Section 212.06(5)(b), F.S., provides:
“Notwithstanding the provisions of paragraph (a), it is not the intention of this chapter to levy a tax on the sale of tangible
personal property to a nonresident dealer who does not hold a Florida sales tax registration, provided such nonresident dealer furnishes the
seller a statement declaring that the tangible personal property will be transported outside of Florida by the Nonresident dealer for resale
and no other purpose. The statement shall include, but not be limited to, the nonresident dealer’s name, address, applicable passport or visa
number, arrival-departure card number, and evidence of authority to do business in his home state or country, such as his business name
and address, his occupational license number, if applicable, or any other suitable requirement. The statement shall be signed by the
nonresident dealer and shall include the following sentence: ‘Under penalties of perjury, I declare that I have read the foregoing, and the
facts alleged are true to the best of my knowledge and belief.’ The burden of proof of this paragraph rests with the seller, who must retain
the proper documentation to support the exempt sale. The exempt transaction is subject to verification by the department.”
Seçào 212.06(5)(b), F.S., determina:
“Não obstante as disposiçòes do parágrafo (a), não é intensão deste capítulo arrecadar um imposto sobre vendas de propriedade
pessoal tangível para um distribuidor não residente que não possua um registro de contribuinte de impostos sobre vendas da Flórida,
sempre e quando tal distribuidor não residente forneça ao vendedor uma declaração indicando que a propriedade pessoal tangível será
transportada para fora do estado da Flórida pelo distribuidor não residente para revenda e nenhum outro propósito. A declaração deve
incluir, mas não se limitar a, o nome do distribuidor não residente, endereço, número do passaporte ou visto aplicável, número do cartáo de
chegada-saida, e prova de licença comercial do seu país ou estado de residéncia, tal como nome da empresa e endereço seu número de
licença profissional, se cabivel, ou qualquer outro requisito apropriado. A declaraçao deverá ser assinada pelo distribuidor não residente e
deverá incluir o seguinte parecer: ‘Sob pena de perjúrio, declaro que li o supra citado, e os fatos alegados são verdadeiros e de boa fé.’ O
dever de provar este parágrafo compete ao vendedor, que deve preservar a documentação que suporta a venda isenta. A transação isenta
está sujeita a verificação por esse departamento.”
