate and no deductible (excess) shall apply for TPLI. Waivers included in your rental rate Collision Damage and Theft Waiver (CDW/TP/TW)”, which covers loss or damage to the Vehicle, including for Theft, attempted Theft or vandalism up to a certain amount, and subject to your payment of the non waivable excess, depending on the Vehicle category; and Please note that the above waivers only apply to the extent You comply, during your rental, with the Rental Terms and Condition, and in particular the rules concerning the use and maintenance of the Vehicle, and all applicable law and local traffic regulation when you are driving the Vehicle. Otherwise, You will be liable for the total amount of the claim in accordance with the Rental Terms and Conditions set out in your Rental Agreement. You can supplement the above coverage by buying the following optional insurances and waivers, subject to specific local requirements set out in the Annex herein and Rental Terms and Conditions. Should You want to buy such optional insurance, please report to the Annex herein where prices are listed per InterRent renting country. Exclusions You will be financially liable for the full cost of the damage if the damage is caused: ● ● ● ● by the wilful acts of the driver; or by an explosion or fire in or to the Vehicle because you are using it to the transport dangerous goods (dangerous goods being any product or substance that, due to its nature and/ or main characteristics, is reasonably considered to be dangerous and which, if not transported with appropriate caution and safety, could cause harm to the Vehicle, and to any Third Party within a reasonable distance of the Vehicle); or by your negligence (which is behaviour that falls below the standards expected of a reasonably sensible person in similar circumstances) or the negligence of your Passengers (for example a fire caused by the use or disposal of cigarettes or cigars); or if the keys are lost or stolen The product will not protect either you if: ● ● the Vehicle is stolen or damaged because of your negligence or more specifically (but without limitation) as a result of keys being left in the Vehicle whilst it is unattended, your failure to use the anti-theft system appropriately, any failure by you to return the keys to us or if you left the Vehicle unlocked when you weren’t using it; personal and / or work related goods or possessions and any goods being transported in or on the Vehicle are stolen or damaged. Optional protection “Personal Accident Insurance (PAI)”, which covers You and your passengers, subject to permitted number of occupants in the Vehicle, in the event of death or permanent disability, depending on the Vehicle category, and “Super Personal Accident Insurance (SPAI)”, which covers You and your passengers, subject to permitted number of occupants in the Vehicle, in the event of death or permanent disability and covers your baggage and/or personal effects for loss or damage, depending on the Vehicle category. Optional coverages ● ● ● ● “Super Cover” which reduces the non waivable excess, which applies in case of “CDW”, “TW/TP”, depending on the Vehicle category, and “Assistance Plus”, which allows You to reduce the extra charge of EUR 250 (VAT included) in case ofBreakdowns or accidents caused by the customer or as a result of using the wrong fuel,breakage or loss of the Vehicle's keys, as well as punctures and/or damage to tyres. “Peace of Mind”, whichallows You to drive and enjoy without worrying about the cost of damage to the Vehicle and the cost of assistance, by suppressing the non waivable excess, depending on the Vehicle category, which would otherwise apply in case of “CDW”, “TW/TP”, and the Roadside Assistance fee and Glass and Tyre Protection. “WWI” Glass and Tyre Protection: This covers glass breakage (damage of any type – other than sunroof and mirrors that caused intentionally by the Hirer – to the windscreen, side-,sliding- or rear-windows, as well a to lenses and lights regardless of any other accident) and punctures, subject to normal use. If the glass, lights and tyres are damaged as a result of a collision then the collision damage protection will apply instead of this product. “Family Package”: This package includes Peace of Mind Coverage, an additional driver and a toddler safety seat. “Premium Package”: This package includes Peace of Mind Coverage and Personal and Property Protection / SPAI. Please note that the above waivers only apply to the extent You comply, during your rental, with the Rental Terms and Condition, and in particular the rules concerning the use and maintenance of the Vehicle, and all applicable law and local traffic regulation when you are driving the Vehicle. You are not protected under this product against the financial liability for damage to the Vehicle if it arises because of wilful acts or negligence that you commit whilst using the Vehicle and which causes damage. Otherwise, You will be liable for the total amount of the claim in accordance with the Rental Terms and Conditions set out in your Rental Agreement. Optional additional insurances • PERSONAL ACCIDENT PROTECTION (PAI) InterRent is insured by: AXA Corporate Solutions, Policy nº XFR0078448GP What am I covered for? Under this protection product you can claim for the financial cost of any of the following potential consequences resulting from your death or injury in a collision that occurs when you are driving the Vehicle: ● ● ● ● a lump sum payment of up to a maximum of €50,000 in the event of your death (or presumption of death) within 24 months of the collision or incident; or if you ultimately remain partially or totally disabled from the consequences of the collision or incident; medical expenses of up to a maximum of €2,500(which includes hospitalisation, consultations and pharmaceutical costs; X-rays and relevant medical tests; dental treatment or any prosthetics) necessitated by the collision or incident. If you and / or your Passengers are victims of a collision during the rental period then, provided you have purchased the product (in which case the protection will apply to you and all passengers in the Vehicle), a claim can be made against it irrespective of who is at fault. As a result: ❍ ❍ ❍ Passengers, who are always considered as third party under the third party liability insurance regime, will be indemnified, regardless the liability of the driver, by the third party liability insurance, they can also collect the lump sum indemnity they are entitled to under the Personal Accident Protection product If you are not the cause of a collision whilst you are driving a Vehicle( an “non at fault” driver), you can cumulate the third party liability insurance compensation, with the the lump sum indemnity he is entitled to under the Personal Accident Protection product, If you are the cause of a collision whilst you are driving a Vehicle( an “at fault” driver) , you won’t benefit from a compensation from the third party liability insurance, but can collect collect the lump sum indemnity they are entitled to under the Personal Accident Protection product. What is (mainly) excluded from the cover? This Personal Accident protection does not cover: ● ● ● ● any of the costs set out above if the expense was not incurred as a direct result of the collision or incident occurring whilst you were in control of the Vehicle or if you intentionally caused or brought about the accident or collision; or any costs relating to treatment you were receiving or medical conditions you were suffering from before the accident or incident occurred; or any damage to or loss of your personal property or possessions; or any damage caused to the Vehicle What is the amount of my financial exposure? Provided you have not committed a breach of any applicable laws (including any relevant road traffic regulations and, in particular, relating to the wearing of seat belts and not exceeding the official passenger capacity of the vehicle – for instance if 7 people are injured in a 5 seater vehicle then the Personal Accident protection will simply not apply at all) then you will be entitled to the protection up to the indemnity limit shown above. However, if you didn’t comply with those laws and/or regulations then our insurer may refuse the cover altogether or, if it can be shown that you were partially responsible for the level of injury you suffered in the collision or incident, it may seek to reduce its liability for the costs. • SUPER PERSONAL ACCIDENT PROTECTION (SPAI) InterRent is insured by: AXA Corporate Solutions, Policy nº XFR0078449GP What am I covered for? Under this protection product you can claim for the financial cost of any of the following potential consequences resulting from your death or injury resulting from a collision that occurs when you are driving the Vehicle or damage to or loss of your personal effects: ● a lump sum payment of up to a maximum of €200,000 in the event of your death (or presumption of death) within 24 months of the collision or incident; or if you ultimately remain partially or totally disabled from the consequences of the collision or incident; medical expenses of up to a maximum of €10,000(which includes hospitalisation, consultations and pharmaceutical costs; X-rays and relevant medical tests; dental treatment or any prosthetics) necessitated by the collision or incident. ❍ ❍ ● ● Loss, damage, theft or destruction of your Baggages and the personal effects contained in them up to a maximum of €5,000 as a result of a collision or theft. If you and / or your Passengers are victims of a collision during the rental period then, provided you have purchased the product (in which case the protection will apply to you and all passengers in the Vehicle), a claim can be made against it irrespective of who is at fault. As a result: ❍ ❍ ❍ Passengers, who are always considered as third party under the third party liability insurance regime, will be indemnified for injuries, loss of or damage to personal property, regardless the liability of the driver, by the third party liability insurance, they can also collect the lump sum indemnity they are entitled to under the Super Personal Accident Protection product If you are not the cause of a collision whilst you are driving a Vehicle( an “non at fault” driver), you can cumulate the third party liability insurance compensation for injuries, loss of or damage to personal property, with the the lump sum indemnity he is entitled to under the Super Personal Accident Protection product, If you are the cause of a collision whilst you are driving a Vehicle( an “at fault” driver) , you won’t benefit from a compensation for injuries, loss of or damage to personal property, from the third party liability insurance, but can collect collect the lump sum indemnity they are entitled to under the Super Personal Accident Protection product What is (mainly) excluded from the cover? This Super Personal Accident protection does not cover: ● ● ● any of the costs set out above if the expense was not incurred as a direct result of the collision or incident occurring whilst you were in control of the Vehicle or if you intentionally caused or brought about the accident or collision; or any costs relating to treatment you were receiving or medical conditions you were suffering from before the accident or incident occurred; or the cost of loss, or destruction of or damage to your Baggage if it is Damage caused by normal wear and tear, depreciation and inherent defects in respect of the baggage. Damage caused by moths or vermin or methods of cleaning, repairing or restoring, or poor ❍ ❍ baggage handling through the action of the driver Damage resulting from confiscation, seizure or destruction by order of an administrative authority. Thefts committed when the doors, windows and boot of the vehicle were not locked shut. Thefts by break-in of the Vehicle situated in the passenger compartment of open or convertible vehicles. However, cover shall apply to the Vehicle if it is situated in the boot of the aforementioned vehicles, provided that the boot in question is locked and is inaccessible from the inside of the vehicle. The following Baggage’s are not covered: Dentures, artificial eyes and other prostheses, spectacles and contact lenses. Cash, personal papers, commercial documents, administrative documents, traveller's cheques, credit cards, air tickets, travel tickets and vouchers. Keys or others similar (magna cart etc.). Mobile phone. Jewels, furs and other objects of value left in an unattended Vehicle at any moment. Baggage, belongings and personal effects left in a parked vehicle between 22:00 and 06:00 hours. any damage caused to the Vehicle ❍ ❍ ❍ ❍ ● ● ● ● ● What is the amount of my financial exposure? Provided you have not committed a breach of any applicable laws (including any relevant road traffic regulations and, in particular, relating to the wearing of seat belts and not exceeding the official passenger capacity of the vehicle – for instance if 7 people are injured in a 5 seater vehicle then the Super Personal Accident protection will simply not apply at all) then you will be entitled to the protection up to the indemnity limit shown above.
