Association – and allied organizations repudiate
homophobic cuts in Federal Government AIDS prevention
campaign
On February 2nd, in Rio de Janeiro, Brazilian Health Minister launched the Ministry’s
2012 Carnival AIDS prevention campaign. According to Ministry information, the
campaign was to be aimed, on a priority basis, at young gay men, thus giving continuity
to the theme of the 2011 World Aids Day campaign in Brazil.
This initiative is justified by the high rates of HIV infection found among young gay
men aged 15 to 24. The Epidemiological Bulletin on AIDS released on November 28 th
2011 shows that the epidemic has increased in this population in recent years. Whereas
between 1998 and 2010 the percentage of cases in the heterosexual population aged 15
to 24 fell by 20.1%, there was an increase of 10.1% among gay men in the same age
group (Source: STD, AIDS and Viral Hepatitis Department - Ministry of Health).
It is important to note that Law No. 8080/90 (which regulates the Brazilian National
Health System – NHS) determines that the NHS must use epidemiological data as the
basis for “establishing priorities, allocating resources and programme directives”
(Article 7, clause VIII).
According to a report published by the Joint United Nations on HIV and AIDS UNAIDS (2006), the epidemic and the response to it have shown a direct relationship
between health protection and the protection of human rights or, inversely, a direct
relationship between the worst health indicators and human rights violations. From this
perspective it is possible to understand how the scenario of homophobia in Brazil,
demonstrated by various studies in recent years, has structured the increased
vulnerability of young gay men to the HIV/AIDS epidemic.
Several different UNAIDS guidelines point to the need to respond to the HIV epidemic
based on the epidemiological data (aiming actions at populations at increased risk of
infection). These include the document entitled “Getting to Zero: 2011-2015 Strategy”
which, among others, makes the following considerations:
Prevention programming also remains unacceptably low for people at higher
risk of infection, such as people who inject drugs, men who have sex with men,
transgender people and female, male and transgender sex workers and their
clients (p. 33, underline added).
There must be no more denial of the harmful social, sexual and gender norms
that drive vulnerability: the social exclusion of particular groups; the refusal to
admit the existence of men who have sex with men (p. 34, underline added).
Furthermore, in June 2011, the United Nations Member States, including Brazil,
applauded on that occasion, renewed their commitments to fighting the epidemic,
through a new Political Declaration on HIV/AIDS, establishing that by 2015 sexual
transmission of HIV will have been reduced by 50 per cent (item 62). The following
observation made in the Declaration is also of relevance:
29. Note that many national HIV prevention strategies inadequately focus on
populations that epidemiological evidence shows are at higher risk, specifically
men who have sex with men (underline added).
The Brazilian AIDS Programme has been considered to be a reference for the world, for
having focused its actions on human rights promotion and placing priority on
populations more vulnerable to and more affected by HIV infection.
Today, the Federal Government responds to the alarming increase in the number of
homophobia cases by cutting financial resources for policies in this area. The
committees and working groups set up by the Government to respond to homophobia
are being demobilized and underused. Existing channels of interlocution are proving
themselves to be inefficient and unproductive.
In the midst of this scenario, on February 2nd the Ministry of Health launched its 2012
Carnival AIDS prevention campaign. A Ministry of Health press release stated that all
the campaign materials were presented during the launch, which was publicized days
beforehand on the Department’s site http://www.Aids.gov.br/pagina/2012/50791.
According to the same source, the campaign was approved by the Social
Communication Secretariat (SECOM) of the Office of the President of the Republic.
Among the campaign pieces, three videos, featuring young gay men, trans persons and
straight people, respectively, formed part of the materials presented at the launch.
Shortly afterwards the videos were taken off the air. They were also removed from the
list of campaign materials available on the STD, Aids and Viral Hepatitis Department’s
website. Following questioning by several different organizations, including ABGLT
(Letter No. 018/2012), the Ministry of Health stated that the videos had been removed
for editing and that they would be made available later.
Following this, in a new statement contradicting the information publicized on February
2nd, the Ministry said that the videos presented during the campaign launch had not been
produced for broadcasting on TV and that a different campaign piece would be
produced for this purpose and would be broadcast on February 12 th.
The new video, already the object of a series of criticisms, features two young actors,
male and female, providing statistics on HIV/AIDS. This new material proves that
public health policies have also become the target of the moralist clean-up that is
becoming increasingly common in the Federal Government, which is bending under the
attacks of fundamentalist religion attacks that daily threaten the basic principle of the
secularity of the Brazilian State. Fundamentalist organizations have claimed
responsibility for the withdrawal and replacement of the campaign material.
In the face of these facts, the Government has opted to contradict itself or remain silent.
Attitudes like these are a constant feature of antidemocratic governments that neither
respect society nor the collective building of public policies. Omitting information,
denying and remaining silent are practices of conservative governments uncommitted to
social movements.
President Dilma does not meet with the LGBT Movement, but had already met twice
with fundamentalist parliamentarians. We recall the pledge she made in her speech
when taking up office: “There will be no discrimination, privileges or favouritism on
my part or on the part of my government”.
We do not want privileges or positions in government. We want public policies based
on the Federal Constitution that states that everyone is equal before the law without
distinction of any nature whatsoever, just as the Federal Supreme Court did on May 5 th
2011 when it recognized equal rights for LGBT people.
If the campaign was produced by the Ministry of Health and approved by the SECOM,
what made the Ministry of Health stop broadcasting it and produce new materials?
According the February 14th edition of the Folha de São Paulo newspaper, the veto
came from the Office of the President of the Republic.
President Dilma Rousseff has given no public explanation about the case.
The Ministry of Health has not publicized who was responsible for the changes to the
campaign or for the prohibition of the campaign pieces in question.
The Federal Government’s loyalty to the religious fundamentalists previously resulted
in the prohibition of the educational material produced by the Schools without
Homophobia project. At that time, the veto of the material was used in exchange for
shielding Minister Antônio Palocci. Who is being shielded now? Is this a new
agreement between the Office of the President of the Republic and the fundamentalist
group of parliamentarians in the National Congress? Since then the responsible
authorities have remained silent on the matter.
To this day the material has not been released for use, in any format whatsoever. We
demand the immediate release of these materials to combat the homophobia that
devastates our schools!
The guidelines for fighting homophobia discussed at the 2 nd National LGBT Conference
held in December 2011 urgently need to be put into practice. For this to happen, in
addition to budgetary resources, the political will and commitment of the Federal
Government will be necessary. If the interference of the religious fundamentalist
parliamentarians persists it will be impossible to make progress with the political
policies aimed at promoting LGBT rights.
We join forces with various other movements that question the form of governability
chosen by this Government. What kind of government exchanges the rights of segments
of its population in return for the support of religious fundamentalists? How many
Brazilian lesbians, gay men, bisexuals and trans persons will have to die victims of
homophobia and AIDS before this Government understands that governing with
religion violates constitutional rights and the secularity of the State, in addition to
causing increased violence against vulnerable populations.
The majority of leaders in the organized LGBT movement voted and worked for the
election of President Dilma Rousseff, in favour of the continuity of the policies
implemented under the Lula Government. So far any expectations of progress have been
thwarted.
ABGLT, the Brazilian Lesbian, Gay, Bisexual and Trans Association, expresses its
repudiation of the institutional homophobia that has manifested itself in certain actions
of the Federal Government and calls on all human rights organizations, its member
organizations and the organizers of Brazil’s more than 200 LGBT Pride Marches to
fight homophobia in Brazil.
ABGLT will take the necessary measures to denounce the influence of religious
fundamentalism on the Brazilian Government. We will refer the matter to the Federal
Public Prosecution service, the Organization of the American States and the United
Nations Organization, especially the Human Rights Council, as well as other
international bodies.
ABGLT also calls on the following organizations to manifest themselves formally: the
National Health Council; the National LGBT Council; the Brazilian Society of
Infectious Diseases; the Brazilian Society of Sexually Transmitted Diseases; the
Brazilian Law Society’s Sexual Diversity Commission; the Federal Council of
Psychology; the Federal Social Work Council; the Parliamentary Front for LGBT
Citizenship; the Parliamentary Front on HIV/AIDS; among other stakeholders in the
Brazilian social movement.
We hereby invite all those interested to take part in the 3 rd March against Homophobia,
in Brasília on May 16th, the theme of which is “Homophobia has a cure: education
and criminalization”, in front of the Ministry of Health, the Ministry of Education and
the President’s Office.
As a former Health Minister once said, “The Ministry of Health should take care of the
body. Religions should take care of the soul”.
