NOTE 39 – PARTICIPATION IN ELECTRIC ENERGY PUBLIC GENERATION AND TRANSMISSION AUCTIONS During 2006, the Company successfully participated in several biddings to sell energy to final consumers and traders, in the Free Agreement Context - ACL, becoming it one of the main agents of this sector in the market. As established in Article 15 of Law No. 3.890-A of April 25, 1961, with the wording of Article 22 of Law No. 10.438, of April 22, 2002, FURNAS can participate, as a minor partner, in SPE, which will be responsible for the construction and exploration of new installations. FURNAS bought three hydroelectric plants sold in the First Auction for Energy from New Installations carried out by Aneel on December 16, 2005. The Company also acquired the concession for the plants of Simplício/Anta (333.7 MW average), Batalha (52.5 MW average) and the participation of 15% (21 MW average) in the plant of Baguari, which has the participation of Cemig (34%) and Neoenergia (51%). In the same auction, FURNAS negotiated 100% of the energy of these installations, in addition to selling an average 90 MW of Manso HPP. On December 10, 2007, Consortium Mesa S.A, made up of FURNAS (39%), Odebrecht Investimentos (17.6%), Andrade Gutierrez Participações (12.4%), Cemig (10%), Fundos de Investimentos e Participações da Amazônia (20%) and Construtora Norberto Odebrecht (1%) won, in an auction held by Aneel, the concession to build and operate the construction project of Santo Antônio HPP, in the Madeira river, Rondônia. The work is estimated to start in December 2008. Operations of the first and the second generating units are contemplated to begin in December 2012 and the last in June 2016. On November 24, 2008, FURNAS, through the Renewable Transenergy Consortium (FURNAS – 49%; Delta Construções S.A. – 25.50% and Fuad Rassi Engenharia, Indústria e Comércio Ltda – 25.50%), purchased during an Aneel auction a lot for the construction and operation of three transmission lines: Chapadão-Jataí; Barra dos Coqueiros-Quirinópolis and Palmeiras–Edéia; for a total of 635 km between Goiás and Mato Grosso do Sul. On November 26, 2008, the Wood Transmission Consortium (consisting of FURNAS, Companhia de Transmissão de Energia Elétrica Paulista – CTEEP and Companhia Hidro Elétrica do São Francisco – CHESF), earned permission to construct and operate the Porto VelhoAraraquara line (Madeira line), extending 2,375 km and traversing five Brazilian states. The value of the accrued asset was 0.21%, corresponding to an RAP of R$ 176,249 thousand. This consortium also won Lot F in the auction, with RAP of R$ 151,788 thousand, corresponding to an accrued asset of 9.99%. The lot includes the construction of a rectifying station (3,150 MW) and an inverter station (2,950 MW). 15
