There is no opportunity, at least for now, given the impossibility of formation of res judicata material in
this kind of action, to regulate the visits to the benefit of the author, before conclusive social and

grasp the point of view of this psychologist children are well taken care of mothers'. Are uneasy about

Relação: 0105/2014 Teor do ato: ALEXANDER SMUGLOVSKY, devidamente qualificado nos autos,
ingressou com ação de regulamentação de visitas em face de WANIA LÚCIA ELIAS, alegando, em estrito
resumo, que é pai de Israel Elias Smuglovsky, não deixando a genitora requerida exercer seu direito de
visitas. Pediu, assim, a regulamentação liminar e definitiva das suas visitas (fls. 2/6). A demandada,
citada, contestou a fls. 155/169, refutando a pretensão de mérito do demandante. Realizaram-se
estudos sociais a fls. 222/227. A fls. 543/544, determinou-se a realização de estudo psicológico no
demandante. Certificou-se, procedentemente, que a ré está residindo nos EUA, enquanto o autor,
possivelmente, está em Fortaleza (fls. 567 e ss.). O Ministério Público foi intimado e se manifestou a fls.
356 v. Em apenso, ingressou a ré, em face do autor, com uma ação cautelar inominada, cuja fase
citatória ainda não foi implementada. É o relatório. Fundamento e decido. Não há ensejo, ao menos por
ora, dada a ausência de possibilidade de formação de coisa julgada material na presente espécie de
ação, para se regulamentar a visitas em proveito do autor, diante dos conclusivos estudos social e
psicológico aqui realizados. Com efeito, valiosas as assertivas lançadas pela psicóloga judiciária a fls. 222
e ss.: "As crianças mostram-se muito afetivas em relação à genitora e com muito medo de retomar a
relação com o pai de Israel. Têm a mãe como referência durante toda a entrevista, demonstrando que
ela é continente à sua ansiedade. As crianças estão bem cuidadas, aparentemente bem de saúde, com
uma relação muito solidária entre eles. Elihana é uma menina doce, e muito inteligente. Diz que
Alexander "era maldoso, mentiroso" e, com muito carinho, afirma que em sua opinião a mãe aprendeu
com a experiência que viveram. Elihana, por sua vez, relata que "com 5 anos ele me chamava no meio
da noite, quando minha mãe estava grávida e dormindo. Me levava pro outro lado da casa e me
colocava sentada no colo dele. Ele mexia o corpo dele, pra frente e pra trás, eu reclamava... ele levou o
Israel pra delegacia uma vez porque ele não quis dar um beijo nele pra se despedir... meu irmão contou
pra mim que ele abria a bunda dele pra colocar o dedo e dizia que ele era gay... eu vi ele bater na minha
mãe... sempre dava loucura nele... estava bem e de repente jogava tudo no chão, brigava, batia... ele é
muito agressivo, perigoso, mau... ele sempre dizia:- vai ser a minha palavra contra a sua... eu tenho
medo dele... acho que ele pode matar a minha mãe... não acho que ele veio buscar o meu irmão por
amor, mas ele quer atingir a minha mãe." Israel conta que "ele (pai) me amarrava na cadeira com fio de
telefone... dava tapa... amarrou de castigo... não tinha feito nada... falava pra mim abaixar as calças...
pra ele ver se tinha coco dentro... ele abria a bunda com as mãos... ele punha o dedo no bumbum...
também me jogou no fundo do mar e eu não sabia nadar... eu tava chorando... ele é que tirava a minha
calça... ele me chamava de gay, me ensinava a fazer o dedo do meio... ele parece gay, porque ele faz pra
me mostrar como é que é... ele batia com cinto, me queimava de cigarro... me comprava boneca,
brinquedo de menina, bolsinha... ele também bebia, ficava louco... vinho, cerveja, muito vinho..."
Baseado no que foi possível apreender, do ponto de vista desta psicóloga as crianças estão bem sob os
cuidados da genitora. Demonstram receio em ter contato com o pai de Israel e ele mesmo afirma não
querer ter proximidade com ele. Fazem relatos importantes e preocupantes sobre violência física, sexual
e psicológica, que não podem ser desprezados, já que repetidos em situações diversas, para diferentes
profissionais. O parecer é contra a regulamentação das visitas neste momento, já que somente a idéia
de visitas, mesmo supervisionadas, provoca intensa angústia no menino e sua família." Posto isso, julgo
improcedente a ação, ao menos neste instante, condenando o autor ao pagamento de custas, despesas
e verba honorária, ora fixada em R$ 2.000,00, na forma do artigo 20, parágrafo 4°, do Código de
Processo Civil. Ao trânsito, observadas as formalidades legais, arquivem-se. P. R. I. Guarujá, 25 de março
