WHEREAS, November 15, 2012,
37th
marks
the
anniversary of the American Cancer
Society' s Great American Smokeout, a campaign designed to encourage tobacco users to
quit, on or before that day; and
WHEREAS, the City of Chino, in conjunction with community partners such as the
Healthy Chino Coalition, Chino Valley Unified School District, Chino Police
Department, Chino Experience Teen Center, and the Teen Advisory Committee, provides
programs that encourage young people to quit and/or not start smoking by promoting a
healthy lifestyle and educating the youth on the effects ofsmoking; and
WHEREAS, tobacco use is responsible for nearly I in 5 deaths in the US., which equals
about 443, 000 preventable deaths each year, and an average of smokers that die 13- 14
years earlier than non- smokers; yet more than 45 million Americans still continue to
smoke cigarettes; and
WHEREAS, each day, more than 3, 800 young people under the age of 18 smoke their
first cigarette and about 1, 000 of these young people begin smoking on a daily basis; and
WHEREAS, the City of Chino urges all tobacco users to demonstrate to themselves and
their loved ones that they can quit on or before the Great American Smokeout.
NOW, THEREFORE, I,DENNIS R. YATES, MAYOR OF THE CITY OF CHINO, do
hereby proclaim Thursday, November 15, 2012, as the
GREAT AMERICAN SMOKEOUT DAY
in the City of Chino, and in doing so support the American Cancer Society' s mission to
help create a world with less cancer and more birthdays.

WHEREAS, Champion Newspapers publishes two community newspapers which serve the Chino
Valley area; Chino Champion and the Chino Hills Champion are delivered by carriers and by mail to
subscribers and others
reaching over 90% of Chino Valley homes every Saturday morning; and
WHEREAS, the Champion is a Newspaper, which publishes local news, sports, entertainment and
other news items of interest to residents of the Chino Valley every week; and
WHEREAS, the Champion is a newspaper ofgeneral circulation publishing legal notices for the cities of
Chino and Chino Hills, the County of San Bernardino, the Chino Valley Unified School District and
fictitious business names for local businesses; and
WHEREAS, in several independent surveys, the Champion has been consistently ranked as the number
one source for news in Chino and Chino Hills. Total combined full-run circulation for both newspapers
averages 42, 258 weekly an estimated adult readership exceeds 90,000; and
WHEREAS, the Champion is the oldest continuously operated business in the Chino Valley. Richard
Gird, who also founded the City of Chino, founded the newspaper on November 11, 1887. Allen P.
McCombs, Chairman of Champion Publications of Chino, Inc. is the current owner and Publisher
Emeritus. He celebrated the 50th Anniversary of his purchase of the newspaper on October 1, 2006.

BACKGROUND
In accordance with Government Code Sections 53232. 2 and 53232. 3, implementing
Assembly Bill 1234 ( AB 1234) effective January 1, 2006, the City adopted Resolution
No. 2005- 093 relating to the
City' s
Business- Related Expense
Policy.
In addition to
requiring local agencies to adopt a business- related expense policy, AB 1234 requires
that Elected Officials provide a brief report on meetings attended at the expense of the
local agency at the next regular meeting of the legislative body.
ISSUES / ANALYSIS
In response to AB 1234, a report regarding Elected City Officials' Travel, Training, and
Meetings ( Exhibit A) was created and is placed on the City Council Agenda Consent
Calendar, as needed.

BACKGROUND
In an effort to reduce, if not, prevent injuries to Chino Police Department' s Motor Officers, we
are requesting to use asset forfeiture funds to purchase Air Mesh Kevlar motor pants and Air
Tech Touring motorcycle boots.
This equipment is abrasion resistant, provides impact
protection and the modern materials are breathable and provide ventilation.
This request was brought forward after receiving information regarding a local Motor Officer that
involved in a traffic collision while on duty.
The Motor Officer was broadsided in the
collision and then slid fifty feet on the asphalt.
The officer did not sustain any injuries to the
lower half of his body, which the Traffic Unit' s Sergeant attributed to the officer wearing Air
Mesh Kevlar motor pants.
Due to increased safety for Motor Officers, numerous Southern
California police agencies have been transitioning to these pants and boots.

BACKGROUND
The Chino Police Department honors the accomplishments of our personnel by listing the
recipients of
department
awards and special
recognitions on
perpetual
plaques.
The plaques
are a reminder to all personnel of our dedication to our community and profession.
The
current plaques are outdated and
in
need of repair.
Baxter' s Frame Works, a Chino based
company, has provided unique and quality craftsmanship with other Police Department framing
projects; therefore, we request their services for these plaques. The cost of award plaques for
law enforcement personnel is a permissible use of Federal Asset Forfeiture funds.
ISSUES/ ANALYSIS
The Chino Police Department proposes to use a portion of the Federal Asset Forfeiture funds to
replace these plaques and proposes to use Baxter' s Frame Works to make the new plaques.
During Fiscal Year 2012- 13, the combined total of purchase orders to Baxter' s Frames,
including the current request for $ 6, 400 totals $ 26, 257. 25. As these purchases exceed the
25, 000 limit to one vendor, approval by City Council is requested.

On October 2, 2012, the Chino Police Department received notification from the University of
California Berkeley Traffic Safety Center that the Department was awarded the 2013 Sobriety
Checkpoint Grant funds from the California Office of Traffic Safety. The Traffic Safety Center is
administering the funds for the Office of Traffic Safety. The grant period is October 1, 2012 to
September 30, 2013 and will cover the cost of conducting 12 sobriety checkpoints and the
purchase of Office of Traffic Safety approved checkpoint supplies.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF

AMENDING
CERTAIN
PROVISIONS TO TITLE 13 OF THE CHINO MUNICIPAL CODE
WHEREAS, there is a need to define repair and maintenance responsibilities for water
laterals, fire service laterals, and sewer laterals between the main lines in the public rights-
of-way and structures on real property adjoining the public rights- of-way.
NOW THEREFORE, the City Council of the City of Chino does hereby ordain as follows:
Section 1:
Section 13. 04. 010 is hereby amended to read as follows:
13. 04. 010 —Definitions.
For the purposes of this chapter, the following words and phrases shall have the meanings
respectively ascribed to them by this section:
A. " Developer"
means a person, requesting water service from the city regardless of
the number of services.
B. "
Engineering
department/ division"
means the engineering division of the public
works department or its designated representative.
C. "
Existing street" means a street which has been accepted as a part of the street
system of the city or the county as of January 1, 1963.
D. " Fire service lateral" means the portion of a fire service line that provides water
for fire fighting purposes to a parcel of land and/ or a structure on that parcel of
land, and is located between the structure and the water main line in the public
right- of-way.
E. " New street" means a street which has not been accepted as a part of the street
system of the city or county as of January 1, 1963.
F. " Water
department/division"
means the utility operation of the city or its
designated representative.
G. " Water lateral" means the portion of a water line that provides water to a parcel of
land and/ or a structure on that parcel of land, and is located between the
structure and
the
water meter at
the
edge of
the public
right- of- way.

Section 13. 04. 175 is hereby added to read as follows:
13. 04. 175— Maintenance —water and fire service laterals.
The owner of each parcel of land that is served by a water lateral or a fire service lateral
shall be responsible for the repair, maintenance, and replacement of those laterals.
Section 3:
Section 13. 08. 085 is hereby added to read as follows:
13. 08. 085 —Sewer Lateral.
Sewer Lateral" means the portion of a sewer line that provides sewage collection service to
a parcel of land and/ or a structure on that parcel of land, and is located between a structure
and the sewer main line in the public right-of-way.
Section 4:
Section 13. 12. 150 is hereby added to read as follows:
13. 12. 150— Maintenance —sewer laterals.
The owner of each parcel of land that is served by a sewer lateral shall be responsible for
the cleaning, repair, maintenance, and replacement of that sewer lateral.
Section 5:
Severability. If any section, subsection, sentence, clause or phrase of this
Ordinance is for any reason held to be unconstitutional and invalid, such decision shall not
affect the validity of the remaining portion of this Ordinance.
The City Council hereby
declares that it would have passed this Ordinance and every section, subsection, sentence,
clause or phrase thereof, irrespective of the fact that any one or more sections, subsections,
sentences, clauses or phrases be declared unconstitutional or invalid.
Section 6:
Certification.
The City Clerk of the City of Chino shall certify to the passage
and adoption of this Ordinance and shall cause the same to be published in a newspaper of
general circulation printed and published within the City in accordance with the provisions of
the Government Code.
