Nach Regel 102 Satz 1 EPÜ sind Entscheidungen der Beschwerdekammern
von dem Vorsitzenden der Beschwerdekammer und dem dafür zuständigen
Bediensteten der Geschäftsstelle der
Beschwerdekammer durch ihre Unterschrift oder andere geeignete Mittel als
authentisch zu bestätigen. Die Regel
lässt somit auch zu, dass eine Entscheidung durch elektronische Mittel als
authentisch bestätigt wird.
According to Rule 102, first sentence,
EPC, decisions of the boards of appeal
shall be authenticated by the Chairman
of the Board of Appeal and by the
competent employee of the registry of
the Board of Appeal, either by their
signature or by any other appropriate
means. This rule thus also allows for
authentication by electronic means.
Conformément à la règle 102, première
phrase CBE, les décisions des
chambres de recours sont authentifiées
par le président de la chambre de
recours et l'agent du greffe de ladite
chambre habilité à cet effet, soit par
leur signature, soit par tout autre moyen
approprié. Cette règle permet donc une
authentification par des moyens
électroniques.
In der Praxis werden Entscheidungen
der Beschwerdekammern zunehmend
durch elektronische Mittel anstatt durch
Unterschrift als authentisch bestätigt.
Wird eine Entscheidung elektronisch als
authentisch bestätigt, so erscheint die
Angabe "Entscheidung elektronisch als
authentisch bestätigt" direkt unter den
Namen des Vorsitzenden der
Beschwerdekammer und des dafür zuständigen Bediensteten der Geschäftsstelle der Beschwerdekammer.
In practice, decisions of the boards of
appeal are increasingly authenticated
by such electronic means, thereby
replacing authentication by signature.
Where a decision is authenticated
electronically, the indication "decision
electronically authenticated" will appear
directly below the names of the
Chairman of the Board of Appeal and of
the competent employee of the registry
of the Board of Appeal.
Dans la pratique, l'authentification des
décisions des chambres de recours par
ces moyens électroniques remplace de
plus en plus souvent l'authentification
par une signature. Lorsqu'une décision
est authentifiée électroniquement,
l'indication "décision authentifiée
électroniquement" apparaît juste audessous des noms du président de la
chambre de recours et de l'agent du
greffe de ladite chambre habilité à cet
effet.
