BASES DEL SORTEO: ENCUESTA MARCA IBEROSTAR
IBEROSTAR HOTELES Y APARTAMENTOS, S.L., con CIF B-28049344, es una entidad mercantil dedicada a la actividad hotelera, perteneciente al
GRUPO IBEROSTAR, y con domicilio social en Calle General Riera n° 154, C.P. 07010 de Palma de Mallorca (en adelante "la Organizadora" o
IBEROSTAR), y convoca la presente Promoción destinada a las personas residentes en España que han aceptado recibir comunicaciones
comerciales de la Organizadora. La participación en esta Promoción supone la aceptación plena e incondicional de los términos y condiciones de
estas Bases, que se detallan a continuación:
1.- OBJETO DEL CONCURSO
IBEROSTAR organiza la presente promoción que consistirá en un sorteo dirigido a premiar a las personas con residencia en España que participen
en los cuestionarios/encuestas de IBEROSTAR (“encuesta Iberostar”) que se llevarán a cabo a través de la invitación enviada por email por parte de
la Organizadora. Para poder participar, y convertirse en ganador del premio que se detalla en la cláusula 3, los participantes deberán cumplimentar
debidamente la encuesta remitida por Iberostar y rellenar los datos que se les solicitarán en el formulario de inscripción.
La participación en la presente promoción es gratuita. Esta promoción se llevará a cabo durante un plazo de diez días naturales desde la recepción
del email de Iberostar. Las presentes Bases continuarán vigentes durante toda la promoción.
IBEROSTAR se reserva el derecho de poder realizar acciones que den lugar a la consecución de más participantes a lo largo de la realización de la
promoción, incluyendo la ampliación del plazo anteriormente indicado.
IBEROSTAR se reserva el derecho a rechazar la participación en el concurso de aquellas personas que no hayan sido invitadas a su participación
mediante envío del email de la Organizadora, no completen debidamente el cuestionario o que incorporen mensajes de texto con material ilegal,
amenazante, injurioso, difamatorio, obsceno, pornográfico o de cualquier otro tipo y a retirar de la página dichos mensajes.
2.- CONDICIONES DE PARTICIPACIÓN:
Todo usuario que desee participar en el sorteo, deberá cumplimentar debidamente la “encuesta marca Iberostar” y el formulario de participación
remitido por la Organizadora, con indicación de los siguientes datos personales: Nombre y apellidos, e-mail y teléfono.
Podrá participar en la presente promoción, cualquier persona mayor de 18 años y que reciban un email de la Organizadora invitando a su
participación en la presente promoción.
Queda prohibida la participación de todas aquellas personas vinculadas laboral a profesionalmente con la entidad organizadora.
La participación en la presente Promoción sólo se realizará a través de un email a solicitud de Iberostar. Únicamente se permitirá presentar una
candidatura por persona.
Cada participante podrá participar con una sola dirección de email.
3.- PREMIO
El premio consistirá en UNA estancia gratuita de 5 noches en habitación doble y en régimen alojamiento y desayuno para DOS personas, en uno de
los siguientes hoteles de Iberostar, ubicados en Mallorca, Playa de Palma: Iberostar Cristina e Iberostar Bahía de Palma (en adelante, los hoteles de
Iberostar Mallorca).
No se incluyen en el premio los gastos de traslado ni cualesquiera gastos adicionales que pudieran asociarse al disfrute del ganador de la estancia.
La imposibilidad de beneficiarse del premio, no dará derecho al ganador a ninguna compensación o premio alternativo. Este premio no será
canjeable por una cantidad económica.
Los premios serán personales y NO podrán ser transferidos.
El participante podrá elegir las fechas de su estancia en común acuerdo con la Organizadora del concurso, siempre y cuando avise a la
Organización con un mes de antelación.
Las fechas efectivas de disfrute del premio serán siempre sujetas a la disponibilidad en el hotel de destino. En caso de que no haya disponibilidad
en las fechas solicitadas por el participante premiado, la Organizadora propondrá fechas alternativas para que pueda disfrutar de su premio o, en
su caso, podrá proponer como alternativa el alojamiento en otro hotel Iberostar. Una vez confirmada la reserva del premio no podrán modificarse
las fechas de disfrute del mismo. El plazo máximo para disfrutar del premio será desde el 1 de octubre hasta el 19 de diciembre de 2016.
4.- COMUNICACIÓN DEL GANADOR
El resultado de la Promoción será comunicado por correo electrónico.
Si la notificación es enviada a una dirección de correo que no es correcta, el ganador será descalificado. El ganador tendrá 7 días naturales a contar
desde la fecha de la comunicación para responder y confirmar que acepta el objeto del premio.
El derecho del premiado a reclamar el premio caducará si no reclamase el premio en este plazo.
La Organizadora se reserva el derecho de descalificar todo participante a ganador que haya facilitado datos falsos a que incumpla los términos y
condiciones de la Promoción, sin perjuicio de las demás acciones que procedan en Derecho.
En los supuestos en que los datos personales a la dirección donde se hubiera notificado el premio, fuera incorrecta, el premiado no reclamara el
premio en plazo, no pudiera beneficiarse del mismo, se descalificará al ganador por incumplimiento de los términos de esta promoción, y el
premio quedará desierto.
5.- SORTEO
El premio consistirá en una estancia gratuita de 5 noches, en habitación doble y en régimen alojamiento y desayuno para DOS personas, en los
hoteles de IBEROSTAR Mallorca antes indicados.
El ganador se elegirá por sorteo ante el Notario, de entre todos los participantes que hayan completado correctamente la encuesta. El sorteo se
efectuará en el plazo de 30 días desde la finalización de la promoción.
6.- PROTECCIÓN DE DATOS DE CARÁCTER PERSONAL
La participación en el concurso implica el consentimiento de los participantes para los tratamientos antes señalados. Los datos solicitados en el
formulario de inscripción son indispensables para su participación en el concurso.
De acuerdo con lo previsto en la Ley 15/1999, de 13 de diciembre, sobre Protección de Datos de Carácter Personal (en adelante LOPD), se le
informa de que los datos personales y comentarios recogidos en el proceso de participación serán tratados por IBEROSTAR HOTELES y
APARTAMENTOS, S.L. para la gestión y el control de la presente promoción y para análisis y realización de perfiles comerciales relacionados con la
marca, consintiendo necesariamente los participantes su tratamiento en las condiciones señaladas en las presentes bases. Los datos personales de
los premiados serán comunicados al hotel de destino, para el correcto disfrute del premio.
Usted podrá ejercitar los derechos de acceso, rectificación, cancelación y oposición mediante escrito acompañado de una copia de su Documento
Nacional de Identidad, ante el Departamento de LOPD, en el domicilio de IBEROSTAR, sito en Calle General Riera n° 154, C.P. 07010 de Palma de
Mallorca.
El consentimiento para los tratamientos y las cesiones de datos señalados en las presentes bases es un requisito indispensable para la
participación en la presente promoción.
7.- EXENCIÓN DE RESPONSABILIDAD POR MAL FUNCIONAMIENTO DE LA RED
La empresa organizadora no se hace responsable del mal funcionamiento de las redes de comunicación electrónicas que impidan el normal
desarrollo del concurso por causas ajenas a la empresa y especialmente por actos externos de mala fe.
Tampoco será responsable la empresa organizadora por los problemas de transmisión a pérdida de datos no imputables a la misma.
8.- GENERALES
La resolución de todas las cuestiones que puedan surgir a plantearse sobre la interpretación de las Bases, será de exclusiva competencia de
IBEROSTAR.
IBEROSTAR se reserva el derecho de modificar el contenido de las presentes Bases, así como el premio del mismo y ampliación del plazo de la
promoción, con el fin de facilitar el mayor éxito del certamen y de contribuir a la difusión del espíritu del concurso. Las Bases y sus posibles
modificaciones serán publicadas en forma permanente en http://www.iberostar.com/bases-legales-sorteo-marca-Iberostar-2016.pdf.
Cualquier pregunta, comentario a queja en relación con la promoción deberá remitirse a IBEROSTAR HOTELES y APARTAMENTOS S.L.
9.- LEGISLACIÓN APLICABLE y JURISDICCIÓN
Los términos y condiciones de la presente promoción, se regirán por la Ley Española.
Para cuantas cuestiones puedan derivarse de las presentes Bases, expresamente se someterán a los Juzgados y Tribunales de Palma de Mallorca.
La participación en el concurso supone la aceptación en su totalidad de las presentes bases.
PRIZE DRAW ENTRY RULES: IBEROSTAR BRAND SURVEY
IBEROSTAR HOTELES Y APARTAMENTOS, S.L., holder of tax registration no. B-28049344, is a trading company specializing in the hotel sector which
forms part of the GRUPO IBEROSTAR, with registered offices at Calle General Riera n° 154, C.P. 07010 Palma de Mallorca (henceforth “the
Organizer” or IBEROSTAR). It hereby announces the following Promotion aimed at persons resident in the United Kingdom who have agreed to
receive marketing information from the Organizer. Participation in this Promotion implies full unconditional acceptance of the terms and
conditions of these Entry Rules, outlined below:
1.- PURPOSE OF THE COMPETITION
IBEROSTAR is the organizer of this Promotion. It consists of a prize draw aimed at rewarding persons resident in the United Kingdom who answer
Iberostar questionnaires/surveys (“Iberostar survey”) on e-mail invitation by the Organizer. To enter and win the prize outlined in point 3, the
participants must duly complete the survey sent by Iberostar and fill in the details requested in the entry form.
Participation in this promotion is free. This promotion shall last for a period of ten calendar days from receipt of the e-mail sent by Iberostar. These
Entry Rules shall remain in effect throughout the whole of the promotion.
During the course of this promotion, IBEROSTAR reserves the right to take any action aimed at boosting the number of participants, including the
extension of the time limit mentioned above.
IBEROSTAR reserves the right to refuse to allow persons who have not received an e-mail invitation from the Organizer to take part in the
promotion, in addition to anyone failing to complete the questionnaire as required and anyone including text messages containing illegal,
threatening, offensive, defamatory, obscene, pornographic or any other type of material, and to remove such messages from the web page.
2.- TERMS & CONDITIONS OF ENTRY:
All users wishing to enter the prize draw must duly complete the “Iberostar brand survey” and entry form sent by the Organizer, providing the
following personal details: their first name and surname, e-mail address and telephone no.
This promotion is open to any person over the age of 18 receiving an e-mail from the Organizer inviting them to take part in it.
Anyone with employment or professional links with the organizing body is strictly forbidden from taking part in it.
Participation in this promotion shall only be possible through e-mail invitation from Iberostar. Only one entry is permitted per person.
Each entrant may only take part with one e-mail address.
3.- PRIZE
The prize shall consist of ONE free 5-night stay in a double room with bed and breakfast for TWO people at one of the following Iberostar hotels,
located in Playa de Palma, Mallorca: Iberostar Cristina and Iberostar Bahía de Palma (henceforth Iberostar Mallorca hotels).
The prize does not include travel costs to and from the hotel or any other additional costs associated with the winner’s use of the stay.
In the event that the winner is not able to take up the prize, this shall not entitle them to any compensation or alternative prize. This prize may not
be exchanged for an amount of money.
The prizes are personal and NON transferable.
The entrant may choose the dates of their stay by mutual agreement with the Organizer of the competition, provided that they give the Organizer
one month’s prior notice.
The dates when the stay is made shall always be subject to availability at the destination hotel. If there are no available rooms on the dates
requested by the prize-winner, the Organizer shall propose alternative dates for them to make the stay or, if applicable, propose accommodation
at another Iberostar hotel as an alternative. Once the reservation of the prize-winner’s stay has been confirmed, the dates of the said stay may not
be changed. The stay must be taken at some point between October 1st and December 19th 2016.
4.- NOTIFICATION OF THE WINNER
The outcome of this Promotion shall be made known by e-mail.
If notice is sent to an incorrect e-mail address, the prize-winner shall be disqualified. The winner shall have 7 calendar days from the date of
receipt of notice to reply and confirm their acceptance of the prize.
The prize-winner’s right to claim the prize shall expire if they fail to claim it within this time limit.
The Organizer reserves the right to disqualify all entrants who provide false data and thus fail to observe the terms and conditions of the
Promotion, without prejudice to any other legal action that may be befitting in Law.
If the personal details of the holder of the e-mail address where notice of the prize is sent are incorrect, the prize winner fails to claim the prize
within the required deadline or is unable to take advantage of it, the winner shall be disqualified for non-compliance with the terms and
conditions of this promotion and the prize shall be declared null and void.
5.- PRIZE DRAW
The prize shall consist of a free 5-night stay in a double room with bed and breakfast for TWO people at one of the aforementioned IBEROSTAR
Mallorca hotels.
The winner shall be chosen at a prize draw conducted in the presence of a Notary Public from among all the entrants who have completed the
survey correctly. The prize draw shall take place within a period of 30 days of the end of the promotion.
6.- DATA PROTECTION
Participation in the competition automatically implies the entrants’ acceptance of the processing of the above personal data. The data requested
in the entry form is a compulsory requisite for entry in the competition.
In accordance with the provisions of Spanish Data Protection Act 15/1999 of December 13th (henceforth the LOPD), you are hereby informed that
the personal data and remarks gathered during the entry process shall be processed by IBEROSTAR HOTELES y APARTAMENTOS, S.L. for the
management and control of this promotion and to analyse and draw up sales profiles for the brand. The entrants necessarily consent to the
processing of the said data under the terms and conditions described herein. The personal details of the prize-winners shall be made known to the
destination hotel so as to ensure due use of the prize.
You may exercise your right of access, rectification, cancellation and objection in writing, accompanied by a copy of your identity card, sending it to
the LOPD Department at IBEROSTAR’s registered offices at Calle General Riera n° 154, C.P. 07010 Palma de Mallorca, Illes Balears (Spain).
Consent for the processing and transfer of the data mentioned herein is a compulsory requisite for participation in this promotion.
7.- EXEMPTION FROM LIABILITY IN THE EVENT OF A SYSTEM MALFUNCTION
The organizing company cannot be held liable for malfunctions not attributable to it in electronic data transmission systems that prevent this
competition from following its proper course or, more particularly, for external acts of bad faith.
Neither may the organizing company be held liable for lost data due to transmission problems not attributable to it.
8.- GENERAL TERMS & CONDITIONS
IBEROSTAR shall be solely responsible for resolving any issues that might arise regarding the interpretation of the Entry Rules.
IBEROSTAR reserves the right to amend the contents of these Entry Rules and their associated prize and to extend the period of this promotion in
order to boost the competition’s success and to contribute to the dissemination of the spirit of the competition. The Entry Rules and any possible
changes shall be permanently published on http://www.iberostar.com/bases-legales-sorteo-marca-Iberostar-2016.pdf.

9.- APPLICABLE LEGISLATION & JURISDICTION
The terms and conditions of this promotion shall be governed by Spanish legislation.
For all matters deriving from these Entry Rules, the parties expressly agree to abide by the decisions of the Palma de Mallorca Law Courts.
Entry in the competition automatically implies full acceptance of these entry rules.
TEILNAHMEBEDINGUNGEN DES GEWINNSPIELS: UMFRAGE ZUR MARKE IBEROSTAR
IBEROSTAR HOTELES Y APARTAMENTOS, S.L., mit spanischer Steuer-ID-Nr. B-28049344, ist eine Handelsgesellschaft, die sich dem Hotelgewerbe
widmet, zur GRUPO IBEROSTAR gehört und ihren Firmensitz in Calle General Riera Nr. 154, 07010 Palma de Mallorca hat (im Anschluss die
„Veranstalterin“ oder IBEROSTAR) veranstaltet die vorliegende Werbeaktion, gerichtet an Personen mit Wohnsitz in Deutschland, die sich mit dem
Erhalt von kommerziellen Mitteilungen der Veranstalterin einverstanden erklärt haben. Die Teilnahme an dieser Werbeaktion bedeutet die
vollständige und bedingungslose Annahme der Geschäftsbedingungen in den vorliegenden Gewinnspielgrundlagen, die nachfolgend aufgeführt
werden:
1. GEGENSTAND DES GEWINNSPIELS
IBEROSTAR veranstaltet die vorliegende Werbeaktion in Form einer Verlosung mit dem Zweck, diejenigen Personen mit Wohnsitz in Deutschland
zu belohnen, die an den Fragebogen/Umfragen von IBEROSTAR („Iberostar-Umfrage“) teilnehmen, durchgeführt anhand einer von der
Veranstalterin per E-Mail verschickten Einladung. Um daran teilnehmen zu können und den Preis zu gewinnen, der in Bestimmung 3 genannt wird,
müssen die Teilnehmer die von Iberostar übermittelte Umfrage ordnungsgemäß ausfüllen und die auf dem Anmeldeformular abgefragten Daten
angeben.
Die Teilnahme an der vorliegenden Werbeaktion ist kostenlos. Diese Werbeaktion wird innerhalb eines Zeitraums von zehn Kalendertagen ab
Erhalt der E-Mail von Iberostar durchgeführt. Die vorliegenden Bestimmungen sind während der gesamten Werbeaktion gültig.
IBEROSTAR behält sich das Recht auf mögliche Schritte vor, um während der Durchführung der Werbeaktion weitere Teilnehmer zu bekommen,
einschließlich einer Verlängerung des ursprünglich angegebenen Zeitraums.
IBEROSTAR behält sich das Recht vor, all diejenigen Personen von der Teilnahme am Gewinnspiel auszuschließen, die nicht von der Veranstalterin
per E-Mail zur Teilnahme eingeladen wurden, den Fragebogen nicht ordnungsgemäß ausfüllen oder in ihre Mitteilungen illegales, bedrohliches,
beleidigendes, verleumderisches, obszönes, pornografisches oder andersgeartetes Material einfügen, und derartige Nachrichten von der Website
zu entfernen.
2. TEILNAHMEBEDINGUNGEN:
Alle Benutzer, die an dem Gewinnspiel teilnehmen möchten, müssen die „Umfrage zur Marke Iberostar“ und das von der Veranstalterin
übermittelte Teilnahmeformular unter Angabe folgender personenbezogener Daten ordnungsgemäß ausfüllen: Vor- und Nachname, E-Mail und
Telefon.
An der vorliegenden Werbeaktion können alle Personen über 18 Jahre teilnehmen, die eine E-Mail von der Veranstalterin erhalten, in der sie zur
Teilnahme an der vorliegenden Werbeaktion eingeladen werden.
Die Teilnahme ist allen untersagt, die sich in einem Arbeitsverhältnis mit der Veranstalterin befinden oder geschäftlich mit ihr in Verbindung
stehen.
Die Teilnahme an der vorliegenden Werbeaktion kann nur auf Anfrage von Iberostar per E-Mail erfolgen. Pro Person ist nur eine Teilnahme
zulässig.
Jeder Mitspieler darf nur mit einer einzigen E-Mail-Adresse teilnehmen.
3. PREIS
Der Preis besteht aus EINEM kostenlosen Aufenthalt mit 5 Übernachtungen mit Frühstück im Doppelzimmer für ZWEI Personen in einem der
folgenden Iberostar-Hotels auf Mallorca, Playa de Palma: Iberostar Cristina und Iberostar Bahía de Palma (nachfolgend kurz Iberostar-Hotels auf
Mallorca).
Im Preis sind weder die Reisekosten noch irgendwelche zusätzlichen Kosten enthalten, die dem Gewinner beim Genuss seines Aufenthalts
entstehen.
Sollte es dem Gewinner unmöglich sein, den Preis in Anspruch zu nehmen, gibt ihm dies nicht das Recht auf irgendeine Art von Entschädigung oder
einen anderen Preis. Der Preis ist nicht gegen einen Geldbetrag einlösbar.
Die Gewinne sind persönlich und NICHT übertragbar.
Der Teilnehmer kann die Termine seines Aufenthalts in Vereinbarung mit der Veranstalterin des Gewinnspiels wählen, wobei er die Veranstalterin
einen Monat zuvor informieren muss.
Die tatsächlichen Termine für die Wahrnehmung des Preises unterliegen der Verfügbarkeit in dem gewählten Hotel. Falls zu den vom Gewinner
des Preises gewählten Terminen keine Verfügbarkeit besteht, wird die Veranstalterin andere Termine vorschlagen, damit er seinen Preis genießen
kann, oder ggf. als Alternative die Unterkunft in einem anderen Iberostar-Hotel anbieten. Sobald die gewonnene Buchung bestätigt ist, können die
Termine zum Genuss derselben nicht mehr geändert werden. Der maximale Zeitraum für die Einlösung des Preises ist vom 1. Oktober bis zum 19.
Dezember 2016.
4. BEKANNTGABE DES GEWINNERS
Das Ergebnis der Werbeaktion wird per E-Mail mitgeteilt.
Wenn die Mitteilung an eine unrichtige E-Mail-Adresse geschickt wird oder keine E-Mail-Adresse angegeben wurde, wird der Gewinner
disqualifiziert. Der Gewinner hat 7 Kalendertage ab dem Tag der Benachrichtigung, um zu antworten und zu bestätigen, dass er den Gegenstand
des Preises akzeptiert.
Das Recht des Gewinners, den Preis in Anspruch zu nehmen, verfällt, wenn er dies nicht innerhalb der genannten Frist tut.
Die Veranstalterin behält sich das Recht vor, jeden Teilnehmer oder Gewinner zu disqualifizieren, der falsche Daten angegeben hat oder die
Geschäftsbedingungen der Werbeaktion nicht erfüllt, unbeschadet aller weiteren Schritte, die rechtlich zulässig sind.
In den Fällen, dass die persönlichen Daten oder die E-Mail-Adresse, an welche die Mitteilung des Preises geschickt wurde, unrichtig sind, der
Gewinner den Preis nicht fristgerecht beansprucht oder den Preis nicht annehmen kann, wird der Gewinner aufgrund von Nichterfüllung der
Bestimmungen dieser Werbeaktion disqualifiziert und der Preis wird nicht verliehen.
5. VERLOSUNG
Der Preis besteht aus einem kostenlosen Aufenthalt mit 5 Übernachtungen mit Frühstück im Doppelzimmer für ZWEI Personen in den o.g.
Iberostar-Hotels auf Mallorca.
Der Gewinner wird per notariell überwachter Verlosung aus allen Teilnehmern gewählt, die die Umfrage korrekt ausgefüllt haben. Die Verlosung
wird innerhalb von 30 Tagen nach Beendigung der Werbeaktion durchgeführt.
6. SCHUTZ PERSONENBEZOGENER DATEN
Die Teilnahme an dem Gewinnspiel bedeutet automatisch die Zustimmung der Teilnehmer zu der o. g. Verarbeitung ihrer Daten. Die in dem
Teilnahmeformular angeforderten Daten sind für die Teilnahme an dem Wettbewerb unerlässlich.
Gemäß den Vorschriften im spanischen Gesetz 15/1999 vom 13. Dezember über den Schutz personenbezogener Daten (nachfolgend kurz LOPD
genannt) wird mitgeteilt, dass die persönlichen Daten und Kommentare, die im Verlauf der Teilnahme erfasst werden, von IBEROSTAR HOTELES Y
APARTAMENTOS, S.L. für die Verwaltung und Kontrolle der vorliegenden Werbeaktion und zur Analyse und Erstellung kommerzieller Profile im
Zusammenhang mit der Marke verarbeitet werden, wobei die Teilnehmer notwendigerweise der Verarbeitung derselben nach den in den
vorliegenden Bestimmungen angegebenen Bedingungen zustimmen müssen. Die personenbezogenen Daten der Gewinner werden dem
gewählten Hotel mitgeteilt, damit der Preis ordnungsgemäß in Anspruch genommen werden kann.
Sie können Ihre Rechte auf Zugriff, Berichtigung, Löschung und Einspruch schriftlich unter Beilage einer Kopie Ihres Personalausweises bei der
Datenschutzabteilung unter der Adresse von IBEROSTAR, Calle General Riera 154, 07010 Palma de Mallorca, Illes Balears (Spanien) ausüben.
Das Einverständnis mit der in den vorliegenden Bestimmungen genannten Verarbeitung und Überlassung der Daten ist eine unerlässliche
Voraussetzung für die Teilnahme an der vorliegenden Werbeaktion.
7. HAFTUNGSBEFREIUNG IM FALLE EINES SCHLECHTEN FUNKTIONIERENS DES INTERNETS
Die Veranstalterin übernimmt keine Haftung für ein schlechtes Funktionieren der elektronischen Kommunikationsnetze, das eine normale
Abwicklung des Wettbewerbs aus Gründen, die nicht der Firma anzulasten sind, und vor allem aufgrund von böswilligen externen Handlungen,
unmöglich machen.
